UK261 on Virgin-operated travel
Virgin Atlantic Airways Limited is a UK carrier, so both UK departures and its own inbound UK services from Canada can be protected. Delay compensation normally requires final arrival at least three hours late. On a journey over 3,500 kilometres, three to four hours can produce GBP 260 and more than four hours can produce GBP 520.
Cancellation compensation depends on notice and replacement timing. Fourteen or more days’ notice usually excludes the fixed amount. Denied boarding has its own immediate compensation and travel-choice rules. Extraordinary circumstances may defeat fixed compensation, but care and rerouting can remain.

APPR compensation bands
Under the current APPR framework, compensation for delay or cancellation within carrier control and not required for safety depends on final arrival and whether the operator is classed as a large or small airline. For a large airline, the current bands are CAD 400 for three to under six hours, CAD 700 for six to under nine hours and CAD 1,000 for nine hours or more. Small-carrier bands are lower.
Verify the operator’s classification on the event date. Do not assume that every partner on the itinerary shares Virgin’s category. Canadian rules also distinguish events within control, within control but required for safety, and outside control.
APPR includes standards for communication, assistance, alternate travel and refunds. The precise obligation changes with the cause category. A UK261 extraordinary-circumstances analysis is similar in purpose but not identical to APPR’s control-and-safety structure.
Claim timing under APPR
A passenger generally has one year from the disruption to request APPR compensation from the airline. The airline should respond within 30 days by paying or explaining why compensation is not owed. Verify the current regulation and CTA guidance before filing.
This one-year request period is not the same as a UK court limitation or AviationADR deadline. Put each date in a separate record. An airline complaint may be followed by a Canadian Transportation Agency process, while an eligible UK dispute can go to AviationADR.

Canadian domestic ticket bought separately
The passenger books a domestic connection independently and misses it after Virgin arrives late. Virgin’s UK261 endpoint may be the Canadian gateway. APPR, insurance or the domestic fare terms govern the separate loss; it is not automatically added to the Virgin claim.
Care, refunds and rerouting
On a protected UK261 journey, Virgin owes reasonable care during qualifying waits even when an extraordinary event caused the disruption. APPR’s treatment of food, communication and accommodation depends on its cause categories and timing.
Ask the operating airline to provide assistance. If it does not, retain itemised receipts and explain necessity. For cancellation, decide whether to accept rerouting or take a refund. A passenger cannot use replacement transportation and recover the full unused fare for the same sector.
Canadian refund provisions and UK261 reimbursement should be presented as alternative or complementary routes only where legally distinct. Keep vouchers voluntary when money is due.
Evidence and claim strategy
