Lufthansa UK261 versus EU261: which passenger-rights regime applies?
Short answer: use UK261 as the primary starting point for a Lufthansa journey departing the United Kingdom and EU261 for a journey departing the EU or EEA. Because Lufthansa is an EU carrier, arrivals into either territory can create overlap. You cannot receive two fixed payments for the same disruption, so choose one coherent basis, currency and escalation route.

UK261 is the retained and amended UK version of Regulation 261. It resembles EU261 but uses sterling and has its own authorities and case law after Brexit. Calling every Lufthansa claim "EC261" can produce the wrong amount even where entitlement is sound.

The table is a filing convention, not a statement that overlap never exists. EU to UK is inside EU261 because of departure and can also meet UK inbound wording. UK to EU is inside UK261 because of departure and can meet EU inbound wording when Lufthansa operates. Prior compensation or assistance under one regime must be disclosed and duplicate recovery avoided.
Compensation bands are not exchange rates
EU261
- EUR 250 for routes up to 1,500 km;
- EUR 400 for intra-EU routes over 1,500 km and other routes up to 3,500 km;
- EUR 600 for other routes over 3,500 km.
UK261
- GBP 220 below 1,500 km;
- GBP 350 from 1,500 to 3,500 km;
- GBP 520 above 3,500 km.
For long-haul delay, UK CAA guidance gives GBP 260 for arrival between three and four hours late and GBP 520 above four hours. EU law likewise permits EUR 300 instead of EUR 600 in that interval. Do not convert EUR 600 to pounds or GBP 520 to euros.
A London to Frankfurt delay normally sits under 1,500 km, so the UK amount is GBP 220. A London to Frankfurt to Buenos Aires journey on one booking may reach the top band because final destination and end-to-end distance control.
Final destination remains central
The Folkerts rule applies to protected connecting travel. If Manchester to Frankfurt arrives 55 minutes late, the passenger misses the onward Lufthansa service and reaches Johannesburg the next day, the delay is assessed at Johannesburg. UK departure provides the UK261 basis.
Separate tickets usually stop the measurement at Frankfurt. A self-transfer loss is not automatically Lufthansa's final-destination delay. Preserve the booking code, ticket numbers and through-baggage record.

Operator identity can switch coverage
Lufthansa's EU licence is why a Lufthansa-operated arrival from outside the EU can be covered. An LH marketing number does not transfer that licence to the airline flying the aircraft.
Example: New York to Frankfurt sold by Lufthansa but operated by United. United is not a Community carrier. EU261 generally does not cover that inbound flight under Article 3(1)(b), though US rights remain. New York to Frankfurt operated by Lufthansa has the opposite result.
For the UK inbound limb, the CAA states that flights arriving in the UK on a UK or EU airline can be covered. Lufthansa can meet that carrier test. Confirm every "operated by" line before selecting the regime.
Refund and care similarities
Both regimes require refund or rerouting after covered cancellation and care during qualifying waiting. Meals, communications, hotel and airport transport are not dependent on the extraordinary-circumstances defence.
The practical currency of expenses is usually the currency spent, supported by the card statement. Fixed compensation uses the statutory currency. Keep the categories separate instead of converting the whole claim into one rounded total.
Escalation after a Lufthansa refusal
Lufthansa publishes Schlichtung Reise & Verkehr for eligible private-travel disputes. The UK CAA lists Lufthansa under that German ADR provider rather than CEDR or AviationADR. A UK passenger should still preserve the CAA complaint route and UK court options where UK261 applies.
England and Wales commonly allow six years for this type of court claim, Scotland commonly five, and Germany commonly three years under BGB rules. Current rules versus future EU reform
The EU revised its passenger-rights legislation in July 2026, but the Council states that application follows publication and a future timetable. The nine-month request period and 30-day airline response are not current EU deadlines on 10 August 2026. They do not amend UK261.
A UK claim should not import the future EU process. An EU claim should not use the CAA's GBP table. Date every legal assessment so a later reader can see which rules governed the flight and filing.
How to frame the submission
State the primary rule in the first paragraph:
This Manchester-origin journey is claimed under UK261. The Lufthansa-operated through booking reached its final destination 7 hours late. I request GBP 520 per passenger, plus the itemised care expenses below.
For an EU departure, replace the basis and amount rather than adding a second alternative total. If overlap is genuinely relevant, disclose it and state that no duplicate fixed payment has been received.
