United Airlines delayed flight compensation
A United Airlines delay can qualify for EUR 250-600 when the protected journey begins in the EU, EEA or Switzerland, or GBP 220-520 when it begins in the United Kingdom. The usual threshold is arrival at the final ticketed destination at least three hours late. A United-operated trip that starts in the United States normally has no EU261 or UK261 fixed delay award.

Choose the situation that applies to your flight:
Test a delayed United itinerary after confirming its first airport and every operated-by entry. This prevents a strong Europe-origin connection claim from being discarded and an ineligible US-origin claim from being overstated.
Fast delay decision
| Question | Claim remains possible when... |
|---|---|
| Territorial scope | The continuous trip started in Europe or the UK, or an eligible inbound operator changes the result |
| Arrival threshold | The final destination was reached at least three hours late |
| Responsibility | United has not proved an extraordinary event that reasonable measures could not overcome |
| Booking structure | Connecting sectors were issued as one journey rather than a self-transfer |
All four should be documented. A screenshot saying "delayed" proves little without route, actual arrival and cause.
Which United delays are inside EU261 or UK261?
Any carrier can be covered on departure from the protected territory. Paris-Newark, Dublin-Chicago and Frankfurt-Washington Dulles operated by United can therefore enter EU261. Heathrow-Newark or Edinburgh-US hub on United can enter UK261.
The reverse direction is not symmetrical. United is not an EU or UK carrier, so a new journey beginning in Newark, Chicago or another US airport and ending in Europe is usually outside these fixed-sum regimes. A UA marketing code operated by Lufthansa, SWISS or another eligible European carrier requires a fresh operator test.
A round trip does not turn both directions into one protected flight. The outward and return journeys are assessed separately even when they share a confirmation number.
Measure delay where the ticket ends
For a directly connecting journey on one booking, compare scheduled and actual arrival at the final destination. Suppose a traveller holds Dublin-Newark-Austin as one ticket. The first aircraft reaches Newark only 80 minutes late, but the missed connection produces a five-hour delay in Austin. The legally significant result is usually the Austin arrival.
If Dublin-Newark and Newark-Austin were bought separately, the first contract usually ends at Newark. The missed self-transfer does not automatically move the final destination to Austin.
Arrival is not wheels-down time. Under the European rule, the useful marker is generally when at least one door opens and passengers are permitted to leave. Preserve a timestamped message, photo, app record or airport data when the case sits close to three hours.
The three-hour United guide deals with time zones, door opening and borderline arrivals in more detail.
The United case about a later US sector
C-561/20 concerned Brussels-Newark-San Jose on one reservation, operated throughout by United. The passengers arrived 223 minutes late after the problem on the Newark-San Jose sector. The Court confirmed that the connected journey could be assessed as a whole because it began in the EU.
This matters whenever a United domestic segment breaks a continuous Europe-origin itinerary. It does not create EU261 coverage for an ordinary San Francisco-Denver ticket bought independently. The initial departure and single-booking evidence are indispensable.
Delays likely to support fixed compensation
Ordinary operating risks can support a claim on a covered route. Examples include a routine mechanical defect, avoidable aircraft rotation issue, crew planning within normal operations or a knock-on delay that United has not connected to a qualifying extraordinary event.
Do not assume that every technical entry is payable. Hidden manufacturing defects, sabotage, collision with foreign objects and some airport-system failures can require a different analysis. United may also rely on weather or air-traffic control, but it should explain the event, its effect on this flight and the reasonable measures attempted.
Compare the actual operation. If similar services departed, ask why this aircraft or crew remained unavailable. A broad airport weather report does not by itself prove causation several hours later.
Compensation bands and the half reduction
Most direct transatlantic routes exceed 3,500 km. A qualifying EU departure can therefore reach EUR 600, while a qualifying UK departure can reach GBP 520. Shorter feeder or standalone journeys use lower bands.
For a long-distance journey, rerouting that arrives between three and four hours late can permit a 50% reduction in fixed compensation. At four hours or more, the full long-haul amount is generally the starting point. This reduction concerns compensation, not a reasonable expense claim.
Use the United compensation amount guide rather than multiplying route segments separately. A connected journey normally produces one distance calculation, not an award for each late aircraft.
Care begins before the compensation threshold
Meals, communications, hotel and transport depend on waiting time and route distance, not on a three-hour final arrival. On a long-haul departure, care commonly becomes relevant after four hours at the airport. Overnight waiting can require accommodation and transfers.
Care is due during an extraordinary-circumstance disruption as well. If United does not provide it, buy only reasonable necessities and keep itemised receipts. Luxury accommodation, alcohol and unrelated purchases are vulnerable to rejection.
A passenger who continues the journey can still seek fixed compensation if all tests are met. A departure delay reaching five hours also creates a distinct right to stop travelling and seek reimbursement under EU261 or UK261.
Build the claim in the right order
- Save the ticket, original schedule and operated-by details.
- Identify the first airport of the continuous journey.
- Calculate final arrival using local dates, time zones and door opening.
- Request the precise reason and keep all United notices.
- Separate fixed compensation from care expenses and any unused-fare refund.
- Submit through United Customer Care with the amount and legal basis stated.
For an EU incident, a national enforcement body may provide a non-binding view after the airline process. For a UK incident, United is not listed by the CAA among current approved ADR participants, so the CAA's Passenger Advice and Complaints Team may be the escalation path after the required first complaint.
Example: Frankfurt to Boise via Chicago
A passenger holds one United-operated ticket from Frankfurt through Chicago to Boise. A routine aircraft defect delays the Chicago-Boise sector and the passenger reaches Boise four hours and 20 minutes late. The journey began in the EU, remained one connected booking and crossed the long-distance threshold. Subject to proof and any defence, EUR 600 can be due.
On Boise-Chicago-Frankfurt in the opposite direction, United's US status matters. That separate journey starts outside the EU, so the same delay usually produces no EU261 fixed amount unless an eligible European carrier actually operates the relevant inbound service.
FAQ
How late must a United flight be for compensation?
For an eligible EU261 or UK261 delay claim, final arrival normally needs to be at least three hours late. Care can become due earlier.
Does the delay count at Newark or my final city?
On one directly connecting booking, use the final ticketed destination. With separate tickets, each contract is usually assessed on its own.
Does United pay for a mechanical delay?
Routine technical faults are not automatically extraordinary under European and UK rules. United must establish any external exception it relies on.
Can I claim for a United delay from the US to Europe?
Usually not fixed EU261 or UK261 compensation when United operates a journey starting in the US. Check codeshare operation and other refund or baggage remedies.
Can I claim meals as well as fixed compensation?
Yes, eligible care costs and fixed compensation have separate purposes. Preserve itemised receipts and avoid counting the same expense twice.
