Delta codeshare compensation: Air France, KLM or Virgin Atlantic?

On a Delta codeshare, the airline named beside "operated by" normally answers the EU261 or UK261 fixed-compensation claim. This is especially valuable on travel from the United States to Europe: Delta operation is normally outside fixed inbound coverage, while Air France or KLM operation can bring an EU arrival within EU261 and Virgin Atlantic operation can bring a UK arrival within UK261.

Why inbound coverage changes with the operator

EU261 covers arrivals from outside the EU when an EU airline operates the flight. Air France and KLM satisfy that carrier test. A DL-coded New York-Paris service operated by Air France or Detroit-Amsterdam service operated by KLM can therefore qualify.

UK261 covers certain inbound flights operated by UK or EU carriers. Virgin Atlantic operation on New York-London can be protected. Direct Delta operation on the same inbound city pair normally is not.

For departures from the EU or UK, any operating airline can be covered. Operator still decides whom to claim against, even though territorial scope would exist for Delta too.

Joint venture is not joint statutory liability

Delta, Air France, KLM and Virgin Atlantic coordinate transatlantic schedules and commercial products. That arrangement can simplify booking and rerouting, but it does not mean every partner owes the same fixed compensation.

Distinguish:

  • marketing carrier: code displayed in the flight number;
  • operating carrier: airline performing the flight with aircraft and crew;
  • ticketing carrier: airline whose ticket stock was used;
  • merchant or agent: company that collected payment;
  • replacement carrier: airline that eventually transported the passenger.

One company can fill several roles, but a fixed EU/UK claim starts with operation. Refund servicing can still sit with the ticket issuer or agent.

One-ticket partner connections

Partner itineraries can contain an Air France feeder, Delta transatlantic sector and Delta Connection onward flight. List every operator rather than assigning one carrier to the whole ticket.

If a Paris departure on one reservation reaches the final US destination at least three hours late, EU261 can apply to the protected journey. Identify which operating segment caused the delay. If Delta's transatlantic flight caused it, Delta may answer; if an Air France cancellation caused the chain, Air France may.

On the reverse US-origin direction, the operating airline on the inbound segment is decisive. A KLM-operated service can create EU scope that a Delta-operated service lacks.

Avoid duplicate demands. The passenger may coordinate evidence across partners but should recover one fixed payment for the same disruption.

Claim form routing

Delta's European compensation page tells passengers to contact the airline that operated when it was not Delta. Air France, KLM and Virgin Atlantic have their own passenger-rights channels.

The fixed claim should include:

  1. marketing number and operating airline;
  2. protected direction;
  3. original and final destination;
  4. delay, cancellation or denied boarding;
  5. cause and amount;
  6. original operated-by evidence.

For ticket refund, state who issued and charged the ticket. An agent can be responsible for processing cash while the operating airline remains responsible for compensation.

Rerouting across the partnership

During disruption, ask the managing carrier to search reasonable Delta, Air France, KLM and Virgin options. A joint schedule can make an earlier route available, but an online seat does not guarantee operational confirmation.

Record alternatives with date, flight, operator, cabin and final arrival. If a replacement changes Delta One to a lower cabin, preserve fare and upgrade evidence for a separate downgrade request.

Cause and evidence belong to the operator

Ask the operating airline for the specific disruption reason in its own records. A marketing carrier's message may repeat a generic status without aircraft rotation, crew, maintenance or air traffic detail.

If Delta sells an Air France operation and says "contact Delta," reply with the operator evidence and ask which role Delta is addressing. If Air France redirects a genuine Air France operation, quote the passenger-facing confirmation and EU operating-carrier rule.

A wet lease is not identical to ordinary codeshare. Where another airline supplies aircraft and crew under a lease but the hiring airline retains operational responsibility under EU rules, request a written operator explanation rather than relying on livery.

Loyalty and cabin issues are separate

SkyMiles earning, Flying Blue credit, Virgin Points and elite benefits do not move statutory liability. Missing miles should be handled separately from compensation.

An award ticket remains capable of EU/UK protection when it is publicly available through a frequent-flyer programme. If a partner-operated replacement fails to provide a paid upgrade, direct the fare or mileage remedy according to the product terms and ticket issuer while preserving any statutory downgrade claim.

Do not let a loyalty credit be described as settlement of fixed compensation unless the passenger knowingly accepted that arrangement.

Codeshare examples

DL-coded New York-Paris operated by Air France, arrival 5 hours late: EU261 inbound coverage can exist. Claim the fixed amount from Air France.

AF-coded Paris-Atlanta operated by Delta, cancelled on the day: Delta is the operator and the EU departure is covered. Ticket servicing can still involve Air France.

DL-coded New York-London operated by Virgin Atlantic, delayed 4 hours: UK261 can apply inbound against Virgin.

KL-coded Atlanta-Amsterdam operated by Delta, delayed 6 hours: direct Delta operation starts in the US, so EU261 fixed compensation normally remains unavailable.

Evidence file

Save confirmation, e-ticket, boarding pass, flight-status notice and receipt. Highlight the operated-by line for the original disrupted flight. Add the replacement operator separately so reviewers do not confuse them.

For a connection, create a segment table with marketing code, operator, schedule, disruption and final effect. This makes the liable operation visible without relying on alliance branding.

Does a DL number mean Delta operated the flight?

No. Air France, KLM, Virgin Atlantic or another partner can operate a Delta-marketed service.

Who pays for a DL-coded flight operated by KLM?

KLM normally answers the statutory operating-carrier claim, while Delta or an agent may still handle ticket servicing.

Can Virgin operation cover New York to London?

Yes. Virgin Atlantic is a UK carrier, so a qualifying inbound operation can fall under UK261.

Can I claim the same EUR 600 from Delta and Air France?

No. Identify the operating carrier responsible for the protected disruption and avoid duplicate fixed recovery.

Does aircraft paint prove the operating airline?

Not reliably, especially with leases. Use the booking, boarding documents and written operational responsibility.
