What reportedly happened on DL749

On 29 August 2026, Delta flight DL749 was scheduled to fly from Los Angeles to Tampa using an Airbus A321neo. Thunderstorms around Tampa led the crew to divert to Southwest Florida International Airport in Fort Myers. The aircraft landed safely in the evening.

Some passengers reported that crew or gate staff told them to collect checked baggage at carousel 7. They left the secure area, but the security checkpoint serving the concourse was reportedly closed. The aircraft later departed Fort Myers for Tampa with those passengers' checked bags still on board.

The central disputed fact is not the weather diversion. It is whether Delta directed passengers outside security and then failed to help them reboard before continuing to Tampa. Public reports currently rely on passenger accounts, and the precise number affected is unclear.

Why EU261 and UK261 do not apply to this flight

DL749 operated wholly within the United States. It did not depart from the EU, EEA, Switzerland or the United Kingdom. The fixed compensation systems that can pay EUR 250-600 or GBP 220-520 therefore do not cover this domestic segment.

The fact that Delta also flies to Europe does not extend European rules to every Delta flight. Nor does a DL flight number prove that a European partner operated the aircraft. This was reported as Delta-operated US domestic transport.

US rules do not provide automatic delay compensation

The US Department of Transportation does not require airlines to pay cash compensation merely because a domestic flight is delayed or diverted. The strongest federal refund rights generally arise when the airline cancels or makes a significant change and the passenger chooses not to accept the alternative transportation.

Here, Delta continued the aircraft to Tampa. A traveller left in Fort Myers needs to explain why they could not use that continuation. If Delta personnel caused the separation by sending people to baggage claim, the claim is materially different from a passenger choosing to leave the gate without authorisation.

Weather also matters. Airline customer-service commitments for controllable delays often exclude disruption caused by severe weather. That makes proof of the later instruction especially important: the request should identify costs caused by Delta's handling after the diversion, not claim that Delta created the thunderstorm.

What expenses may be worth claiming

An affected passenger should first ask Delta to transport them from Fort Myers to Tampa or their ticketed destination. If that did not happen in time, reasonable self-arranged costs may include:

  • ground transport from Fort Myers to Tampa;
  • a necessary hotel when same-night travel was impracticable;
  • reasonable meals during the added wait;
  • transport between the airport and hotel;
  • replacement travel where Delta offered no usable completion.

These are not guaranteed statutory payments. Delta may examine its Contract of Carriage, the weather exclusion, what staff actually said and whether the passenger mitigated the loss. An itemised USD 180 rideshare supported by a receipt is easier to assess than a general request for “compensation for inconvenience.”

The instruction to baggage claim is the key factual issue

Passengers should reconstruct who gave the instruction, where and when. Useful evidence includes a Delta app notification, SMS, announcement recorded lawfully, a contemporaneous message to family, names of travelling companions and photographs showing the closed checkpoint.

If the instruction was verbal, several consistent witness statements can help. Write the account while details are fresh:

  1. when the aircraft arrived at the gate;
  2. the exact words used about baggage claim;
  3. whether passengers were told the flight had terminated;
  4. when they learned the aircraft would continue;
  5. what help Delta offered after re-entry became impossible.

Delta's operational and boarding records can show whether the gate knew passengers were outside security and whether final boarding calls were made. Ask the airline to preserve and review those records.

What if the trip began in Hong Kong or another country?

One reported traveller may have been travelling from Hong Kong through Los Angeles to Tampa. That does not automatically create EU261 protection. If all sectors were on one international contract of carriage, the Montreal Convention may govern proven damage caused by delay at the destination.

Article 19 of the Convention can make a carrier liable for damage occasioned by delay unless it proves that it took all reasonably required measures or that such measures were impossible. The passenger must show actual loss and causation. There is no automatic amount for inconvenience.

The current Montreal limit for passenger delay is 6,303 Special Drawing Rights per passenger, effective from 28 December 2024. It is a maximum, not a payout. The scope of the international contract, stopover, ticketing and place of destination must be checked. A domestic LAX-TPA ticket purchased separately is a different case.

Baggage was not necessarily “lost”

Reports say the checked bags continued to Tampa on the aircraft. That creates a delivery and access problem, but not necessarily permanent baggage loss. A passenger should ask Delta where the bag was held, how it could be collected and whether delivery would be arranged.

If the bag was unavailable long enough to require essential purchases, preserve the baggage report, tag and receipts. Baggage remedies follow separate rules from the passenger's ground-transport claim. Do not submit one undifferentiated amount.

How to complain to Delta

Submit the request through Delta's written complaint channel and keep a copy. Use a neutral chronology rather than an allegation that the flight “secretly abandoned” passengers. Identify the employee role or announcement, the closed checkpoint and each attempt to contact Delta.

Request the concrete remedy:

  • reimbursement of specified reasonable expenses;
  • delivery or return of checked baggage costs;
  • explanation of the instruction and boarding process;
  • confirmation whether the itinerary was treated as completed;
  • correction of any “voluntary abandonment” or no-show notation.

Attach the e-ticket, boarding pass, receipts, screenshots and proof of the final arrival in Tampa. If the written response ignores the alleged instruction, ask Delta to review station and gate records. A passenger can also file a complaint with the US DOT, although DOT does not adjudicate an individual damages award like a court.

When a Delta flight can produce an EU or UK lead

This event is not such a lead, but direction matters on other Delta journeys. A Delta-operated departure from Paris, Amsterdam or another EU/EEA airport can fall under EU261. A Delta-operated departure from London can fall under UK261. A direct Delta-operated US departure to Europe normally does not.

If an itinerary uses Air France, KLM or Virgin Atlantic, check “operated by” for every disrupted sector. The marketing code alone does not determine the responsible carrier or applicable regime.

Does Delta owe EUR 600 for leaving passengers in Fort Myers?

No. DL749 was a domestic US flight and EU261 did not apply. A passenger should claim documented US contractual or Montreal losses where the facts support them.

Does US law require cash compensation for a weather diversion?

No automatic cash compensation is required for an ordinary domestic weather delay or diversion. Refund and expense rights depend on what happened next and the airline's obligations.
