For most international journeys, the Montreal Convention currently caps total baggage liability at 1,519 SDR per passenger. The ceiling is not an automatic award and is shared across loss, delay and damage from the same carriage.
Inspect the bag before leaving
Check wheels, handles, shell, frame, zips, locks and contents in the reclaim area. Photograph the bag from several angles, the bag tag and the belt location. If possible, include a timestamp and scale reference.
Take the bag to Delta's Baggage Service Office and request a damage report. Keep the file reference needed for the online claim. If a Delta representative says the issue is normal wear, ask for that decision in writing and photograph the disputed area.
Do not discard the bag or repair it before Delta has a reasonable opportunity to inspect, unless safety or urgent use makes action necessary. Preserve the damaged parts and invoice.

International treaty law also requires a written complaint for checked-bag damage within seven days after receipt. Immediate reporting avoids disputes about when and where damage occurred.
What damage is usually covered
Airlines are responsible for physical damage that occurs while checked baggage is in their control, subject to legal limits and exclusions. A cracked shell, torn fabric, broken wheel, damaged frame or crushed contents can qualify.
Delta excludes ordinary wear and tear. Superficial scratches, scuffs, dirt and damage caused by overpacking or an inherent defect may be disputed. The distinction is factual: a wheel torn from its housing is different from cosmetic marking after normal handling.
Take clear close-ups and a full-bag photograph. Show that the bag was suitable for travel and identify any earlier marks honestly.
Repair, replacement or depreciated value
Delta may arrange repair, replace the bag with a comparable item or offer monetary settlement. A used suitcase is not automatically valued at the price of a brand-new premium model. Age, condition, purchase price and repair feasibility matter.
Keep the original receipt if available. Otherwise provide the brand, model, approximate purchase date, photos and comparable current product. Obtain a written repair estimate or a statement that repair is uneconomic.
For damaged contents, list each item and explain how impact or mishandling caused the loss. Preserve the item until Delta resolves inspection.
Montreal Convention limit
Most international Delta baggage transport is governed by the Montreal Convention. The current liability ceiling is 1,519 Special Drawing Rights per passenger for baggage destruction, loss, damage and delay combined. The SDR conversion changes with currency rates.
This is a maximum, not a flat payment. The passenger proves actual value and causation. If two checked bags under one passenger are damaged, the ceiling does not double. If several passengers checked bags, ticket and bag-tag records help show whose baggage was accepted.
A special declaration of interest made at check-in with any required additional payment can create a higher ceiling. Keep the declaration and receipt.
Domestic US baggage follows a different DOT framework, currently permitting a liability limit no lower than USD 4,700 per passenger.
Mobility devices need urgent handling
A wheelchair or scooter is an assistive device, not ordinary luggage. Delta tells passengers to meet an agent or ask for a Complaint Resolution Official before leaving the airport when a device is delayed or damaged. It states that a passenger can file a claim, receive a loaner and choose a preferred repair or replacement vendor.
Record the device's make, model, serial number, condition, battery type, dimensions and handling instructions. Photograph it before check-in and immediately after return. Ask staff to note whether it can be used safely.

Missing or stolen contents
Pilferage is not always visible until the bag is opened. Delta currently asks passengers to report missing checked-bag contents within 24 hours after domestic arrival and within seven days after international arrival.
Make an inventory, preserve packaging and photograph signs of interference. Report suspected theft to airport police where appropriate, but also create the airline baggage file. A police report does not replace Delta's claim.
Valuables such as cash, jewellery, electronics, documents and fragile items can be restricted under conditions of carriage. Check exclusions before placing them in checked baggage and provide purchase evidence.
Codeshare and connection damage
Report at the final airport to the baggage service carrier that handles the arriving journey. Keep tags for every segment and note which carrier operated each flight. The Montreal Convention has rules for successive carriage, while the airport report creates the practical trace.
If Delta and KLM or Air France transported the bag, do not assume the DL marketing number identifies the point of damage. Submit the report promptly and let carriers investigate handovers.
Separate tickets can complicate responsibility. Record where the passenger collected and rechecked the bag.
Claim file and calculation
Attach the e-ticket, boarding pass, bag tag, airport report, file reference, photographs and purchase proof. Add repair estimate, replacement quote, damaged-content list and correspondence.

Ask Delta to explain depreciation and exclusions line by line. Do not claim full retail value for a used item without justification.
Separate baggage and flight claims
Damaged baggage does not itself produce EUR 600 or GBP 520. EU261 and UK261 fixed compensation concern qualifying flight disruption; Montreal and domestic rules concern baggage.
If a Delta-operated Paris-New York flight arrives four hours late and the bag is cracked, file an EU261 delay claim and a separate baggage claim. A successful or rejected flight claim does not decide physical damage.
