Tunisair claim time limit: EC261, Montreal and baggage deadlines
There is no single Tunisair deadline for every claim. The airline conditions mention 30 days for flight-delay notice and two years for liability actions, while EC261 court limitation depends on the competent national law. Baggage damage generally needs written notice within seven days and delayed baggage within 21 days after receipt.

This guide addresses Tunisair claim time limit for Tunisair travel. The law and airline information were checked on 28 August 2026. Verify the route and operator for the travel date.
First test the direction of the flight
Tunisair is a Tunisian carrier. It is not an EU or UK airline. EC261 can cover its European departures. A direct Tunisia-to-Europe flight is normally outside EC261.
UK261 uses a similar direction test. A UK departure can be protected. A direct Tunisair return from Tunisia normally is not.
| Itinerary assessed for Tunisair claim time limit | Fixed compensation position | Why it matters here |
|---|---|---|
| Tunisair claim time limit: EU to Tunisia | Covered in principle | A protected EU airport is the origin. |
| Tunisair claim time limit: Tunisia to EU | Normally not covered | A non-EU carrier starts outside the EU. |
| Tunisair claim time limit: UK to Tunisia | UK261 can apply | The flight leaves the United Kingdom. |
| Tunisair claim time limit: Tunisia to UK | Normally outside UK261 | Tunisair is not a UK carrier. |
| Tunisair claim time limit: EU origin via Tunis | Full review needed | One booking and final destination matter. |
Nationality and payment currency do not alter the test. Examine each direction separately. A protected outbound does not protect the return automatically.
After scope, examine the event, arrival delay, distance and cause. A covered flight still needs all other conditions.
Use the deadline attached to each legal basis
Tunisair public conditions contain a 30-day flight-delay claim clause. Treat it as a contractual notice position and file promptly, but do not describe it as the universal court limitation for EC261. European limitation rules are supplied by the competent national legal system.
The Montreal Convention has a two-year period for an action concerning international carriage liability. That period is different from short written-notice requirements. A passenger can lose a baggage case long before two years by missing the seven- or 21-day notice step.
The future EU reform does not currently create a nine-month deadline. It was approved in July 2026 but is not applied on the date of this guide. Do not wait for future procedures when current national and contractual rules are already running.
Jurisdiction can change the answer. Departure state, destination, carrier domicile, booking arrangements and consumer forum rules may matter. Record the disruption date and obtain local advice before the shortest plausible period expires.
Worked example
A passenger delayed from France files with Tunisair after forty days. The airline points to its 30-day clause. The passenger should not assume the EC261 claim has vanished, but should identify the French or other competent limitation rule and explain the prompt evidence trail. A baggage claim would require its own much shorter notice analysis.
What can be requested in a covered Tunisair claim time limit case?
Fixed payment, ticket choices and care costs are separate. List each requested amount.
| Remedy linked to Tunisair claim time limit | Typical trigger | Evidence |
|---|---|---|
| Tunisair claim time limit: EC261 payment | Covered qualifying event | Route, arrival and cause. |
| Tunisair claim time limit: UK261 payment | Covered UK event | UK origin, band and cause. |
| Tunisair claim time limit: refund or rerouting | Cancellation or five-hour wait | Ticket, offer and choice. |
| Tunisair claim time limit: care | Qualifying wait | Itemised receipts. |
| Tunisair claim time limit: proven loss | Contract or Montreal basis | Causation and value proof. |
EC261 normally uses great-circle distance. A protected through booking uses its final destination. Timely rerouting can sometimes reduce a fixed payment.
Extraordinary events may remove only the fixed payment. They do not erase every duty. Tunisair must prove the event, causal link and reasonable measures.
Evidence checklist
For this Tunisair claim time limit request, preserve the following material:
- Travel and disruption date.
- Date each claim was first submitted.
- Tunisair acknowledgement and reference.
- Applicable conditions supplied with the ticket.
- Departure, destination and passenger residence.
- Baggage delivery or damage date where relevant.
- Calendar showing the shortest possible deadline.
How to submit and preserve the claim
Tunisair provides separate forms for flight, ticket, ground, onboard and baggage issues. Choose the form matching Tunisair claim time limit. The airline says each form is personal. Prepare one request per traveller.
State the date, airports, PNR, ticket number and operator. Give times with the time zone. List each remedy on a separate numbered line.
Attach readable copies, not original documents. Keep the ticket, passes, notices and receipts. Save the submitted text and confirmation page.
Tunisair says it aims to answer within two months. That is not a universal time limit. Ask a vague refusal for the precise cause and measures taken.
Escalation depends on the regime and departure state. An EU body may examine compliance. It may not recover money in every case. Tunisia also has a Ministry complaint portal. Court rules need a separate review.
Common mistakes to avoid
A Tunisair code does not prove who operated the flight. Check the operated-by line. Test the EU outbound and Tunisia return separately. Accept a voucher only by informed choice.
Keep baggage, refund, care and fixed payment amounts separate. Each has its own basis. Calculate the request rather than sending one unexplained total.
The EU reform approved in July 2026 is not yet applied on the checked date. Its future nine-month claim rule is not a current deadline. Nor is its 30-day reply rule. Existing law and national limitation rules still govern.

FAQ
Is the Tunisair deadline always 30 days?
No. The conditions state a flight-delay notice position, but EC261 court limitation is governed by the competent national law. File promptly and analyse both.
Does Montreal give two years for baggage notice?
No. The two-year action period does not replace seven-day damage notice or 21-day delayed-baggage notice.
Is nine months already the EU261 filing deadline?
No. The reform approved in July 2026 is not yet applied on 28 August 2026. Current rules remain in force.
Does Tunisair response time extend my deadline?
Do not assume so. An internal review can continue while a legal period runs, so keep an independent diary.
Which country time limit applies?
That requires jurisdiction analysis using the route, parties and competent forum. The ticket purchase location alone does not always decide it.
