United Airlines 5-hour delay: refund or continue travelling?

After a departure delay of at least five hours on a United journey covered by EU261 or UK261, the passenger can abandon travel and request reimbursement, including a return to the first departure point when a partly completed trip no longer serves its purpose. This is not the same as the three-hour final-arrival test for fixed compensation.

Before selecting "cancel" in the United app, preserve proof that the airline delayed the flight and state that you are choosing the statutory reimbursement option. A voluntary cancellation under fare rules can produce a travel credit instead of the cash remedy you intended.

A passenger can cross one threshold without crossing the other. A flight delayed five hours at departure may recover time and arrive 2:45 late; reimbursement was available before travel, but fixed delay compensation may fail. Another passenger may depart 2:30 late, miss a connection and arrive six hours late; fixed compensation can arise despite never waiting five hours at the first gate.

Which United journeys receive the five-hour choice?

EU261 covers United departures from the EU and EEA, with relevant protection also applying to Swiss departures. UK261 covers United departures from the United Kingdom. The rule can apply to a connected itinerary if all sectors form one reservation.

A United-operated journey that begins in the United States is normally outside these five-hour statutory provisions, even when Europe is the destination. US DOT refund rules use cancellation or a defined significant change rather than copying the EU five-hour departure threshold.

For an international itinerary subject to DOT rules, a six-hour or greater schedule shift is one form of significant change, but the passenger must reject the altered itinerary or alternative transport to obtain the automatic refund. Do not merge that rule with EU261.

What reimbursement can include

When the passenger decides not to continue after the protected five-hour delay, reimbursement generally covers the unused ticket. If travel has already begun and the remaining journey no longer has purpose in relation to the original plan, it can also cover the used portion and a return flight to the first point of departure at the earliest opportunity.

That extended remedy requires facts. A business traveller who misses the only meeting may be able to show that continuation is pointless. A holiday traveller who simply prefers a later date may instead need rerouting or fare-rule options.

Write the reason and request before leaving the airport. Ask United to confirm cancellation of the remaining coupons without marking the passenger as a no-show.

What happens if you continue flying?

Choosing to take the delayed flight normally means you no longer seek reimbursement of that used transport. You retain care rights during the wait and can still claim fixed compensation if final arrival meets the threshold and United lacks a valid extraordinary-circumstances defence.

The decision should be practical:

  • compare expected final arrival with the trip's purpose;
  • check whether United can reroute sooner;
  • consider visas, hotel bookings and onward separate tickets;
  • preserve all alternatives displayed in the app;
  • avoid accepting a credit before understanding cash rights.

If United cancels rather than merely delays the service, the cancellation choice between reimbursement and rerouting applies without waiting five hours.

Care while the decision is pending

United must provide reasonable care on a covered delay according to distance and waiting time. Long-haul passengers normally reach the care threshold after four hours. Meals, refreshments and communication should be proportionate. Overnight delay can require hotel accommodation and transport between airport and hotel.

Extraordinary circumstances do not erase care. A severe storm may defeat fixed compensation but still leave United responsible for assistance while the passenger waits for its rerouting.

Can reimbursement and fixed compensation coexist?

They can coexist only when the facts independently satisfy both remedies. A passenger who continues travelling and reaches the final destination at least three hours late can test fixed delay compensation. A passenger who abandons a merely delayed flight after five hours should not claim the fixed amount solely from that departure wait, because there is no qualifying late arrival by that passenger. Fixed compensation can still arise from a separately established cancellation or denied-boarding event.

The amount is not automatically EUR 600 or GBP 520. Route distance, the legal event, notice, final timing and the cause still matter. If United proves an unavoidable ATC closure, reimbursement and care can be due while the fixed amount is not.

State each remedy separately in the submission:

  1. unused fare and taxes;
  2. any necessary return transport required by the regulation;
  3. itemised care expenses;
  4. fixed compensation, if independently due, and its legal calculation.

Avoid the voluntary-cancellation trap

Do not click a generic "cancel trip" button without saving the delay screen. United's automated flow may apply fare conditions and issue a future flight credit. Instead, use Customer Care or the refund route and say that the flight was delayed at least five hours and that you elected not to travel under the applicable passenger-rights regime.

Keep the original e-ticket, scheduled departure, status screenshots, gate records, conversations and refund confirmation. If an OTA issued the ticket, notify both United and the ticket agent; identify which party is processing the refund without sending a fixed-compensation claim to the seller merely because it collected payment.

Connected journey example

A passenger travels Dublin-Newark-Nashville on one United booking. Departure from Dublin is delayed six hours because of a routine technical defect. The planned event in Nashville ends before any realistic arrival. The passenger tells United that the journey no longer serves its purpose and requests reimbursement rather than accepting travel the next day.

EU261 can support reimbursement of the unused journey. If the passenger had already flown a feeder into Dublin on the same protected itinerary, a return to the original departure point may need analysis. Fixed compensation remains a separate question based on scope and cause.

The reverse Nashville-Newark-Dublin trip starts in the US. A five-hour wait does not automatically create the EU statutory option against United, although DOT cancellation or significant-change rules and United's fare or disruption commitments may provide a refund.

A short written request

Use precise language:

United flight [number] from [airport] on [date] has been delayed at departure by at least five hours. This journey began in [EU/EEA/Swiss/UK airport] and is covered by [EU261/UK261]. I elect reimbursement rather than travel and ask that all unused coupons be protected from no-show cancellation. The journey no longer serves its original purpose because [short reason]. Please confirm the refund to the original payment method and any required return transport.

FAQ

Does a five-hour United delay guarantee compensation?

No. Five hours creates a reimbursement choice on a covered departure. Fixed compensation uses territorial scope, final arrival and cause tests.

Can I take the flight and still demand a refund?

Normally not a full refund for transport you accepted and used. You may retain fixed-compensation and care-expense claims.

Must United refund cash instead of a travel credit?

When statutory reimbursement is due, a voucher or credit should require the passenger's informed agreement. State that you want the original payment method.

Does the EU five-hour rule apply from Newark to Europe?

Usually not when United operates a journey beginning in the United States. Check DOT significant-change rules and the actual operating carrier instead.

Can I get a return flight to my first airport?

Potentially, when a partly completed covered journey no longer serves its original purpose. Document why continuation became pointless and keep all ticket sectors together.
