Air Serbia US flight claims: EU261, Serbian law and DOT refunds
Short answer: the United States does not provide an EU-style fixed payment for every long Air Serbia delay. US DOT rules can require an automatic refund when Air Serbia cancels or significantly changes travel to or from the United States and the passenger rejects the offered alternative. EU261 may still provide EUR 600 where a one-ticket journey starts in the EU and reaches the US through Belgrade, but Air Serbia's direct Serbia-US services do not gain EU261 simply because they cross the Atlantic.

What US DOT refund protection does
DOT's current rule requires US and foreign airlines to provide prompt automatic refunds when they cancel or significantly change a scheduled flight to, from or within the United States and the passenger does not accept rebooking, credit or other alternative compensation.
Qualifying significant changes include defined major timing shifts on international travel, arrival or departure at a different airport, added connections, a cabin downgrade and certain accessibility-related aircraft or airport substitutions. Assess the current DOT definition against the actual change instead of treating every 20-minute adjustment as refundable.
The refund covers the ticket price and fees for transportation not provided. Ancillary fees for services not delivered, such as a paid seat or checked bag, can also be refundable under the federal rule.
Refund timing and payment method
DOT requires prompt refunds, generally within:

The money should return through the original payment method unless the passenger knowingly chooses another form. A voucher or travel credit should not be imposed after the traveller rejects the changed transport.
If an OTA is the merchant of record, the intermediary can be involved in moving the refund while the airline remains subject to its transport obligations. Record who charged the card and who holds the ticket funds.
DOT refund is not delay compensation
US federal protection generally does not award a fixed sum merely because an international flight arrives three, six or ten hours late. The passenger can still have:
- contractual meals, hotel or rerouting under Air Serbia's terms;
- Serbian passenger-rights remedies for a Belgrade departure;
- EU261 compensation for a protected EU-origin itinerary;
- Montreal Convention damages for proven international delay loss;
- Canadian APPR rights if Toronto forms part of the journey.
Do not label a DOT refund as USD “compensation.” It restores payment for transport or services not supplied. A EUR 600 EU261 award, where valid, addresses inconvenience through a separate statutory route.
Example: Vienna-Belgrade-Chicago
All sectors are on one Air Serbia booking. A disruption at Belgrade causes final arrival in Chicago eight hours late. The journey began in the EU, so EU261 can be assessed to Chicago. If coverage, cause and final-delay conditions are met, the route is in the long-distance EUR 600 band.
If Air Serbia instead cancels and the passenger rejects replacement travel, DOT refund protection also applies because the ticket includes transportation to the United States. The passenger can seek repayment for unused transport and separately test EU261 compensation, without recovering the same ticket price twice.
Change the itinerary to Chicago-Belgrade-Vienna. Air Serbia is not an EU carrier, so EU261 normally does not protect the inbound journey. DOT refund, Serbian procedure and Montreal damages remain possible depending on the event.
Cancellation and major schedule change
Save the itinerary before and after the change. Compare departure time, arrival time, airport, number of connections, cabin and operating carrier. Record whether Air Serbia offered a replacement and whether the passenger accepted any sector or credit.
If continued travel remains useful, ask Air Serbia for rerouting rather than selecting refund. DOT's automatic-refund route is triggered when the consumer does not accept the alternative. Once a workable substitute is accepted and used, a full refund of the same transportation is not generally available.

Care and replacement transport
DOT refund rules do not create the same general care package as EU261. Check Air Serbia's passenger-rights notice, conditions of carriage and the law governing the departure. At Belgrade, Serbian care thresholds can apply; at an EU feeder airport, EU261 care can operate.
Before purchasing another transatlantic ticket, ask Air Serbia for the earliest suitable rerouting and preserve available options. Self-booked transport is easier to justify when the carrier's alternative was materially ineffective and the passenger documented attempts to resolve it.
International delay expenses can also be considered under the Montreal Convention, up to the current passenger-delay SDR limit, subject to causation and the carrier's due-care defence. Lost income is not automatically reimbursed merely because it is stated.
Filing and escalation
Submit the Air Serbia claim with the complete itinerary, ticket number, original and revised schedule, cancellation notice, passenger choice and original payment evidence. For a DOT refund request, state that no alternative transportation, credit or voucher was accepted.
