Mavi Gök Airlines charter and package holiday responsibilities
Published: Updated:

The essential answer: charter and package holiday
Mavi Gök is authorised for scheduled and non-scheduled operations, so describing every service as charter is inaccurate. Where the flight belongs to a package, the operating carrier answers the aviation remedies while the organiser answers for accommodation, transfers and the promised holiday programme. A retail agent may communicate with both but does not automatically replace either. One lost night can justify two carefully separated complaints, not duplicate recovery of the same expense.
Practical example: charter and package holiday
A late departure removes a hotel night: the airline receives the flight claim, while the organiser receives a separate account of lost package services.
Mavi Gök is not exclusively a charter airline
SHGM's official list grants Mavi Gök Havacılık A.Ş. authorisation TR 024 for scheduled and non-scheduled passenger and cargo carriage. MGA also offers charter and wet-lease services. The character of a particular flight must therefore come from its ticket and contract rather than a general perception of the brand. EU261, UK261 or SHY-YOLCU can protect a seat sold in a package or a separately purchased ticket when their scope conditions are met.
Four different roles can exist on one holiday flight
The operating carrier answers for air-passenger rights, while under Article 13 of Directive 2015/2302 the organiser is responsible for proper performance of all package services, including air transport. The agent has its own sales duties and the insurer answers under the policy. Bases against the carrier and organiser can operate in parallel without permitting overcompensation for the same loss. Record the full legal names and supporting documents rather than assigning everything to one logo.
A holiday voucher is not a substitute for the flight document
A package reference can connect the hotel, transfer and flight without showing the ticket number, operator or coupons. Ask for a record containing the operated-by field, date and route. If the agent changed the carrier, retain both versions. At the airport, photograph the boarding pass and change notice. Without these details, an EU261 claim may be sent to the organiser instead of the carrier, or an MGA return from Türkiye may be treated as European merely because the package was bought in Poland.
A lost resort night belongs in the package account
Where a late departure shortens the stay, address the value of an unused room, meal or transfer to the organiser under the package contract. Statutory flight compensation serves a different purpose and does not automatically equal the price of one night. The same chronology can accompany both letters, but the amounts and legal bases should remain separate. Allocate any price reduction to the service concerned rather than mechanically deducting it from per-passenger compensation where the remedies do not overlap.
A cancelled charter still requires a transport choice
As the relevant operating carrier, MGA must fulfil reimbursement or rerouting duties under the applicable regime. At the same time, the organiser should manage the package by notifying the hotel, transfer provider and customers and addressing services not performed. Record any conflicting instructions before acting on them. Check how a ticket refund would affect the entire package before accepting it. Buy a replacement flight only after documenting the absence of a suitable alternative and selecting a reasonable price.
Separate the messenger from the party making the change
The organiser is often the communication channel, but the carrier retains its own passenger-rights duties. Preserve when each entity sent its message and when it was received. In a cancellation case, notice timing can affect fixed compensation. If an agent says it had no information, ask for the transmission history. Do not direct the whole dispute to whichever app displayed the alert; establish who made the operational decision and who contracted to supply the package.
A wet lease complicates operator identity without removing rights
An MGA aircraft and crew may perform a service for another airline while operational responsibility remains with the customer. Case C-532/17 warns against equating the provider of aircraft with the operating carrier. The organiser remains a separate entity under the holiday contract. Compare the operated-by field, marketing number, airport information and business handling the disruption. Then send the passenger-rights claim to the correct company rather than assuming that the name on the fuselage also covers the hotel and programme.
Flight direction matters on a charter too
A charter departure from Poland to Türkiye can fall under EU261 regardless of MGA's Turkish licence. An MGA return from Türkiye does not gain EU261 simply because it forms part of a Polish package. SHY-YOLCU must be assessed for the Turkish route and UK261 for a UK departure. A package contract does not move the origin airport. Prepare a separate page for each direction showing origin, operator, event and legal basis; one package number does not make the law identical.
Run parallel complaints without duplicating the entire letter
Send MGA the flight and operator details, chronology, fixed-compensation request, ticket choice and care expenses. Send the organiser the package contract, missing services, effect on the stay and requested price reduction or remedy. In both documents disclose payments relating to the same item. MGA does not need the full holiday valuation where it has no bearing on the air claim, while the organiser should see evidence of the actual arrival time.
Three distinct remedies in one family example
A family reaches Antalya one day late. MGA provides an airport hotel, the organiser refunds the lost resort night, and the passengers assess fixed delay compensation. The airport hotel is care, the organiser's refund addresses the package, and the statutory amount depends on scope, timing and cause. None of these should automatically be multiplied or subtracted. A table showing the purpose of each payment reveals what remains outstanding and prevents the same cost being claimed twice.
Evidence needed for verification: charter and package holiday
- For a charter package, retain the original ticket and earliest record of the event.
- In the a charter package analysis, build a chronology from material created during travel.
- When documenting a charter package, keep the carrier message that states its position.
- Link every calculation for a charter package to the exhibit supporting that line item.
- Before submitting a charter package, check that names and dates remain legible in every attachment.

FAQ — frequently asked questions
Do charter passengers have flight rights against MGA?
Charter status does not by itself remove passenger protections under EU261, UK261 or SHY-YOLCU when their scope tests are met. The ticket may sit inside a package, but the flight still has an operator.
What does Package Travel Directive Article 13 require from the organiser?
The organiser is responsible for performance of the travel services included in the package, regardless of which supplier performs them. That responsibility can cover accommodation, transfers and the contracted flight arrangement.
Can a package traveller claim directly from MGA as well?
Yes, applicable passenger-rights rules can create a direct claim against the operating airline alongside package remedies. The traveller should distinguish the disrupted flight entitlement from failures in the wider holiday.
May the same hotel or transfer loss be recovered twice?
No, parallel legal routes do not permit overcompensation for one identical loss. Tell MGA and the organiser what has already been paid, while preserving genuinely different remedies such as a statutory lump sum.
When is a package price reduction different from flight compensation?
A price reduction addresses a lack of conformity in the package, while flight compensation addresses a qualifying transport disruption. One incident may support both analyses, but neither amount should be assumed automatically.
Which records help separate airline and organiser responsibilities?
Keep the package contract, flight confirmation, organiser correspondence, revised itinerary and receipts. Create a short chronology showing which party promised each service and which payment corresponds to each claimed consequence.
