Virgin Atlantic three- or four-hour delay: GBP 260 or GBP 520?
On a Virgin Atlantic journey longer than 3,500 kilometres, final arrival between three and four hours late can produce GBP 260, while arrival more than four hours late can produce GBP 520 under UK261. The threshold uses arrival at the last destination on one protected booking, not the time the aircraft took off, landed or reached the stand. Do not assume that “four-hour delay” in an email is exact. Airline messages may describe departure, projected arrival or a rounded duration. Request the timestamp used by Virgin when the result sits close to the boundary.
Which arrival moment counts?
European case law used in interpreting the retained UK framework treats arrival as the time when at least one aircraft door opens and passengers are allowed to leave. Touchdown is too early because passengers remain confined. Baggage delivery is usually too late because the flight itself has already arrived.
Useful evidence includes the airline’s operational record, gate data, cabin announcements, a timestamped photograph or message sent when disembarkation began, and independent airport information. A flight-tracking service can corroborate the sequence but should not replace the strongest operational evidence.
Suppose a Barbados-London service touches down three hours and forty minutes late, waits for a stand, and opens its first door four hours and six minutes after schedule. If UK261 coverage and cause tests are met, the GBP 520 band may be relevant. Using touchdown would wrongly reduce the claim.
Connections can move the finish line
Final destination means the endpoint shown on a continuous reservation. A passenger travelling Mumbai-London-Newcastle on one ticket may need to measure Newcastle arrival. If the London delay causes a missed connection and Newcastle is reached eight hours late, the whole protected journey matters even if the Virgin aircraft opened its door three hours and twenty minutes late.
Separate tickets usually break that logic. When Mumbai-London is one reservation and London-Newcastle another, Virgin’s contracted destination may be London. A missed self-transfer can still generate insurance or contractual questions, but it is not automatically added to the UK261 clock.

Coverage in each direction
Virgin Atlantic is a UK carrier. Its UK departures are protected, as are many Virgin-operated arrivals from outside the UK. Therefore a Virgin-operated Delhi-London flight can potentially qualify, not only London-Delhi. A Delta-operated US-London flight carrying a VS marketing number does not acquire Virgin’s carrier status.
EU261 provides another route to compensation for Virgin flights departing an EU airport. A Paris-New York departure can reach EUR 600 after a qualifying long delay. A standalone New York-Paris Virgin service normally falls outside EU261 because Virgin is not an EU carrier, yet UK261 may protect the same service as a UK-carrier arrival into the EU; refund, baggage and contractual rights remain separate.
Where both UK and EU arguments appear, define the specific journey and remedy. The passenger cannot obtain duplicate fixed awards for the same inconvenience. The coverage comparison keeps the two territorial tests separate.
The cause can still defeat the amount
Crossing three or four hours is necessary but not sufficient. Virgin can avoid the fixed payment by proving an extraordinary circumstance that caused the delay and could not have been avoided through reasonable measures. Severe weather, an air traffic flow restriction, airport closure or an external security event may qualify.
The explanation must relate to the particular service. Ask when the event began, how it affected this aircraft or crew rotation, when it ended and what alternatives were considered. A remote event on an earlier sector may have a causal effect, but the carrier should demonstrate the operational chain.
Routine technical problems and internal resourcing often stay within the airline’s normal activity. Not every component failure is routine: an externally caused strike, hidden manufacturing defect or foreign-object damage can require a different conclusion. Do not concede the defence based on a one-line category.
Care and five-hour reimbursement are separate
The three- and four-hour bands concern fixed compensation at arrival. Care starts from expected departure-delay thresholds tied to distance and can apply even before the flight arrives. It may include meals, communications, overnight accommodation and airport-hotel transport.
At least five hours of departure delay can create a choice to abandon the journey and obtain reimbursement under UK261. That is not an extra GBP 520. A passenger continuing to travel retains the delay analysis; a passenger abandoning the trip should record the refund election and avoid using the refunded sector.
Present the calculation clearly
Attach the itinerary, ticket, boarding pass and operated-by evidence. State scheduled and actual door-opening time at the final destination. Show distance using the protected journey rather than an unrelated mileage figure. List each passenger and request GBP 260 or GBP 520 individually.
If Virgin offers GBP 260 but evidence shows more than four hours, ask for the timestamp and legal basis used. If it offers GBP 520 despite rerouting within a reduction window, verify before accepting that the sum and release terms match the claim. The compensation amount page covers all bands.

It is a boundary that should be assessed with precise arrival evidence and the current legal wording. Do not rely on a rounded display; ask for the door-opening timestamp.
Does a late bag extend the flight arrival delay?
Normally no. Baggage delivery is a separate issue under Montreal rules; flight arrival generally occurs when passengers are permitted to leave the aircraft.
Can my connection delay turn GBP 260 into GBP 520?
Yes, on one protected booking the final destination’s arrival time controls. A later partner sector can therefore affect the overall delay, subject to operating-carrier rules.
Is a Virgin flight into London always covered?
