Flying Club points, reward seats and upgrades after disruption
A publicly available Virgin Atlantic reward seat can qualify for UK261 in the same way as a cash ticket, while points reinstatement, taxes, companion rewards and upgrades follow Flying Club and ticket rules. Fixed compensation still depends on route, operator, event, timing and cause. Virgin Points have programme terms and should not be assigned an invented cash value in a claim.

One disruption can involve all four. Present them in distinct sections.
Reward seats and passenger-rights coverage
UK261 excludes free or reduced fares not available directly or indirectly to the public, but includes tickets issued under frequent-flyer or other commercial programmes. A confirmed Flying Club reward seat is therefore not automatically outside protection.
If Virgin operates a protected long-haul flight and final arrival exceeds four hours for a qualifying cause, the fixed amount can be GBP 520 even though points paid the base fare. Compensation is not limited to taxes. A ticketed child on a reward seat is assessed separately.
The route still matters. UK departures and Virgin-operated arrivals into the UK or qualifying EU destinations can be covered. A Delta-operated US-origin reward flight under a VS code may sit outside UK261 fixed compensation.
Cancellation and points reinstatement
When Virgin cancels and the passenger chooses reimbursement, the unused reward should be restored in the form used: points back to the account and relevant taxes or charges through the payment path. Check companion, upgrade or credit-card voucher treatment separately.
Accepting rerouting can require Virgin to reissue the reward without demanding new points simply because current redemption prices are higher. Ask for comparable travel conditions and preserve the original cabin.
If the passenger voluntarily cancels, Flying Club’s current cancellation deadline, fee and expiry terms apply. Do not use UK261 language unless Virgin caused the disruption.
Paid upgrades
A cash upgrade from Economy to Premium or Upper Class creates a confirmed cabin and payment record. If Virgin carries the passenger lower, UK261 downgrade percentages can apply to the affected flight and the upgrade charge needs to be included in the fare analysis.
Keep original fare, upgrade receipt, reissued e-ticket and both boarding passes. Request Virgin’s attributable-sector calculation. Merely refunding a small ancillary fee may not answer a 75% long-distance downgrade claim.
If the upgrade was wait-listed and never confirmed, there may be no downgrade. The evidence must show a confirmed higher cabin before the involuntary move.
Points-funded upgrades and vouchers
A points upgrade should be reinstated if the upgraded cabin is not supplied, subject to programme and ticket rules. The statutory downgrade percentage may also arise, but expressing a points-funded fare as a monetary base can be disputed.
Do not promise one universal conversion. Ask Virgin to explain its calculation, identify the affected flight and preserve the points debit. Companion rewards and upgrade vouchers can have expiry rules; request restoration or extension when carrier disruption made use impossible.
Flying Club terms state that points have no cash value in the programme relationship. That does not remove statutory passenger rights, but it warns against inventing a cash exchange rate for reimbursement.
Partner-operated reward bookings
Flying Club can issue seats on partner airlines. Statutory fixed compensation follows the actual operator. A KLM-operated New York-Amsterdam reward can be an EU261 claim to KLM; a Delta-operated US-London reward may rely on DOT rather than UK261 fixed compensation; a Virgin-operated return can be a claim to Virgin.

Rerouting a reward passenger
Reward inventory visible to the public is not necessarily the limit of statutory rerouting. After a protected cancellation, ask for earliest reasonable transport under comparable conditions, including revenue inventory or a partner where appropriate. The passenger should not be told to wait weeks solely because a reward bucket is closed.
Provide a specific alternative and record Virgin’s response. If self-booking is necessary, document contact attempts, urgency and price. Preserve the reward points and avoid accepting a voluntary refund if rerouting remains the chosen remedy.
Fixed compensation and points
UK261 fixed sums are paid in money, not points, unless the passenger freely agrees to another form under applicable conditions. Compare any point offer with GBP 220, GBP 350, GBP 260 or GBP 520 and read release terms.
Compensation can coexist with points reinstatement because one addresses disruption and the other returns unused consideration. A goodwill points award may be additional, but disclose any settlement that purports to resolve the statutory claim.

Keep account statement before and after booking, reward confirmation, ticket numbers, taxes, voucher, upgrade, operator, original and replacement cabins and final arrival. Capture terms applicable on booking and cancellation dates.
