Delta EU261, UK261 or US DOT: which rules apply?

Use EU261 for a Delta-operated journey departing the EU/EEA/Switzerland, UK261 for a Delta-operated journey departing the United Kingdom, and US DOT rules for refund and US consumer protections on travel to, from or within the United States. A direct Delta-operated US-to-Europe flight normally has no fixed EU261 or UK261 payment, and DOT does not replace that gap with a universal cash award for ordinary delay.

Start with operation and direction. The ticketing carrier is relevant to refund processing, while fixed European compensation normally follows the operating airline.

EU261 on Delta travel

EU261 protects departures from EU airports on any airline. The connected framework also covers relevant EEA and Swiss departures. Delta can therefore owe EUR 250, EUR 400 or EUR 600 for eligible delay, cancellation or involuntary denied boarding.

EU261 additionally provides reimbursement or rerouting after cancellation, a reimbursement choice after a five-hour departure delay, care during qualifying waits and percentage refunds for downgrade.

Inbound travel from outside the EU normally requires an EU operator. Because Delta is American, its direct US-EU operation usually falls outside. Air France or KLM operation under a DL code can change that result.

UK261 on Delta travel

Any airline can be covered when the journey departs a UK airport. A Delta-operated Heathrow-US flight can therefore produce fixed amounts of GBP 220, GBP 350 or GBP 520 and the related transport and care rights.

For an inbound flight, UK261 generally looks for a UK or EU operator. Delta operation from the US normally does not qualify; Virgin Atlantic operation can.

Do not state a euro amount for the UK claim or demand both currencies. Use the statutory sterling band and record the final arrival time.

What US DOT rules provide

US federal protections are strongest for refunds, oversales, tarmac delay, disability, baggage fees and truthful consumer information. When an airline cancels or significantly changes a flight and the passenger rejects the alternative, an automatic cash refund is generally required.

Current significant-change standards include time shifts meeting federal thresholds, airport changes in defined circumstances, extra connections, cabin downgrade and certain accessibility effects. For international travel, the time threshold is six hours. Delta's general disruption policy reflects that standard for many newer tickets.

DOT does not create a fixed payment for every ordinary completed delay. A passenger arriving seven hours late in Paris after a Delta-operated Atlanta departure normally cannot convert the DOT refund rule into EUR 600 after using the flight.

Where the systems overlap

A Delta cancellation from Amsterdam to New York engages EU261 because of departure and DOT refund rules because the flight serves the United States. If the passenger rejects rerouting, both systems support cash reimbursement. The passenger receives one refund, not two.

Fixed EU261 compensation can still sit alongside that refund because it addresses a different harm. Care expenses can also be separate. Label each remedy and subtract amounts already paid for the same item.

On a Heathrow departure, UK261 care can be broader than Delta's controllable-disruption commitment. US customer-service limitations do not reduce mandatory UK rights.

Connecting journeys and the first protected departure

One reservation from Paris through Atlanta to a final US city can remain within EU261 final-destination analysis. A later domestic Delta sector does not automatically become legally isolated. Preserve the complete ticket and show how the misconnection caused final lateness.

A return flight after a stay is different. New York-Paris days later is a separate Delta-operated inbound journey and normally outside EU261 fixed scope.

For self-transfers, each booking usually stands alone. DOT may address a cancelled US segment, but EU261 does not normally make Delta responsible for a separately ticketed onward flight.

Compensation, refund and expense vocabulary

Use precise labels:

  • fixed compensation: statutory EUR or GBP band for eligible disruption;
  • refund: return of ticket or ancillary money when travel is not accepted or supplied;
  • rerouting: substitute carriage to the destination;
  • care: meals, communication, hotel and necessary transport during a protected wait;
  • reimbursement: repayment of reasonable proven costs;
  • damages: proven loss under a contract or the Montreal Convention.

Calling everything compensation makes it difficult to see which rule applies and can lead Delta to answer only one part.

Operator and ticket issuer roles

Air France, KLM and Virgin Atlantic can operate services sold by Delta. The operator answers EU261 or UK261 fixed claims. Delta or an agent may remain responsible for ticket servicing, eCredit or refund processing depending on who took payment.

Escalation route follows the issue

For an EU261 complaint, start with Delta or the relevant operator and then consider the national enforcement or dispute-resolution route connected to the disrupted airport. For UK261, use the airline's current ADR or CAA pathway after the required first complaint. For US consumer violations, DOT accepts aviation consumer complaints.

Three overlap examples

Paris-Atlanta cancelled, passenger declines travel: cash refund is due under the applicable frameworks. If notice was short and Delta's internal cause drove cancellation, EUR 600 can be separate.

London-New York delayed five hours and flown: UK261 can provide GBP 520 plus care. DOT refund is normally not due because transportation was accepted and used.

Atlanta-Amsterdam cancelled, KLM-operated codeshare: KLM's EU status can bring EU261 inbound protection. The ticket issuer may still process refund, but send the fixed claim to KLM.

Atlanta-Amsterdam delayed six hours and completed on Delta: no ordinary fixed EU261 amount; no automatic DOT refund after accepted travel. Proven baggage or Montreal delay loss remains a separate possibility.

Evidence for regime selection

Keep the e-ticket, ticket number, payment receipt, operating-carrier line and complete coupon sequence. Add the event notice, choice accepted or rejected, final arrival and expense receipts. For a codeshare, capture the original operation before schedule changes.

In the demand, state one sentence for jurisdiction: "This Delta-operated journey departed Paris and falls within EU261." Then list each remedy separately. A clear route statement is more persuasive than citing several regulations without connecting them to facts.
