Which rules can apply to delay over five hours

For delay over five hours, Pegasus Hava Tasimaciligi A.S. is a Turkish carrier, not an EU or UK carrier. That carrier status makes direction central to delay over five hours, ahead of website language, nationality or purchase currency.

For delay over five hours, EU261 uses EUR 250, EUR 400 and EUR 600 bands after coverage, timing and cause are established. Turkish rules for delay over five hours use EUR 100 domestically and EUR 250, EUR 400 or EUR 600 internationally, converted at the Central Bank selling rate on payment day.

For delay over five hours, the Turkish amendment published on 10 December 2024 added an express rule for final-arrival delays of at least three hours caused by technical or operational reasons. In a review of delay over five hours, it directs the carrier to perform the duties in Articles 8 and 9; it did not turn every late flight anywhere in the world into a valid claim.

Where both systems appear relevant to delay over five hours, record any payment already made and do not promise duplicate fixed awards for the same disruption.

Decide whether the journey still serves its purpose

Do not simply fail to board. Tell Pegasus in writing that the five-hour delay makes the journey pointless and that reimbursement is chosen under the applicable passenger-rights rule.

If part of the trip has already been used, a return to the first point of departure may be relevant when the remaining journey no longer serves the original plan.

Continuing to travel can preserve a later fixed-delay claim, but the ticket-price refund for abandoning the same transport is a different election. Record the choice clearly.

Worked example

A one-day business trip from an EU airport loses its purpose after a six-hour delay. The traveller documents the meeting time, declines travel in writing and asks for reimbursement instead of becoming a no-show.

For delay over five hours, substitute the passenger's real airports, operators, timings and offers.

Compensation, refund, rerouting and care are separate

For delay over five hours, fixed compensation addresses a qualifying disruption; it is not the ticket price. For delay over five hours, reimbursement replaces unused transport, rerouting provides substitute travel, and care covers proportionate waiting needs.

The EU reform adopted in July 2026 is not yet applied to delay over five hours. Its future nine-month submission and 30-day response rules for delay over five hours are not current on 29 August 2026.

Routes, bundles and forms can change. Verify the operator, current Pegasus terms and competent procedure again when submitting delay over five hours.

Mistakes that weaken the file

FAQ about delay over five hours

Can I just leave the airport after five hours?

Notify Pegasus and preserve proof of the delay and your reimbursement choice; silently leaving can create an avoidable no-show dispute.

Does choosing a refund always remove compensation?

No. The unused-ticket remedy and fixed compensation are legally distinct, although the facts must satisfy each set of conditions.

Does a Pegasus-operated return from Turkiye automatically fall under EU261 for delay over five hours?

No. For delay over five hours, a direct Pegasus return from Turkiye normally falls outside EU261 because Pegasus is not an EU carrier; Turkish rules may still apply.

Can expenses be claimed as well as a fixed award for delay over five hours?

Potentially yes. For delay over five hours, reasonable care or replacement costs have a different function from fixed compensation and must be proved separately.
