Virgin Atlantic compensation claim form: evidence and submission

Compensation, ticket refund, care expenses and baggage claims may use different forms, so one vague message can slow every part of the case.

Virgin’s disruption page currently separates compensation and expense routes. Keep a complete copy of each submission and its reference. The following eight steps match the visible process a passenger can follow.
Eight steps to submit the claim
- Confirm the operating carrier and complete itinerary. Find the “operated by” line, all ticket numbers, booking reference and every sector issued together. A VS marketing number does not prove Virgin controlled the affected flight.
- Choose the passenger-rights framework. Test UK261, EU261, US DOT, Canadian APPR or Indian CAR against direction and operator. Do not request a UK amount on a journey outside UK261 merely because Virgin sold the ticket.
- Record the disruption and final arrival time. Preserve original and replacement schedules, notice timestamps, door-opening time and the reason given. For connections, record arrival at the last destination on one booking.
- Separate compensation, refund, care and baggage requests. State each remedy under its own heading. A GBP 520 claim does not include the unused fare, meals or luggage loss.
- Collect booking records, notices and itemised receipts. Include e-ticket, boarding passes, operated-by proof, Virgin messages, rebooking offers and merchant receipts. A bank statement alone may not identify the purchase.
- Use the matching Virgin Atlantic online form. Select the channel named for post-travel compensation or expenses, or the dedicated baggage path. Enter facts consistently across submissions.
- Save the submission and case reference. Capture the confirmation screen, sent text and attachment list. Store the date because ADR eligibility and limitation clocks can depend on correspondence.
- Follow up or escalate without opening duplicate cases. Reply under the same reference, ask targeted questions and use AviationADR only after the airline stage and current eligibility requirements are satisfied.
Before opening the form
Prepare a concise chronology in a text document. List scheduled departure and arrival, actual departure, first door opening at final destination, missed connections, cancellation notice, replacement options and the cause given. This prevents inconsistent numbers when an online form times out.
For a family or group, list each passenger exactly as ticketed. One adult may need authority from other adults. Children should be identified separately. Do not assume one booking reference means one compensation amount; fixed payments are assessed per eligible passenger.
Translate documents only where genuinely needed. Virgin handles English submissions, so preserve original names and numbers. A short explanation beside a foreign receipt is usually more useful than altering the document.
Select the right legal route
UK261 generally covers departures from the UK and Virgin-operated arrivals into the UK. It can therefore apply to Virgin’s own services from the United States, India, Canada, the Caribbean or Africa back to Britain. A partner-operated flight needs the operator’s status.
EU261 covers a Virgin flight departing an EU airport, but ordinarily not a standalone Virgin-operated flight from a third country into the EU. Current UK261 can nevertheless protect that Virgin inbound service because a UK carrier is arriving in the EU. US DOT protects refunds after cancellation or a defined significant change on itineraries to, from or within the US, without creating a general American delay award. Canadian and Indian rules answer their own questions.

How to write the compensation request
Open with the booking reference, flight date, full route and operating airline. State the event and exact final arrival delay. For cancellation, include when notice arrived and the original and replacement schedules. Request the correct amount for each passenger and explain the distance band.
Address cause in one paragraph. Quote Virgin’s wording and ask for the underlying event, causal link and reasonable measures if it invokes extraordinary circumstances. Avoid accusing staff or speculating about maintenance without evidence.
A useful request is factual: “Virgin-operated New York-London, final door opening four hours and eighteen minutes late, ordinary technical reason stated at the gate, GBP 520 requested for each of two passengers.” It gives the decision-maker a testable file.
Refund and rerouting submissions
Identify which ticket coupons remain unused and whether the journey lost its purpose. If requesting rerouting costs, show that Virgin was asked to provide a workable alternative, what was available, why travel remained urgent and why the replacement purchase was reasonable.
Do not describe voluntary passenger cancellation as airline cancellation. A fare-rule refund and UK261 reimbursement are different. For bookings through an agent, provide the original payment receipt and correspondence showing who controls the payment path.
Expense claims
Create a table with date, merchant, item, currency, amount and reason. Attach the itemised receipt in matching order. Explain why Virgin did not provide care and why each purchase was necessary. Meals, hotel, airport-hotel transfer and communications can qualify; alcohol, luxury upgrades and unrelated purchases are vulnerable.

Baggage needs a separate file
Delayed, lost or damaged baggage is usually assessed under the Montreal Convention and Virgin’s baggage process, not as UK261 delay compensation. Include the baggage tag, property irregularity report, delivery date, inventory, purchase receipts and proof of value.
Written deadlines are short: delayed baggage claims generally need to be made within 21 days after delivery, and damage claims within seven days. Do not wait for the flight compensation response before protecting a baggage deadline.
After submission
Save confirmation and monitor the response. If Virgin gives a generic refusal, reply with focused questions rather than opening another form. Ask for operational evidence, exact arrival timing or the operator record as relevant. Keep all correspondence in date order.
