The essential answer: care and waiting costs

Meals, communications, accommodation and transfers serve a different purpose from fixed compensation. An extraordinary circumstance may defeat the EU261 lump sum yet does not automatically remove reasonable care during a prolonged wait. The traveller should ask MGA for assistance first and, if none is offered, keep purchases necessary and proportionate. An itemised invoice showing date, service, currency and amount explains the expenditure better than an unexplained card statement.

Practical example: care and waiting costs

No vouchers arrive during an overnight wait, so the passenger buys modest food and accommodation and keeps both the request for help and itemised receipts.

Care meets needs during the wait; it does not punish the airline

Meals, refreshments, communication, accommodation and transfers are intended to meet reasonable needs until onward travel. Their value does not come from the EUR 250–600 compensation table. The carrier can owe care even where an external cause defeats a fixed-compensation claim. Put waiting expenses in their own section of the letter to MGA. Every receipt should show the date, service, currency and connection with the period during which assistance was not provided.

Ask MGA for assistance first and record the response

Go to the service desk, use an official channel or capture the failed app screen. If MGA offers a voucher, note its value, conditions and whether a suitable outlet is open. No response is also evidence, but it should be documented reasonably. A self-funded purchase is easier to justify after a visible attempt to obtain care. Safety comes first in an urgent situation; the record can be completed immediately after secure accommodation or transport has been found.

A reasonable meal depends on the time and length of the wait

There is no universal lunch price for every airport. Consider the waiting period, time of day, passenger count and available outlets. Keep an itemised receipt rather than only a card-terminal slip. Alcohol, unrelated shopping and luxury additions are difficult to justify. If a family buys one shared meal, enter it once and state how many people ate. This demonstrates proportionality without artificially dividing one receipt into several individual claims.

An overnight wait can require a hotel

If the replacement flight leaves the next day, MGA should arrange suitable accommodation and travel between the airport and hotel. Where help does not materialise, choose a safe, reasonable option rather than the most expensive available standard. Record the missing voucher, booking time and distance. A family room is one expense. If the organiser supplies a hotel, establish whether it covers the disruption night or the ordinary holiday stay because those services have different purposes.

Include both journeys between the airport and accommodation

Transport is part of care when an overnight stay requires passengers to leave the airport. Keep a receipt showing the route or a ride-app record; for cash, request written confirmation. Do not seek the same taxi fare from MGA and the organiser. If the airline sends passengers to a distant alternative airport, distinguish the cancellation transfer from hotel transport. The expense table should show where each trip began, ended and why it was necessary.

Rerouting and buying a new ticket are separate decisions

Care during the wait does not grant an unrestricted right to purchase any replacement ticket. Ask for reasonable rerouting first and retain every offer. If the carrier provides no workable solution, a self-purchased alternative should be necessary and proportionate. Record its availability, price and timing. Choosing reimbursement for the unperformed ticket may end the duty to provide onward transport, but it does not erase reasonable costs already incurred while waiting.

Extraordinary weather does not remove basic needs

An airport closure, high winds or an ATC decision may defend MGA against the fixed payment where all conditions are met. Passengers still need information and appropriate care. Receipts can be claimed without first winning the dispute about cause. Describe the waiting period and missing assistance, then address fixed compensation under a separate heading. This prevents all expenditure being rejected with one sentence about the weather.

Match care duties to a flight involving Türkiye

For an MGA departure from the EU, consider Article 9 of EU261; for a UK departure, the corresponding UK261 provision; and for a journey involving Türkiye, the SHY-YOLCU care rules, including Article 10. The December 2024 Turkish amendment separately triggers immediate duties under Articles 8 and 9 for certain technical or operational delays. Do not mix three legal bases into one receipt. State the direction, use the principal regime and describe any overlap transparently without claiming the same meal several times.

A package hotel and an airport hotel serve different purposes

The resort accommodation is an organiser's package service, while an airport hotel during disruption can be carrier care. If a delay consumes the first night of the holiday, the organiser may face a package price-reduction issue and MGA may owe reasonable waiting support and air-passenger remedies. Record the two locations, dates and purposes. Do not present a lost resort room as a care receipt where the passenger never paid for it directly.

Prepare an expense schedule that can be audited

Use columns for date, person or group, service, reason, amount, currency, evidence and reimbursement status. Convert currency only as a secondary aid and preserve the original value. Attach proof that assistance was requested and MGA's reply. Remove any private purchases from a mixed receipt. This lets the airline accept individual items without resolving the compensation dispute and gives an authority or court a concise record alongside the disruption timeline.

Evidence needed for verification: care and waiting costs

  • For the right to care, retain the original ticket and earliest record of the event.
  • In the the right to care analysis, build a chronology from material created during travel.
  • When documenting the right to care, keep the carrier message that states its position.
  • Link every calculation for the right to care to the exhibit supporting that line item.
  • Before submitting the right to care, check that names and dates remain legible in every attachment.

FAQ — frequently asked questions

Does MGA still owe care during extraordinary circumstances?

Yes, an extraordinary event may affect fixed compensation but does not normally suspend the duty of care. The passenger should request assistance and retain reasonable receipts if MGA provides nothing suitable.

When can an MGA delay trigger meals and refreshments?

Care begins after the waiting threshold applicable to the flight's distance and expected delay, which can be earlier than three hours. The quantity offered must remain reasonable in relation to the wait.

What overnight assistance should MGA arrange?

When a necessary stay arises, care can include hotel accommodation and transport between the airport and lodging. Passengers should give MGA an opportunity to assist unless urgency or inaccessibility makes self-booking reasonable.

Can a passenger recover self-funded care expenses?

Reasonable and necessary spending may be claimed when MGA failed to provide required assistance. Itemised receipts, the waiting timeline and evidence that help was requested make reimbursement easier to assess.

Is care the same remedy as a ticket refund or rerouting?

No, care supports the passenger while waiting, whereas reimbursement and rerouting resolve the unused transport. Record the chosen travel option separately from meals, accommodation, communications and airport transfers.

Which law governs care on MGA flights?

EU261 can govern departures from protected European airports, UK261 can govern UK departures, and SHY-YOLCU commonly applies to MGA carriage involving Türkiye. Each direction needs its own coverage and threshold analysis.
