Lufthansa strike compensation: identify whose workforce stopped the flight
Short answer: a strike involving Lufthansa's own pilots, cabin crew or other employees is not automatically an extraordinary circumstance. EU case law treats internal labour action connected with employment relations as part of airline activity in many situations. A strike by airport security, air-traffic control or another independent organisation is more likely to be external, but Lufthansa must still prove causation and reasonable measures.

Branding can mislead. An LH flight number operated by Discover Airlines, Lufthansa City Airlines or a codeshare partner requires an operator-specific enquiry. The company employing the striking workers matters.
Internal Lufthansa strikes
In Airhelp v SAS, the Court of Justice held that a strike organised by a trade union representing the operating carrier's staff, linked to demands concerning working conditions, was not beyond the carrier's control for EU261 purposes. Earlier “wildcat strike” judgments also rejected a blanket extraordinary label where spontaneous absences followed restructuring announced by the airline.
This does not mean every labour dispute produces automatic payment. The passenger still needs a covered route, a qualifying delay, cancellation or denied boarding, and no separate disqualifying fact. Lufthansa may also show that a particular flight was lost because of an independent external restriction rather than its own workforce action.
Avoid arguing that Lufthansa should have accepted every union demand. Courts do not decide collective bargaining through a passenger claim. The practical questions are whether the event was inherent in managing staff and whether its consequences could reasonably have been limited.
Airport and air-traffic strikes
Security-screening stoppages, national air-traffic-control action and closures imposed by public authorities normally sit outside Lufthansa's organisation. They can support an extraordinary-circumstances defence when they directly affect the claimed flight.
The defence is not established by showing that a strike happened somewhere in Europe on the travel date. Lufthansa should connect the action to the route, slot or airport and explain why rerouting was not reasonably available.
Example: French ATC industrial action reduces sectors through French airspace. A Lufthansa Frankfurt–Madrid service is cancelled, but comparable routes operate around the restriction. The carrier should explain its allocation and rerouting choices rather than merely citing “ATC strike.”
Example: security staff at Frankfurt close passenger screening and the airport authority restricts departures. The event is external, yet Lufthansa must still offer refund or rerouting and provide care during the wait.
Notice and cancellation rights
A strike cancellation activates Article 8 choices regardless of the cause. The passenger may select:
- reimbursement for the unused journey and, where relevant, a return to the first point of departure;
- rerouting to the final destination at the earliest opportunity; or
- rerouting on a later date convenient to the passenger, subject to seats.
Fixed compensation is a separate question. For cancellation, the timing of notice and the replacement schedule matter. Notice at least 14 days before departure generally removes the cancellation payment, while later notice can still avoid it only within the statutory timing windows.

Reasonable measures during industrial action
Lufthansa need not undertake an impossible or disproportionate response, but it should examine realistic options. Depending on timing and route, these can include another Lufthansa service, a Group or Star Alliance flight, a different connection airport, rail within Germany or a later departure that reaches the destination sooner.
The passenger should preserve screenshots showing seats which were available when assistance was requested. Availability later in the claims process does not prove that the same inventory existed at the airport, so record dates and times.
Where Lufthansa offers rerouting several days later despite a plausible same-day alternative, ask it to book the earlier transport. If immediate assistance fails and independent purchase becomes necessary, obtain written refusal where possible and keep the new fare reasonable.
Compensation amounts
For qualifying EU261 cases, fixed amounts are EUR 250, EUR 400 or EUR 600 per passenger, with a possible 50% rerouting reduction in defined circumstances. UK261 uses GBP 220, GBP 350 and GBP 520, including the GBP 260 long-distance band for arrival between three and four hours late.
A family booking is assessed passenger by passenger, but the cause evidence will usually be shared. A public frequent-flyer award ticket remains eligible. Expenses are claimed separately and must not be added to fixed compensation as if they were one statutory sum.
Build a strike evidence file
Keep Lufthansa emails, app notifications, boarding documents and the full itinerary. Save the operating-carrier identity and the time notice reached the passenger. Record what staff said, while distinguishing it from official confirmation.
Useful independent evidence includes the union announcement, airport notice, ATC network statement and contemporaneous departure data. The claim should ask Lufthansa to identify:
- the organisation and workforce involved;
- the period of action relevant to the flight;
- the direct operational restriction;
- rerouting and staffing measures attempted;
- any delay attributed to a later, separate cause.
This structure prevents an internal Lufthansa dispute from being blurred with an airport or ATC stoppage.
Care does not depend on blame
Meals and refreshments must be appropriate to the waiting time. Overnight disruption can require hotel accommodation and transport between the airport and hotel. Two communications are also covered by the regulation.

Responding to a strike refusal
Do not send a generic statement that “strikes are compensable.” Quote the refusal and classify the workers. If they were Lufthansa employees, cite Airhelp v SAS and request the employment and causation facts. If they were external, focus on reasonable measures and the actual restriction.
Where Lufthansa supplies a complete external-event explanation, reassess the fixed claim while preserving refund, rerouting and expense rights. A credible claim should change when the evidence changes.
