Delta rejected your compensation claim: how to respond
A Delta rejection is not conclusive when it uses a generic reason, overlooks a covered European departure, follows the DL marketing code instead of the operator, or fails to explain extraordinary circumstances and reasonable measures. Read the refusal as a set of factual propositions, answer each with evidence and preserve the existing case number. A weak claim should also be corrected honestly; a direct Delta-operated US-to-Europe flight normally cannot be rescued by repeating EU261 language.

Do not answer all possible defences. Focus on the one Delta relied on and reserve unrelated remedies under separate headings.
If Delta denies territorial coverage
For a Delta-operated journey departing the EU/EEA/Switzerland or the UK, quote the original origin and attach the complete ticket. Delta's American nationality does not remove outbound protection.
When the disruption occurred on a later US connection, explain that the continuous reservation began in Europe and identify the final ticketed destination. The Court of Justice has recognised EU261 responsibility on connecting journeys involving a non-EU carrier.
If the flight instead began in the United States and Delta operated it, a no-EU261 decision is usually correct. Switch to cash refund, contractual, DOT or Montreal rights where supported rather than escalating an ineligible EUR 600 demand.

If Delta points to a partner
Compare the original confirmation, boarding pass and any operational notice. A DL number alone is not proof that Delta operated. Air France, KLM, Virgin Atlantic, Endeavor, Republic or SkyWest may appear beside "operated by."
Where the partner truly operated, redirect the statutory fixed claim and explain the evidence. If Delta did operate despite partner branding, send the original operated-by record and ask Delta to reconsider.
Ticket refund can follow a different route through Delta or an issuing agent. A partner refusal on fixed compensation does not decide who holds the passenger's money.
If Delta says the delay was below three hours
Check two common errors: wrong destination and wrong arrival event. A one-ticket connection uses the protected final destination, not the first US airport. Arrival generally occurs when at least one aircraft door opens and disembarkation is permitted, not at runway touchdown.
Build a timeline with scheduled final arrival, replacement itinerary and door-opening evidence. Convert times consistently across zones. If the margin is close, request Delta's operational arrival record.
Do not round 2 hours 58 minutes upward. A factually short delay may still support care costs or another remedy but not fixed delay compensation.
If Delta invokes extraordinary circumstances
Ask Delta to identify:
- the precise external event;
- when and where it operated;
- how it caused this flight's delay or cancellation;
- what reasonable measures were attempted;
- which part of the total delay remained unavoidable.
Severe weather, binding air traffic restrictions, security problems or airport closure can qualify. Routine maintenance faults and many internal labour issues generally do not. A valid extraordinary event can also cease before the remaining delay, making causal allocation important.
Care and rerouting do not disappear when the defence succeeds. Submit those outstanding costs separately.

If cancellation notice is disputed
EU261 and UK261 look at when the passenger was informed. Search email headers, text timestamps, app notices and agent messages. Delta's internal cancellation date is not enough.
Notice at least fourteen days ahead normally excludes the fixed amount. For shorter notice, compare both the replacement departure and arrival with the statutory windows. A replacement that leaves much earlier can fail even if it arrives close to schedule.
Attach the original schedule and the first alternative, not only the itinerary eventually accepted.
If Delta says the claim is late
There is no single current EU261 court limitation period for all Delta departures. National law and jurisdiction determine the period. UK routes commonly involve six years in England and Wales and five years in Scotland, with procedural nuance.
Ask Delta to identify the law, forum and accrual date behind its refusal. An internal handling preference is not automatically the mandatory limitation period. Conversely, filing a customer-service case may not suspend a court clock.

If Delta relies on a voucher or prior payment
Identify what was received: meal voucher, eCredit, goodwill miles, ticket refund, fixed compensation or expense repayment. These answer different obligations. A EUR 20 meal voucher does not settle a EUR 600 statutory claim.
Read any release or settlement language accepted with a travel credit. If Delta says a payment discharged the case, ask which remedy and passenger it covered. Deduct amounts that truly duplicate the demand, but do not surrender unrelated rights without evidence.
Write a concise reconsideration
Use this order:
- case reference and requested decision;
- one sentence establishing scope and operator;
- decisive timing or notice facts;
- response to Delta's stated defence;
- amount and passenger names;
- numbered attachments;
- reasonable reply date.
Avoid emotional history unrelated to the legal issue. The goal is a record that an adjudicator can review if Delta does not change its position.
When to escalate
For an EU departure, the relevant national enforcement or complaint body is usually connected to where the incident occurred. Your Europe suggests escalation after no airline reply within two months or an unsatisfactory reply. Check whether the body issues individual outcomes or primarily enforces compliance.
For a UK dispute, Delta is currently listed under AviationADR. The CAA says the provider can normally be approached after a final response or eight weeks without resolution, subject to its time conditions.
For US consumer-rule issues, DOT accepts complaints and uses them for oversight. DOT is not a substitute court for a disputed EU261 amount. Preserve limitation while using any administrative route.

Is Delta's first rejection final?
No. A passenger can seek reconsideration and use the appropriate authority, ADR or court route, but should correct any genuine scope defect.
Is "operational reasons" enough to prove extraordinary circumstances?
No. Delta should identify the event, causal link and reasonable measures with enough detail to assess the defence.
What if Delta measured arrival at Atlanta instead of my final city?
Send the one-ticket itinerary and replacement arrival at the final destination, explaining the protected connecting journey.
Should I open a new Delta case after rejection?
Usually reply under the existing reference so the chronology stays together, unless Delta's system directs a different formal appeal route.
Can I escalate a correct rejection of a US-origin Delta flight?
