Delta from the United States to Europe: when compensation is not due
A direct flight from the United States to Europe operated by Delta Air Lines normally does not qualify for fixed EU261 or UK261 compensation. Delta is a US carrier, so destination alone does not create EUR 600 or GBP 520. Passengers can still have valuable cash-refund, rebooking, expense, baggage or partner-operated claims, and a DL flight number may conceal an Air France, KLM or Virgin Atlantic operation that changes the answer.

Buying the ticket from a European website, paying in euros or holding EU citizenship does not turn Delta into an EU carrier.
Why the return direction is different
EU261 covers departures from the EU on any airline. For arrivals from outside, the flight normally needs an EU operating carrier. Delta satisfies the outbound rule when leaving Europe but not the inbound carrier rule when it operates from the United States.
UK261 similarly covers departures from Britain on any airline, while inbound coverage generally requires a UK or EU operator. Delta's American status therefore matters on the US-UK direction.
A return booking contains distinct flights. Paris-New York on Delta can be protected; the later New York-Paris Delta operation usually is not. Sharing one confirmation does not export outbound scope across a stay in the United States.

The operating partner can rescue an inbound claim
Delta participates in a transatlantic joint venture with Air France, KLM and Virgin Atlantic. Codeshare displays often show a DL marketing number even when a partner supplies the aircraft and crew.
Air France and KLM are EU carriers, so their operation can bring an inbound service to the EU within EU261. Virgin Atlantic is a UK carrier and can bring a US-London service within UK261. The statutory claim goes to that operating airline, not automatically to Delta because it issued the ticket.
The reverse is equally important. An AF, KL or VS number operated by Delta remains a Delta operation and normally lacks inbound fixed coverage. Aircraft paint, lounge access and loyalty credit are not reliable legal tests.

US DOT cash-refund rights still matter
When Delta cancels or significantly changes a flight and the passenger rejects the alternative, US rules generally require an automatic refund. Current standards define significant changes through events such as a sufficiently large schedule shift, different airports in specified circumstances, extra connections, downgrade or an accessibility-impacting aircraft change.
For international travel, Delta's current general threshold is six hours earlier or later for many tickets issued from 28 October 2024. If the passenger accepts and flies the replacement, a full ticket refund is ordinarily no longer due.
This is reimbursement, not inconvenience compensation. US federal law does not create a universal fixed cash award for every completed ordinary delay. A seven-hour Delta delay from Atlanta to Paris can therefore end with no statutory flat payment if the passenger travelled, although other losses may need review.
Rebooking and Delta's customer commitment
Delta normally attempts automatic rebooking after cancellation or significant disruption. The passenger can search alternatives in My Trips or the Fly Delta app. For controllable cancellation, delay or misconnection, Delta's current customer commitment includes specified meals, hotel accommodation and transport in qualifying situations.
Those commitments are different from EU261 care. On an uncovered US departure, read the controllability conditions and request help at the airport. Save written promises, vouchers and any refusal.
Delta states that US or Canadian residents can use its reimbursement form for certain controllable disruption expenses, while other residents should use Comment and Complaint. Residence affects that Delta submission channel; it does not create European fixed compensation.
eCredit is optional when cash is owed
Delta may offer an eCredit, currently described on its disruption page as valid for five years. A passenger can choose it for flexibility, but a legally required refund should not be converted into credit without agreement.
Before accepting, check expiry, named traveller restrictions, transferability and whether the selection waives a cash request. Capture the screen. If no alternative travel, credit or other benefit was accepted after a qualifying cancellation or change, request the original payment method.

Baggage claims survive the EU261 answer
International Delta travel can be governed by the Montreal Convention. Delayed, lost or damaged baggage is a separate claim with short notice periods and proof requirements. Delta currently identifies a 1,519 SDR per-passenger Convention limit; that ceiling is not automatic compensation.
Report the problem to Delta's Baggage Service Office, obtain the file reference and preserve bag tags. Damage generally needs notice within seven days for international travel. Delay complaints generally require written action within twenty-one days after delivery. A bag not found within twenty-one days is treated by Delta as likely lost.
An uncovered New York-Amsterdam flight can still produce reimbursement for reasonable essential purchases caused by baggage delay.
Proven delay damage and insurance
The Montreal Convention can also address proven damage caused by international passenger delay, subject to causation, defences and the current 6,303 SDR limit. It is not a flat payout and does not compensate inconvenience alone.
Travel insurance or card benefits may cover accommodation, missed events or replacement arrangements beyond Delta's commitment. Observe notice and mitigation requirements. A package organiser or OTA can also have separate contractual obligations.
Do not label every expense "EU261 compensation". Identify the correct legal or contractual path to keep a valid request credible.
Connection nuance
A journey that truly started in Europe and merely connects in the United States is different from a new US-origin flight. For example, Amsterdam-Atlanta-Miami on one reservation can remain a protected EU journey even though the disruptive Atlanta-Miami sector is domestic.
By contrast, a passenger who stayed in Atlanta for several days and later flew Atlanta-Amsterdam is normally on a separate inbound journey. Examine stopover, ticket coupons and final destination rather than using the location of disruption alone.
Evidence and next action
Save the full e-ticket, operating airline, ticket issuer, cancellation or delay notice, offered alternative and proof of rejection or acceptance. For expenses, retain itemised receipts and the stated cause. For baggage, keep the file reference, tags, inventory and written complaint.
Then choose one accurate route:
- European fixed claim against a qualifying partner operator;
- DOT cash refund after rejected cancellation or significant change;
- Delta customer-service expense request;
- Montreal baggage or proven-delay claim;
- insurance, package or agent remedy.
An outcome of "no EU261" does not mean "no passenger rights." It means the request must target what the itinerary actually supports.
