Tunisair will not pay: authority, complaint portal or court

Escalate a Tunisair claim through the body connected to the governing regime and flight direction. An EU departure can lead to the relevant national enforcement body, a UK departure to UK procedures, and a Tunisian consumer or transport issue to the Tunisian Ministry route. A court claim needs separate jurisdiction and deadline checks.

Enter your route, date and type of disruption. We will check whether your case qualifies for a claim under EU 261/2004 or UK261.

Choose the situation that applies to your flight:

This guide addresses Tunisair complaint escalation for Tunisair travel. The law and airline information were checked on 28 August 2026. Verify the route and operator for the travel date.

First test the direction of the flight

Tunisair is a Tunisian carrier. It is not an EU or UK airline. EC261 can cover its European departures. A direct Tunisia-to-Europe flight is normally outside EC261.

UK261 uses a similar direction test. A UK departure can be protected. A direct Tunisair return from Tunisia normally is not.

Nationality and payment currency do not alter the test. Examine each direction separately. A protected outbound does not protect the return automatically.

After scope, examine the event, arrival delay, distance and cause. A covered flight still needs all other conditions.

Choose a body that can address the actual dispute

Start by completing the airline process with a coherent record. An authority will need the original request, evidence, rejection or proof of silence. A new narrative at escalation weakens a case that should be easy to trace.

For EC261, the enforcement body connected to the event can review regulatory compliance. Its power to order individual payment differs by country. Alternative dispute resolution may exist, but eligibility and binding effect must be checked before filing.

For UK261, use the current Civil Aviation Authority information and any approved dispute route available for the carrier. Do not send a Tunisia-to-UK case to a UK body while ignoring that the direct Tunisair-operated inbound may fall outside UK261.

The Tunisian Ministry of Transport provides an online complaint form. It can be relevant for local service issues or unresolved carrier complaints, but it does not transform an uncovered route into an EC261 claim. Court action remains a distinct remedy.

Worked example

Tunisair rejects a covered Brussels departure without explaining the cause. The passenger first requests a reasoned answer, then sends the same record to the competent Belgian channel and assesses court jurisdiction before limitation expires. The escalation identifies the EU flight rather than the entire return booking.

What can be requested in a covered Tunisair complaint escalation case?

Fixed payment, ticket choices and care costs are separate. List each requested amount.

Tunisair complaint escalation: refund or reroutingCancellation or five-hour waitTicket, offer and choice.

EC261 normally uses great-circle distance. A protected through booking uses its final destination. Timely rerouting can sometimes reduce a fixed payment.

Extraordinary events may remove only the fixed payment. They do not erase every duty. Tunisair must prove the event, causal link and reasonable measures.

Evidence checklist

For this Tunisair complaint escalation request, preserve the following material:

  • Original claim and attachment list.
  • Airline acknowledgement or proof of delivery.
  • Full rejection or silence timeline.
  • Territorial and operating-carrier analysis.
  • Calculation of each requested amount.
  • Authority or ADR eligibility rules.
  • Jurisdiction and deadline note before court action.

How to submit and preserve the claim

Tunisair provides separate forms for flight, ticket, ground, onboard and baggage issues. Choose the form matching Tunisair complaint escalation. The airline says each form is personal. Prepare one request per traveller.

State the date, airports, PNR, ticket number and operator. Give times with the time zone. List each remedy on a separate numbered line.

Attach readable copies, not original documents. Keep the ticket, passes, notices and receipts. Save the submitted text and confirmation page.

Tunisair says it aims to answer within two months. That is not a universal time limit. Ask a vague refusal for the precise cause and measures taken.

Escalation depends on the regime and departure state. An EU body may examine compliance. It may not recover money in every case. Tunisia also has a Ministry complaint portal. Court rules need a separate review.

Common mistakes to avoid

A Tunisair code does not prove who operated the flight. Check the operated-by line. Test the EU outbound and Tunisia return separately. Accept a voucher only by informed choice.

Keep baggage, refund, care and fixed payment amounts separate. Each has its own basis. Calculate the request rather than sending one unexplained total.

The EU reform approved in July 2026 is not yet applied on the checked date. Its future nine-month claim rule is not a current deadline. Nor is its 30-day reply rule. Existing law and national limitation rules still govern.

FAQ

Can any EU authority order Tunisair to pay me?

No. Competence and enforcement powers differ. Use the body connected to the covered event and check whether it resolves individual payment.

Can I complain to the Tunisian Ministry?

Yes, the Ministry provides a complaint portal. Its role and remedy differ from an EC261 enforcement body or court.

Should I escalate before Tunisair replies?

Usually preserve a reasonable airline opportunity first, unless a short deadline or urgent remedy requires earlier action.

Does an authority complaint stop limitation?

Do not assume it does. Court limitation can continue while an administrative or ADR process is pending.

Can I sue in my home country?

Sometimes, but jurisdiction depends on the contract, route and applicable procedural law. Obtain case-specific advice before filing.
