Air Serbia five-hour delay: refund, return or continue?

Short answer: after an Air Serbia departure delay reaches at least five hours, a passenger covered by the relevant passenger-rights framework can normally abandon the journey and request reimbursement. If travel has already begun and no longer serves its original purpose, a return to the first departure point may also be required. Continuing the trip is a different choice and usually means the flown ticket is not refundable merely because of that delay.

The five-hour rule concerns a transport decision. It is not the same as fixed compensation, which normally turns on final arrival, legal coverage and the cause of disruption.

Decide whether the trip still has value

Before selecting refund, answer four practical questions:

  1. Has the departure delay actually reached five hours?
  2. Is the remaining journey still useful at the expected arrival time?
  3. Has any part of the booking already been used?
  4. Does the passenger want money back or transport to the destination?

A passenger travelling for a two-hour meeting may reasonably conclude that an arrival the next day defeats the journey. A traveller beginning a month-long visit may prefer to wait and continue. The legal option belongs to the passenger; the airline should not convert it into a voucher without informed agreement.

The passenger should explicitly communicate the choice. Write that travel is being abandoned under the applicable five-hour provision and identify every coupon for which reimbursement is sought. Do not simply fail to board, because a no-show record can obscure the statutory reason.

Direction still determines the legal source

Air Serbia's passenger-rights notice includes the five-hour reimbursement option. For an EU departure, Article 6 of EU261 connects a sufficiently long delay to the reimbursement rules in Article 8. For a departure from Serbia, use the Serbian statutory framework and the carrier's Serbian procedure. For London departures, UK261 contains the retained UK equivalent.

Do not cite EU261 for Belgrade-New York solely because Serbia participates in the ECAA. The Serbian system implements comparable protection, but it remains a distinct national legal route.

Refund and fixed compensation can coexist

Abandoning a journey after five hours does not automatically create fixed compensation, and it does not necessarily destroy a valid fixed claim. Analyse them separately:

  • reimbursement repays transport that will not be used;
  • fixed compensation addresses qualifying inconvenience;
  • care covers reasonable needs during the wait;
  • Montreal Convention damages address proven loss caused by international delay.

For an EU261-covered service, fixed delay compensation ordinarily requires three hours or more at final arrival. A passenger who never flies after invoking the five-hour refund option cannot use a later actual arrival on that service in the ordinary way, so case-specific legal analysis may be needed. A cancellation or denied-boarding claim can have a clearer fixed-payment route.

Avoid writing one total without labels. Air Serbia should be able to see which amount is ticket reimbursement, which is care expense and which is statutory compensation.

Care continues while the decision is pending

Before five hours, distance-based waiting thresholds may already require food, drinks and communication. If departure moves to the next day, accommodation and airport-hotel transport can become necessary.

Care usually runs until the passenger chooses reimbursement or until suitable rerouting departs. Once a traveller ends the transport contract and leaves for private reasons, later leisure accommodation is not automatically the carrier's expense.

Ask Air Serbia for practical assistance first. When it is unavailable, buy modest meals, a reasonable room and necessary transfer, then retain itemised invoices showing date, location and items. A card statement proves payment but not what was purchased.

Example: delayed connection in Belgrade

A passenger holds one ticket from Athens through Belgrade to New York. The Athens departure is delayed six hours before the first sector leaves.

Possible choices:

  • continue the protected itinerary and let Air Serbia reroute the missed connection;
  • abandon before departure and request reimbursement of the unused ticket;
  • if stranded after an earlier used sector and the purpose is lost, request a return to the journey's first point plus the appropriate reimbursement.

Because the itinerary begins in the EU, EU261 can frame the five-hour choice. Any fixed compensation would still depend on the disruption, final-destination consequences and extraordinary-circumstances analysis.

Change the origin to Belgrade. The practical choice can look similar, but the written claim should rely on Serbian passenger law and Air Serbia's notice, not describe the case as an EU261 departure.

Do not confuse a statutory refund with voluntary cancellation

Passenger-initiated cancellation before a disruption follows the ticket's fare conditions. The five-hour option arises because the carrier's delay has crossed a statutory threshold. Using a normal “cancel booking” path can trigger fare penalties or a non-refundable result that should not apply to the disruption remedy.

Preserve a screenshot of the delay and contact Air Serbia through a channel that records the request. If airport staff cannot process reimbursement, ask them to note the disruption and submit the written claim promptly afterward.

Evidence and wording

Attach:

  • booking confirmation and e-ticket receipt;
  • original schedule and updated departure estimates;
  • proof that the five-hour point was reached;
  • written notice that the journey was abandoned;
  • explanation of why used travel no longer served its purpose, if claimed;
  • confirmation of any return transport;
  • receipts for care that Air Serbia did not provide;
  • bank details and the carrier's case reference.

A concise request might state the scheduled departure, the time the delay reached five hours, the legal regime selected from the origin, the passenger's reimbursement choice and the exact unused sectors. Add fixed compensation only as a separate alternative section.

For a Serbian case, do not miss the 90-day carrier-complaint step. The later Civil Aviation Directorate process expects proof that Air Serbia had a complete opportunity to respond during the official 60-day period.

FAQ

Must I wait five hours after Air Serbia cancels a flight?

No. Cancellation creates an immediate refund-or-rerouting choice under the applicable rules. The five-hour threshold is principally a delayed-departure remedy.

Can I take the flight and still request a full ticket refund?

Usually not for transport knowingly accepted and completed. Fixed compensation and reasonable expenses may remain separate, but reimbursement addresses the unused journey.

Does five hours mean EUR 600 compensation?

No. The fixed amount depends on route distance, governing law, final impact and cause. A five-hour departure delay is not itself a EUR 600 formula.

Can reimbursement include my return to the starting airport?

It can when travel has already begun, the delay makes the trip pointless and the applicable rules require a return to the first departure point.

Is a Wizz or rail ticket automatically refunded if I leave?

No. Alternative transport has its own reasonableness and prior-contact analysis. First choose between Air Serbia rerouting and reimbursement, then document why self-arrangement was necessary.
