Delta compensation claim deadline: how long do you have?
There is no single current deadline for every Delta EU261 claim because court limitation follows the national law and jurisdiction applicable to the dispute. UK claims commonly involve six years in England and Wales and five years in Scotland, while baggage complaints can require action within seven or twenty-one days. The adopted future EU nine-month submission procedure is not yet the universal current rule on 15 August 2026.

An airline's case-response target is not automatically the last day for court action. An insurance notice, card chargeback or OTA term is another independent clock.
Why EU261 has no one historical period
The current Regulation establishes the substantive payment but leaves court limitation to national legal systems, subject to EU principles. The possible forum can depend on departure, arrival, the connecting itinerary, defendant and contractual performance.
Do not assume that departure country always supplies the deadline or that an online article's three-year figure applies across Europe. When a claim is old, identify the courts that could hear it and check their current rules.
Submitting Delta's form may create useful evidence but may not suspend limitation. A prolonged exchange with customer care can therefore consume time without protecting a judicial claim.
UK limitation and ADR timing
Claims in England and Wales are commonly associated with a six-year period for this kind of monetary action. Scotland commonly uses five-year prescription, with its own rules. Northern Ireland requires its own check.
Delta is currently signed up to AviationADR according to the UK CAA. The CAA's operational guidance says ADR can cover incidents within six years, or five years for a person living in Scotland. It also states that the consumer should submit within twelve months of the airline's final response, or within twelve months of the last written communication if no response arrived.
These ADR rules do not guarantee that every old claim is valid in court. Forum, accrual, prior proceedings and acceptance of settlement can matter. File well before the apparent outer edge.

The future nine-month EU procedure
The EU adopted revised air-passenger rules in July 2026, but the new provisions do not become generally applicable immediately. The reform includes a future period for passengers to submit claims and a timetable for airline response.
As of 15 August 2026, do not treat nine months as the existing universal limitation for a Delta EU departure. It is also conceptually different from the last date for filing court proceedings. Application date, Official Journal publication and transitional rules must be checked for the flight concerned.
Until then, file promptly under current procedures and protect the national limitation period.
Delta form and processing statements
Delta's European request page says it will process eligible refunds within seven business days of receipt, while bank processing can add time. That is a stated processing period, not a passenger claim limitation.
Delta's general international contract contains other one-year request language for particular tax, fee or charge refunds. Do not import that special contract term into an EU261 fixed-compensation claim or baggage complaint without checking what the requested money represents.
Keep the submitted form, case number and payment method. If an entitled refund is late, the chronology supports follow-up or DOT complaint.
Baggage deadlines are much shorter
For international carriage under the Montreal Convention:
- damage normally requires written complaint within seven days after receipt;
- delay normally requires written complaint within twenty-one days after baggage delivery;
- court action is generally extinguished if not brought within two years, calculated under the Convention.
Report the problem at Delta's Baggage Service Office and obtain a file reference, but also submit the written claim with receipts and inventory. Do not assume an airport report alone satisfies every complaint requirement.

DOT refund timing is not a delay-compensation period
US rules require prompt automatic refund after cancellation or significant change when the passenger rejects alternatives. Credit-card and other payment processing standards govern how quickly money should be returned once the right arises.
They do not create permission to wait indefinitely before disputing a missing refund. Preserve rejection of rebooking or eCredit, unused ticket status and the payment account. File a DOT complaint while evidence is available if Delta does not comply.
A completed ordinary delay from the United States does not become a fixed-payment claim merely because a refund-processing deadline passed.
Safe timing workflow
- Identify the operating airline and protected direction.
- Record flight date, final arrival and cancellation notice.
- Separate fixed payment, ticket refund, expenses and baggage.
- Submit a complete Delta claim promptly and save acknowledgement.
- Identify possible national forums and their limitation rules.
- Diary Delta, NEB, ADR and court dates independently.
- Obtain local advice when any expiry is close.
Do not wait for perfect internal records before filing a clear initial claim. State that further operational evidence is requested and preserve the date.
Timing examples
Delta Paris-New York disruption eighteen months ago: EU261 scope can exist. The passenger must identify applicable national limitation rather than reject the case solely because nine months passed.
Delta Heathrow-Atlanta delay four years ago: UK261 may remain actionable in England and Wales, but the traveller should verify forum and ADR or court conditions now.
Delta Atlanta-Amsterdam delay three years ago: age is secondary because direct Delta operation from the US normally lacked EU261 fixed coverage from the outset.
International suitcase damage reported after ten days: the ordinary seven-day written period may already be missed even if any flight-disruption claim has years remaining.
Evidence for a deadline dispute
Preserve the e-ticket, travel date, first submission, automated receipt, case number, every Delta response and each escalation. If Delta says the claim is late, ask it to identify the governing law, forum, accrual date and rule relied on.
Do not accept an unexplained internal policy as mandatory law. Equally, do not promise that correspondence extended time. A deadline answer should be tied to the specific remedy and jurisdiction.
