Avianca flight compensation: when EU261 or UK261 applies
Avianca can owe fixed flight compensation when an Avianca-operated journey starts at an airport covered by EU261 or UK261 and the disruption meets the timing and cause tests. A qualifying European departure may be worth EUR 250, EUR 400 or EUR 600 per passenger; a qualifying UK departure may be worth GBP 220, GBP 350 or GBP 520. An Avianca-operated flight that starts in Colombia or elsewhere in Latin America normally does not become covered merely because it lands in Europe.

The direction test in one table
Avianca is a Colombian airline, not an EU or UK carrier. EU261 covers departures from the EU and EEA regardless of airline nationality. Comparable rules cover relevant Swiss departures. UK261 covers departures from the United Kingdom regardless of airline nationality. Inbound protection is narrower and usually requires an EU or UK operating carrier, a condition Avianca does not meet.

Nationality, residence, payment currency and the website used for booking do not reverse those outcomes. A return booking is assessed by direction: its Europe-to-Latin America half may qualify while its Avianca-operated return does not.

Which Avianca disruptions can qualify?
A delay claim usually requires arrival at the final ticketed destination at least three hours late. Arrival means the point at which at least one aircraft door opens and passengers can leave, not touchdown or the moment the aircraft reaches the stand. If a missed connection occurs on one continuous booking, measure the delay at the last destination shown on that booking.
A cancellation can trigger fixed compensation when notice arrived fewer than 14 days before departure, unless the replacement timing fits a statutory exception or Avianca proves extraordinary circumstances. Involuntary denied boarding can qualify without a three-hour test when the passenger had a confirmed reservation, presented on time and held the required documents.

A poor seat assignment, missing prepaid meal or voluntary booking change is not automatically the same event as a statutory downgrade or cancellation.
Compensation amount and the long-haul reduction
EU261 uses distance bands of EUR 250, EUR 400 and EUR 600. UK261 uses GBP 220, GBP 350 and GBP 520. Avianca's direct and connecting journeys between protected European origins and Latin America will often fall in the longest band, but the actual continuous itinerary still has to be checked.
Long-haul EU compensation may be reduced from EUR 600 to EUR 300 where rerouting gets the passenger to the final destination within the statutory four-hour window. Under UK rules, an eligible long-haul arrival between three and four hours late generally produces GBP 260, while a delay of at least four hours reaches GBP 520.
The amount is calculated for each eligible passenger. Three adults and a child holding seats on one protected itinerary can have four separate fixed claims. One booking can carry protection beyond Bogota
Suppose a passenger has one ticket from Barcelona through Bogota to Quito. Avianca operates both sectors. A delay from Europe causes the onward flight to be missed, and the passenger reaches Quito six hours late. EU case law allows the final destination on that single booking to be used even though the connection and last sector are outside the EU.
Separate tickets are different. If Barcelona-Bogota and Bogota-Quito were purchased independently, the airline can argue that the first contract ended at Bogota. The cost of the second missed ticket may still deserve examination, but it is not automatically included in the first journey's fixed EU261 calculation. The airline logo does not prove who operated
A flight can carry an AV marketing code while another airline supplies the aircraft and crew. Conversely, Avianca can operate a sector sold under a partner's code. Fixed EU261 and UK261 duties normally follow the carrier that performed or intended to perform the disrupted flight.
Check the words “operated by” on every e-ticket segment and boarding pass. Avianca's contract of carriage names several companies within the brand, including Aerovias del Continente Americano, Taca International, Avianca Costa Rica, Avianca Ecuador, Aviateca and Regional Express Americas. Care, rerouting and refunds are separate rights
Fixed compensation is not the same as practical help during disruption. On a covered departure, Avianca must offer reasonable meals and communication after the applicable waiting threshold, plus hotel accommodation and airport transport where rerouting requires an overnight stay. A genuine weather event may defeat the fixed amount but does not erase care while the passenger waits.
After a covered cancellation, the passenger generally chooses reimbursement, rerouting at the earliest opportunity or travel at a later convenient date subject to seat availability. A voucher is not the compulsory form of reimbursement. After a delay of at least five hours, a passenger who abandons a journey that no longer serves its purpose may have reimbursement and return-flight rights.
Do not ask for an unused-ticket refund after completing the replacement journey. Do keep fixed compensation, reasonable care expenses and any separately justified replacement-transport cost on distinct lines in the demand.
Build the file before contacting Avianca
Save the full e-ticket, six-character booking code, ticket numbers, original itinerary, every boarding pass, replacement itinerary and all disruption messages. Take a screenshot showing the “operated by” line before an app update overwrites it. Record scheduled and actual final arrival in one time zone.
For a cancellation, preserve the first message rather than only the latest reminder. For expenses, retain itemised receipts. For a family, list each passenger and obtain written authority from other adults if the airline requests it.

FAQ
Does every delayed Avianca flight qualify for EUR 600?
No. The itinerary must first be within EU261, then meet the arrival-delay, distance and cause requirements. Many Avianca flights beginning in Latin America fail the territorial test.
Is Bogota to Madrid covered by EU261?
Normally not when Avianca operates a journey that begins in Bogota. Check whether an EU carrier actually operated the affected sector or whether the journey originally began in the EU on one continuous booking.
Can an Avianca departure from London earn GBP 520?
Yes. UK261 covers departures from a UK airport on any airline. A long-haul Avianca disruption can reach GBP 520 when the timing and cause tests are met.
Are LifeMiles award passengers protected?
Publicly available frequent-flyer award tickets are not excluded merely because miles paid the fare. Fixed compensation and the return of miles or taxes are different remedies.
Does bad weather remove meal and hotel rights?
No. Proven extraordinary weather can remove fixed compensation, but care and rerouting duties continue on a covered journey.
