easyJet UK261 vs EC261: choose the law from the route and operator

An EU departure engages EC261. Flights between the two areas can fall within both frameworks, but a passenger cannot collect two fixed awards for the same disruption. The EZY, EJU or EZS prefix becomes especially important for inbound travel.

Identify the operating entity
easyJet's current terms say:
EZYis normally operated by easyJet UK Limited;EJUis normally operated by easyJet Europe Airline GmbH in Austria;EZSis normally operated by easyJet Switzerland S.A.
The terms also say the operating airline will be shown in Flight Tracker and that easyJet will notify passengers if another carrier operates the service. Save this record. The company that sold the booking, aircraft owner and operating air carrier can be different legal concepts.
An EU departure does not require an EU airline, so an EZY service leaving Paris is covered by EC261. Inbound travel is where operator status commonly decides coverage: an EJU flight from a third country to the EU has a stronger EC261 basis than an otherwise identical service operated by a non-EU airline.
UK261 amounts and scope
UK261 provides GBP 220 below 1,500 km, GBP 350 from 1,500 to 3,500 km and GBP 520 above 3,500 km. On the longest delay category, three to four hours normally produces half, GBP 260.
UK departure coverage applies regardless of airline nationality. Inbound coverage extends to qualifying UK or EU operators under current CAA guidance. The legal status of easyJet Switzerland in a particular inbound scenario deserves careful checking rather than automatic classification as UK or EU.
UK261 also supplies care, refund and rerouting. The UK CAA says a cancellation can require alternative transport by another airline when that route reaches the destination significantly sooner.
EC261 amounts and scope
EC261 pays EUR 250 up to 1,500 km, EUR 400 for intra-EU journeys above 1,500 km and other journeys from 1,500 to 3,500 km, and EUR 600 for other covered journeys above 3,500 km.
All EU departures are covered, subject to passenger conditions. An arrival from a third country is covered when the operating carrier meets the EU or Community-carrier test and equivalent benefits were not already received in the third country under the regulation's conditions.
Switzerland adopted Regulation 261 through its bilateral aviation agreement. Swiss FOCA explains that references to the EU in its passenger guidance include Switzerland, Norway and Iceland for this purpose. Swiss enforcement and treatment of later Court of Justice case law can still require local analysis.
Two laws, one disruption
A flight from Amsterdam to Gatwick operated by easyJet Europe begins in the EU and arrives in the UK on an EU airline. Both systems may have a connection. That does not allow EUR 250 plus GBP 220 for one delayed segment. Fixed compensation addresses the same inconvenience, and double recovery is not the purpose of overlapping legislation.
Choose the route that matches the operating facts and forum. If easyJet pays under one regime, disclose it in any other proceeding. Differences in currency or procedure do not create two losses.
Care receipts also cannot be recovered twice. If easyJet reimburses a hotel under UK261, the same invoice should not be claimed again under EC261. A separate package organiser may owe a different remedy, but compensation for the identical expense must be coordinated.
Delay, cancellation and denied boarding
Both regimes preserve fixed compensation for arrival delays of at least three hours, subject to cause. Door opening is the relevant marker rather than touchdown. Long-distance amount reductions differ in currency but follow comparable timing logic.
Cancellation normally creates refund or rerouting and possible compensation when notice is below 14 days. Replacement-flight safe harbours and reductions require exact schedule comparison. Involuntary denied boarding creates a claim without waiting for a three-hour arrival delay.

Extraordinary circumstances in both systems
Severe weather, ATC decisions, airport closure and security incidents can exclude fixed compensation when directly causal and unavoidable despite reasonable measures. Routine technical defects generally remain within airline operations. The retained UK framework and current EC261 both require evidence rather than a bare label.
An EU Court judgment issued after Brexit may not bind a UK court in the same way as pre-exit retained case law. Avoid assuming that every future European interpretation automatically changes UK261. Conversely, a UK CAA page does not determine an EC261 proceeding in an EU court.
Procedure and deadlines diverge
easyJet uses the same EC261-branded online compensation portal for claims, but identify the regime and currency in the text. For eligible UK-connected disputes, its terms point to AviationADR within 12 months of the final response.
EC261 court limitation comes from national law under C-139/11. easyJet's terms state six years in England and Wales for Regulation 261 and APR 2019 claims. Other forums differ. The future EU nine-month submission and 30-day response rules are adopted but not applicable on 10 August 2026; they will not automatically amend UK261.
Evidence checklist
Keep the airport pair, travel date, original schedule, booking reference and every passenger name. Save the flight prefix and “operated by” entry. Record door opening, cancellation notice delivery or gate refusal as relevant. Preserve the cause message, replacement offer and itemised expenses.
In the claim, explain coverage in one sentence: “The flight departed the UK, so UK261 applies,” or “The flight departed an EU airport, so EC261 applies.” For inbound travel, add the operator and its legal base. This is clearer than citing both regimes without analysis.

Does every easyJet flight use UK261 because easyJet began in Britain?
No. EU departures use EC261, Swiss departures use the adopted Swiss framework, and operator status matters for inbound routes. Corporate history does not replace the route test.
What do EZY, EJU and EZS mean?
easyJet states that they normally identify easyJet UK, easyJet Europe and easyJet Switzerland respectively. Confirm the current operating-airline notice for the actual flight.
Can I claim both EUR 250 and GBP 220 for the same delay?
No double recovery should be expected. Overlapping laws may offer procedural choices, but one disruption does not create two statutory inconvenience payments.
