Avianca from Latin America to Europe: coverage and Colombian rights
An Avianca-operated journey beginning in Colombia or another Latin American country normally falls outside EU261 and UK261, even when its destination is Madrid, Paris or London. Avianca is not an EU or UK carrier. That does not mean the passenger has no rights: Colombian aviation rules, the contract of carriage, refund law and the Montreal Convention may still provide care, reimbursement or compensation. The correct claim must start with the applicable regime rather than an automatic demand for EUR 600.

Why the return direction changes EU261 and UK261
European rules cover departures from their territory on any airline. For a flight arriving from a third country, they generally require a qualifying European operating carrier. Avianca does not have that status. UK261 applies the same basic distinction for inbound flights operated by non-UK, non-EU airlines.

A round-trip ticket does not turn both directions into one territorial event. Assess the outbound and inbound separately. Booking through an EU travel agency, paying in euros or holding a European passport does not convert Avianca into a Community carrier.
Three exceptions worth checking
First, inspect “operated by”. If a qualifying EU or UK airline actually performed the inbound sector under an Avianca marketing code, carrier status can change the answer. The AV number alone is not enough.
Second, identify the first departure on the affected continuous booking. A journey that began in Madrid and continued through Bogota to another destination can remain an EU-origin journey even though the disruption happened after the non-EU connection. A new, separately purchased return ticket beginning in Bogota is different.
Third, compare the itinerary after involuntary rerouting with the original protected contract. An airline should not be able to erase an already applicable regime merely by replacing a cancelled route with a new flight number. Preserve both versions and explain the chronology.

Colombian passenger rights are not EU261 in another currency
Colombia's Aeronautica Civil identifies passenger rights in section 3.10 of the Colombian Aeronautical Regulations. Its public guidance describes assistance and compensation for carrier-attributable events. The structure is different from fixed EU distance bands.
For an attributable delay longer than one hour but under three, the guidance describes refreshments and a communication. Above three hours and below five, it adds an appropriate meal. Above five hours, further compensation may arise; where the wait passes 10 p.m. local time, accommodation and transfers can be required for a passenger away from home, subject to the stated conditions.
Aerocivil also describes a minimum additional payment equal to 30% of the relevant journey value for carrier-attributable delay over five hours, cancellation and involuntary denied boarding, unless the passenger expressly accepts another form. The fare allocation is based on the affected sector's share of the itinerary distance. This is not automatically EUR 600 and it depends on attribution and the Colombian rules applicable to the trip.
Cancellation, refund and interruption
When transportation is interrupted, ask Avianca to state the available continuation and refund options in writing. If the passenger does not continue, calculate the unused portion rather than demanding reimbursement for sectors already flown without a legal basis. If the disruption is attributable to the carrier, examine the separate Colombian compensation described above.
Avianca's refund portal handles ticket reimbursement, while the complaint form handles a documented dispute. Do not let a refund request silently replace a compensation complaint. Conversely, do not request EU fixed compensation on an inbound itinerary after the coverage check has failed.
For tickets involving a travel agent, the agent may control the payment flow, but that does not determine which carrier caused the operational event. Save all communications showing whether Avianca or the seller directed the passenger to the other.
Baggage and provable loss remain separate
The Montreal Convention can apply to international baggage delay, loss and damage even when EU261 does not. It uses proof of loss and a liability ceiling rather than the EUR 250-600 flight-disruption bands. Written deadlines are short: damaged checked baggage should generally be complained about within seven days and delayed baggage within 21 days after delivery.
Likewise, a documented consequential loss from delay can require a Montreal analysis. It is not the same as an automatic three-hour fixed payment. Keep receipts, causation evidence and mitigation records.

How to present a non-EU261 claim accurately
Write the origin, final destination, booking structure, operating carrier, event, stated cause and actual timing. Then name the regime being used. For a Bogota-Madrid delay, that may be Colombian RAC passenger rights and the contract of carriage, not EU261. For baggage, name the Montreal Convention and the relevant written deadline.
Attach the e-ticket, fare receipt, boarding passes, disruption messages, replacement itinerary and itemised expenses. If relying on the Colombian 30% provision, show the price and route allocation rather than inserting a European distance-band amount.
Submit Avianca's form and preserve the acknowledgement. If the complaint concerns Colombian passenger rules and remains unresolved, consult current Aerocivil and transport-supervision channels. A European enforcement body is unlikely to cure a territorial exclusion simply because the destination was in Europe.
A useful lead-quality check
The strongest fixed-compensation cases in the Avianca network are protected departures from Europe or the UK, not ordinary inbound returns. Before investing time in escalation, answer four questions: where did the continuous journey start, who operated the disrupted sector, was it one booking, and which event caused the loss?
If the first answer is Madrid, Barcelona, Paris or London, continue with the EU/UK Avianca overview. If it is Bogota or another Latin American city, build the Colombian, contractual or Montreal claim honestly.

Does Bogota-Madrid on Avianca qualify for EU261?
