Essential purchases during delay
Virgin’s current guidance refers to a daily guideline of GBP 65 or USD 75 for necessary replacement items while baggage is delayed. Treat this as carrier guidance, not an automatic allowance or absolute legal cap. Recovery under Montreal depends on proven reasonable loss.
Buy what is needed for the location and delay: basic clothing, toiletries and essential medication replacements where lawful. A passenger returning home may need fewer items because substitutes are available. A passenger attending a wedding or business event can explain particular needs.
Keep itemised receipts. Card statements alone do not show what was purchased. Do not buy luxury replacements or an entire wardrobe on the first day. If the bag arrives sooner than expected, stop additional spending.
Montreal Convention limit
From 28 December 2024, the international baggage liability limit is 1,519 Special Drawing Rights per passenger. SDR is an IMF unit whose local-currency value changes. The ceiling covers the passenger’s combined proven baggage loss under the relevant carriage; it is not a guaranteed cheque for every missing suitcase.
Claim actual value, depreciation, essential purchases and other provable loss within the legal framework. A used item is not normally valued as new without justification. Provide receipts, photographs, serial numbers or comparable replacement evidence.
Passengers carrying unusually valuable baggage can consider a special declaration of interest and any additional charge before travel. Ordinary checked-baggage limits and exclusions still matter.
Build a lost-bag inventory
List each item, brand, description, purchase date, original price, current value and evidence. Group clothing, electronics, personal items and the suitcase. Avoid a single round total with no detail.
Attach photographs from before travel where available, purchase records and proof of trip purpose. Explain items without receipts honestly and use reasonable second-hand value. False or inflated inventories can undermine the entire claim.
Include all passengers whose property was in the bag. Montreal’s limit is per passenger, but evidence should show ownership and how baggage was checked.
Multi-carrier journeys
Virgin may carry the long-haul sector while Delta, Air France, KLM, IndiGo or another partner carries a connection. Montreal can permit a baggage claim against certain actual, first or last carriers depending on the journey. Report at the final airport and keep every baggage tag.
The airline paying UK261 fixed compensation is not necessarily the only baggage respondent. Do not let carriers pass the passenger endlessly; ask for a written transfer and preserve the trace reference.
Separate tickets can require collecting and rechecking baggage. Failure to do so can change liability. Keep proof of through-tagging and transfer instructions.
Deadlines
For delayed checked baggage, a written complaint must generally be made no later than 21 days after the bag is placed at the passenger’s disposal. Court action under Montreal must normally be brought within two years from arrival, scheduled arrival or stopping of carriage.
The airport report does not safely replace the detailed written claim. Submit receipts and loss promptly. If the bag becomes lost, update the same reference and request the loss process.
These clocks are distinct from a UK261 court period or AviationADR filing rule. Put them in a deadline table.
Flight delay and baggage delay together
A passenger reaching London five hours late and receiving the bag two days later may have two claims. UK261 fixed compensation depends on route, final arrival and cause. Montreal baggage damages depend on actual loss and notices.
Do not request GBP 520 because the bag was late. Do not reduce essential-purchase receipts merely because fixed flight compensation was paid. The remedies address different harm, while duplicate payment of one item remains prohibited.

Claim package
Attach the property irregularity report, baggage tag, boarding passes, itinerary, delivery record, essential-purchase receipts and inventory. State dates and currencies. Preserve Virgin’s tracking messages and reference.
Ask for actual proven loss and explain reasonableness. If Virgin applies only its daily guideline, request the legal and factual basis where documented loss is higher. Keep a complete submission copy.
