Avianca Europe-Latin America connection compensation

A missed Avianca connection in Bogota can produce EU261 or UK261 compensation when the passenger's continuous booking started in Europe or the United Kingdom, the itinerary was directly connecting, final arrival met the delay threshold and the airline cannot prove an extraordinary cause. The connection airport being outside Europe does not by itself break protection. Two independently purchased tickets, however, are not automatically treated as one protected journey.

One reservation changes the legal endpoint

EU case law treats the final destination of directly connecting flights as the last destination on the passenger's ticket. It has also confirmed that a journey departing the EU can remain within Regulation 261 when the transfer and later sector occur outside EU territory.

The same booking reference is strong evidence, but inspect the e-ticket receipt as well. Some agency itineraries display one interface while issuing separate ticket contracts. Look for ticket numbers, fare construction and whether baggage was checked to the final destination.

Final delay can arise from a modest first delay

A passenger may leave Madrid only 70 minutes late, miss the planned Bogota connection and arrive in Guayaquil eight hours late. The claim is not limited to 70 minutes if the sectors formed one directly connecting booking. Compare scheduled and actual arrival at Guayaquil in one time zone.

The relevant arrival point is when an aircraft door opens and disembarkation becomes possible. Preserve the replacement boarding pass and arrival evidence, because the app may later show only the changed journey. If Avianca reroutes the passenger through another city, that does not replace the original final destination for measuring the result.

A connection missed through the passenger's own late arrival at the gate, missing documents or a voluntary stopover is different. Record boarding announcements and gate times before assigning cause.

Direction still comes before the connection

A continuous Europe-to-Latin America ticket can remain protected after Bogota. The reverse Avianca-operated journey normally cannot use EU261 or UK261 simply because it connects into Europe at the end.

For example, Quito-Bogota-Madrid on one Avianca ticket starts outside the EU. Avianca is not a Community carrier, so the normal EU261 inbound condition is absent. Colombian rules, the contract and Montreal delay damages may still be relevant. The inbound coverage guide explains those alternatives.

A return booking must therefore be divided into its outbound and inbound directions. Do not describe the entire round trip as “from Madrid” when the disrupted half actually started in Colombia.

Identify the operator of each affected sector

Avianca participates in Star Alliance and maintains other codeshare partnerships. An AV code can appear on a flight performed by another airline, and a partner code can appear on an Avianca aircraft. Fixed passenger-rights duties normally attach to the actual operating carrier.

Suppose Avianca operates Paris-Bogota but a separate partner operates Bogota-Lima on the same booking. Record which event caused the missed connection and which carrier performed the disrupted sector. A claim can require more careful allocation than a journey operated by Avianca end to end.

Use the original confirmation, boarding pass and “operated by” line. Avianca's own Help Center tells passengers to open the flight details and check the operator for each segment. The codeshare guide covers mixed itineraries.

Rerouting and care in Bogota

When a protected connection is lost because of a covered disruption, Avianca should reroute the passenger to the final destination at the earliest opportunity under comparable conditions. Ask for a written replacement itinerary and do not surrender the original ticket record.

During a necessary wait, reasonable meals, communication, overnight accommodation and airport-hotel transport may be due. These care duties do not disappear because the initial cause was extraordinary. If Avianca provides no usable assistance, buy proportionate essentials and retain itemised receipts.

Do not independently buy a premium replacement without first requesting rerouting unless urgency and the airline's failure make self-help reasonable. Preserve screenshots of unavailable support, queue times and alternatives considered. Expense recovery depends on necessity and proportionality, not only on possessing a receipt.

Separate tickets and self-transfer loss

Two separate purchases create a commercial risk that fixed compensation does not automatically absorb. If the protected Madrid-Bogota flight arrives 90 minutes late but a separate Bogota-Cartagena ticket is missed, EU261 will normally measure the first contract at Bogota. The passenger may explore flexible fare terms, travel insurance and provable loss, but should not state that Cartagena was the statutory final destination without contractual evidence.

An itinerary sold as a package or protected connection by an agent may create additional contractual duties. Save the seller's promise, transfer guarantee and invoice. Those rights sit alongside, rather than rewrite, the operating carrier test.

Calculate and document the claim

For a protected EU-origin journey over 3,500 km with final arrival at least three hours late, the starting fixed band is EUR 600 per eligible passenger. A lawful reduction to EUR 300 can apply when the long-haul rerouting or delay remains within four hours. UK long-haul bands distinguish GBP 260 for three to four hours from GBP 520 at four hours or more.

List each passenger, final delay and amount. Add care expenses separately. State that all sectors were issued on one ticket and attach proof. The Avianca amount guide handles group and reduction examples.

Submit the complete chronology through Avianca's complaint form. If the airline replies only that the first flight was less than three hours late, point to the one-booking itinerary and final arrival. If it disputes the booking structure, request an itemised explanation identifying the ticket contracts it relies on.

FAQ

Can a missed Avianca connection in Bogota qualify under EU261?

Yes, when a directly connecting booking started in the EU and the final delay and cause requirements are satisfied.

Is the delay measured when I reach Bogota?

Not if Bogota was only a connection on one ticket. Use arrival at the last ticketed destination.

What if the onward flight had a separate booking code?

A separate code is a warning, but inspect the actual e-ticket contract. Independently purchased tickets are normally not combined automatically.

Does extraordinary weather remove rerouting and hotel rights?

No. It may defeat fixed compensation, but assistance and rerouting duties continue on a protected journey.

Which airline receives a mixed-carrier claim?

Identify who operated the disrupted sector and caused the lost connection. A marketing code or alliance membership is not conclusive.
