Delta employee strikes under European law
The Court of Justice ruled in Airhelp v SAS that a strike called by a trade union of an operating carrier's employees, concerning working conditions and pay, was not an extraordinary circumstance. Labour relations are part of the normal management of an airline, and the event was within its sphere of control for the regulation's purposes.
That reasoning can apply when Delta's own pilots, cabin crew, maintenance employees or other personnel take industrial action and a protected Delta flight is cancelled or reaches its final destination at least three hours late. Delta cannot rely solely on the fact that the action was lawful, union-led or announced shortly before travel.
Each case remains factual. The passenger should identify the employer of the striking workers and the operating carrier. A strike at a contractor, airport or public authority is not the same as a dispute between Delta and its workforce.
External strikes and reasonable measures
Air traffic control action, airport closure or a strike by independent security staff can be external to Delta. It may remove fixed compensation if Delta proves the event actually caused the particular cancellation or long delay and could not have been avoided even with all reasonable measures.
The analysis does not stop at “ATC strike.” Relevant questions include:
- Which airspace, airport or service was restricted?
- At what time did the restriction affect the scheduled flight?
- Was Delta assigned a slot or cancellation instruction?
- Could a reasonable reroute, aircraft change or later same-day departure reduce the delay?
- Did the event affect the original flight, or only create a later aircraft rotation problem?
Delta need not make intolerable sacrifices, but it must show a route-specific connection and proportionate mitigation. A press article announcing industrial action does not prove what happened to one service.
Operating carrier in codeshare travel
A Delta flight number may be operated by Air France, KLM or Virgin Atlantic. The employer involved in the dispute and the carrier operating the disrupted flight are therefore essential.
If Air France operates Paris-New York under a DL code and Air France staff strike, the statutory claim is directed to Air France. If Delta operates the flight under both DL and AF numbers and Delta employees strike, Delta is the operating carrier. The seller, loyalty programme and logo at the top of the confirmation do not replace the “operated by” line.

Cancellation notice and alternatives
For a protected cancellation, fixed compensation also depends on when Delta informed the passenger and what rerouting it offered. Notice more than fourteen days before departure generally removes the fixed cancellation award, although refund or rerouting rights remain. Shorter notice can still avoid compensation only within the regulation's narrow alternative-flight windows or through a proven extraordinary circumstance.
Do not measure notice only from a public strike announcement. Delta must show when cancellation information reached the passenger. Save the email header, text message, app notification and travel-agent communication.
Choose clearly between reimbursement and rerouting. If travel remains necessary, ask for the earliest reasonable alternative, including a partner flight. Accepting rerouting does not by itself waive a separate compensation claim.
Care during strike disruption
Meals, communication, accommodation and transport are separate from fixed compensation on protected journeys. Delta's care duty can continue during an external strike, even where the extraordinary-circumstances defence is valid.
Ask Delta for vouchers or arrangements before paying. If help is unavailable, buy reasonable necessities and keep itemised receipts. Luxury accommodation, alcohol and unrelated purchases are unlikely to be recoverable. Record the queue, chat and refusal if an agent cannot provide assistance.
For a Delta-operated flight beginning in the United States, use Delta's disruption channels and current expense policy. US law does not create the same general care package or a fixed cash award for delay, so avoid presenting EU rights as worldwide.
Evidence that separates internal and external action
Keep the complete itinerary, PNR, boarding documents, scheduled and actual times, and Delta's explanation. Capture the operating carrier on every affected segment. If an airport announcement names a third-party workforce, preserve it.
Ask Delta to specify:
- the organisation whose employees took action;
- whether those employees worked for Delta, another airline, the airport or an authority;
- the operational restriction applied to the flight;
- the time and duration of that restriction;
- the alternatives examined;
- the passenger's final arrival time after rerouting.
This evidence is more useful than debating whether all strikes are extraordinary. The answer depends on control, cause and reasonable measures.
Compensation and other remedies
Covered long-haul journeys can fall within the EUR 600 or GBP 520 band. The exact amount depends on route distance, final arrival and any permitted reduction after rerouting. The Delta long-haul compensation guide provides the calculation.
A refund returns the unused ticket value when the passenger chooses not to travel. Rerouting gets the passenger to the destination. Care pays reasonable waiting needs. Fixed compensation addresses the qualifying disruption. These remedies should be requested as separate lines with separate evidence.
Under US rules, a Delta cancellation or significant change can trigger an automatic refund when the passenger rejects alternatives. There is no federal fixed delay award equivalent to EU261. Delta may also provide rebooking, eCredit or expense relief under its current commitments.
Worked examples
Amsterdam-New York cancelled by Delta pilot strike: Delta operates from the EU and gives two days' notice. The internal labour dispute may support EU261 compensation, in addition to the passenger's refund or rerouting choice.
London-Atlanta delayed by air traffic controllers: UK261 applies by departure, but a documented ATC restriction may be extraordinary. Delta must still provide applicable care and show reasonable measures.
New York-Paris cancelled during a Delta staff dispute: Delta operates from the United States. The passenger should use US refund and Delta contractual rights; EU261 does not attach merely because employees caused the cancellation.
Paris-Atlanta under a DL code, operated by Air France: Air France is the carrier for the statutory claim. Determine whose employees struck and direct the request accordingly.
