Delta delayed or lost baggage claim: deadlines and reimbursement

Report a missing Delta checked bag at the airport immediately, keep the file reference number and submit receipts for reasonable essentials. Delta treats a bag not found within 21 days as likely lost. Baggage reimbursement is separate from EU261 delay compensation. A passenger can have both claims when the flight and bag each meet their own requirements.

First actions at the airport

Go to Delta's Baggage Service Office before leaving the arrivals area. File a delayed baggage report and verify delivery address, phone, email, bag-tag number and description. Save the file reference and a copy or screenshot of the report.

Keep:

  • boarding pass and full itinerary;
  • checked-bag receipt and fee payment;
  • bag tag and tracking screenshots;
  • file reference from Delta;
  • photographs showing the bag before travel if available;
  • an inventory of contents and supporting purchase records;
  • every necessary replacement receipt;
  • delivery record when the bag arrives.

Do not report the bag only as a general customer-service complaint. The baggage file reference is needed for tracking and Delta's claim process.

The legal meaning of loss and the airline's claim workflow are related but not identical. Preserve all communications if Delta closes tracking early or asks for an inventory sooner.

Reasonable delayed-bag expenses

A passenger away from home may need clothing, toiletries, medication-related items or other essentials until the bag arrives. Buy in stages and keep spending proportionate to location, weather, trip purpose and delay length.

Delta currently says reasonable expenses are generally determined at USD 50 per day for the first five days. This is guidance, not an automatic daily payment. Submit actual itemised receipts and explain any necessary amount above the guideline.

If the bag is ultimately lost, Delta states that prior delayed-bag reimbursements are deducted from the final settlement. That avoids paying twice for the same contents.

Expensive replacements, electronics, jewellery and business equipment face closer scrutiny and possible exclusions. Essential does not mean recreating the entire suitcase immediately.

International liability under the Montreal Convention

Most international Delta baggage journeys fall under the Montreal Convention. The current baggage liability ceiling is 1,519 SDR per passenger for destruction, loss, damage or delay combined. SDR is an International Monetary Fund unit whose currency value changes.

The limit is not a guaranteed payment. The passenger proves actual loss, reasonable expenses and the value of missing contents, subject to depreciation and exclusions. It is also not multiplied by the number of checked bags.

A higher declared value made at check-in with any required supplementary payment can alter the ceiling. Preserve that declaration.

For domestic US travel, DOT currently permits airlines to limit baggage liability to no less than USD 4,700 per passenger. Check the incident date because limits can be adjusted.

Written deadlines

For international baggage delay, the Montreal Convention requires a written complaint no later than 21 days from the date the bag was placed at the passenger's disposal. For checked-bag damage, the period is seven days after receipt. Delta can impose shorter reporting steps for domestic claims, so immediate airport reporting remains safest.

A court action under the Convention generally must be brought within two years, calculated under the treaty's rule. Do not confuse that litigation period with the 21-day written delay complaint.

Send the claim through Delta's baggage channel, retain confirmation and keep a complete copy. A tracking chat alone may not state the expenses or legal complaint clearly enough.

When the bag becomes lost

After six days, Delta invites a Potential Property Loss Claim. Prepare a truthful item inventory showing description, purchase date, original price, current value and receipt where available.

Airlines can apply depreciation rather than replacing every used item at new retail price. Photos, card records, emails and model information can support value when an old receipt is unavailable.

DOT states that once a bag is determined lost, an airline is responsible for the bag and contents within the liability rules and must refund the checked-bag fee paid for the lost bag. Ask Delta to itemise any settlement and fee return.

Do not exaggerate or add uncertain items. Inconsistencies can delay the entire file.

Codeshare and connecting itineraries

On a journey involving Delta and a partner, report the missing bag to the carrier handling baggage service at the final airport. The Montreal Convention can allow claims involving successive carriers, but practical handling starts with the baggage office that creates the file.

Keep every bag tag because it shows routing and responsible handovers. A DL flight number does not prove Delta physically operated each sector.

If the bag was rechecked during US entry procedures, note where it was last handed to an airline. Do not assume automatic through-checking on separate tickets.

Flight delay compensation is separate

EU261 and UK261 address qualifying flight cancellation, denied boarding and arrival delay. They do not pay the value of a missing suitcase. Montreal and domestic baggage rules handle the bag.

A Delta-operated Amsterdam-New York flight arriving four hours late with a bag delayed three days can create two files: an EU261 delay claim and a Montreal expense claim. Submit them separately with shared itinerary evidence.

A direct Delta-operated Atlanta-Paris journey normally has no EU261 fixed delay compensation, but international baggage protection can still apply. The direction rule for a flight award does not remove treaty baggage rights.

Claim calculation

List reasonable delay purchases first. If the bag remains lost, add the depreciated value of the bag and contents. Subtract items already returned, insurer payment where required and duplicate reimbursement.

Show original currency and total. Attach receipts in the same numbered order as the schedule. Explain necessary purchases that lack a receipt and expect closer review.

If Delta offers miles or a voucher, ask whether it is goodwill or full settlement. Do not release a documented baggage claim without understanding the amount and terms.

Worked examples

Paris-New York bag arrives after three days: report at Delta's office, buy proportionate essentials and submit receipts. Montreal applies independently of any EU261 flight claim.

Amsterdam-Atlanta suitcase missing after six days: file the property-loss inventory while Delta continues searching. At 21 days, Delta considers it likely lost.

Atlanta-Chicago domestic bag lost: the US domestic liability framework applies, currently allowing a limit no lower than USD 4,700 per passenger, subject to proven loss.

Family checks three bags under two passengers: treaty liability is assessed per passenger, not automatically as three separate maximum awards.
