Virgin Atlantic India flight: UK261 and DGCA CAR rights

Virgin-operated flights between the United Kingdom and India can generally fall under UK261 in both directions, while India’s DGCA Civil Aviation Requirements add separate delay, cancellation, care, refund and denied-boarding protections. The strongest fixed claims usually arise where Virgin actually operates and UK261 timing and cause tests are met. A domestic IndiGo sector needs its own operator and ticket analysis.

Read “operated by” on every sector. A VS marketing code, through baggage or loyalty credit does not merge Virgin and IndiGo.

UK261 amount on India routes

UK-India journeys exceed 3,500 kilometres. A protected final arrival from three to four hours late can therefore produce GBP 260; more than four hours can produce GBP 520. A qualifying short-notice cancellation or involuntary denied boarding can also reach GBP 520, subject to rerouting reductions.

Virgin can avoid fixed compensation only if it proves an extraordinary circumstance and reasonable measures. Severe weather, external air traffic restrictions or airport closure may qualify. Routine technical defects and internal staffing often do not. Care and rerouting can remain even where the fixed sum fails.

DGCA CAR delay protections

India’s current CAR Section 3, Series M, Part IV sets departure-delay assistance thresholds by scheduled block time. Broadly, care can start after two hours for shorter flights, three hours for mid-length flights and four hours for longer flights, provided the passenger checked in on time and the conditions apply.

For domestic flights expected to be delayed more than six hours, the current CAR requires an alternative flight within a specified period or a full refund. Long overnight or 24-hour delays can activate accommodation provisions. These Indian rules should not be converted into GBP 520; they address a different framework.

Foreign international operations and exceptional circumstances require careful application of the CAR and carrier tariff. Keep the official version effective on the travel date. AirSewa and DGCA channels can be relevant after the airline complaint stage.

Cancellation and denied boarding in India

The CAR provides notification, alternate-flight, refund and compensation mechanisms for qualifying cancellation and involuntary denied boarding. Amounts can be tied to flight duration, fare components and statutory caps rather than UK distance bands. The passenger should use the current official table instead of an old rupee figure from a travel blog.

Record when Virgin informed the passenger, the replacement offered and actual arrival. Under UK261, fourteen-day notice and statutory replacement windows matter. Under Indian rules, notice and alternate arrangements have their own wording. One event can engage both systems, but the passenger should disclose payments and prevent double recovery.

Care, hotel and meals

UK261 requires care on a protected Virgin service according to waiting time and can continue during extraordinary events. Indian CAR also contains facilities for qualifying delays and cancellations. Ask Virgin at the airport before purchasing necessities.

Keep itemised receipts for meals, hotel and transfer. Explain why the airline did not provide care and why the cost was reasonable. Family, disability and medication needs should be recorded. Alcohol and luxury upgrades are weak items.

If a domestic partner is responsible for the wait, direct the immediate request to that operator while preserving the through-ticket evidence. Contractual interline arrangements may affect rebooking even when fixed compensation follows another carrier.

Missed connection and baggage

One-ticket travel can protect the final destination. A Virgin-operated London-Delhi sector followed by an IndiGo connection sold on the same ticket may require rerouting when the first flight makes the connection impossible. Separate bookings often leave the passenger responsible for the self-transfer unless a platform guarantee or insurance applies.

Check whether baggage was tagged through. Report missing luggage before leaving the destination airport and obtain a property irregularity reference. Montreal rules generally govern international baggage, with a current liability ceiling of 1,519 SDR per passenger for proven loss, not an automatic award.

Build two clear claim sections

For UK261, state complete route, one-booking status, operator, final arrival delay, cause and requested GBP amount. For Indian rights, identify the CAR provision or airline commitment, departure delay, care or refund requested and the India complaint reference.

Attach e-ticket, boarding passes, operated-by wording, immigration or arrival evidence, cancellation messages, rebooking offers and receipts. Keep communications in English where possible but preserve original documents. If one passenger files for others, collect authority.

FAQ

Can Delhi to London on Virgin qualify for GBP 520?

Yes. Virgin is a UK carrier, so its UK arrival can qualify when final delay exceeds four hours and no successful extraordinary defence applies.

Does DGCA CAR pay the same fixed amount as UK261?

No. Indian rules use their own delay, care, fare and cap structure. Do not present rupee remedies as a conversion of GBP 520.

Is an IndiGo domestic connection covered by UK261?

Not automatically. One-booking final-destination logic and the operator responsible require analysis; a separate domestic ticket normally stands alone.

Can I receive care during extraordinary weather?

UK261 care can remain on a protected service despite extraordinary circumstances. Indian CAR also has assistance rules subject to its conditions.

Where can an unresolved Indian complaint go?

After complaining to the airline, AirSewa and DGCA processes may be relevant. UK261 disputes can also use the appropriate UK escalation route when eligible.
