Quick answer: can you claim for LOT overbooking?

You may be able to claim LOT overbooking compensation if you had a confirmed booking, followed the check-in and boarding requirements, and LOT still refused boarding because the flight was full or because of another airline-controlled seat shortage. EU 261 treats involuntary denied boarding as one of the clearest compensation situations.

The reason for refusal matters. A passenger denied boarding because of missing passport, visa or entry documents is in a different position from a passenger who was ready to board but lost the seat to overbooking. Ask LOT staff to write the reason before you leave the gate.

LOT boarding situationClaim strengthWhat it means
Valid booking, checked in on time, refused boarding because the flight was fullUsually strongThis is the classic involuntary denied boarding scenario under EU 261.
You accepted LOT volunteer benefits and agreed not to travelDepends on the agreementVolunteers can negotiate benefits and still have refund or rerouting rights, but fixed compensation is different.
You arrived late at check-in or the gateUsually weakEU 261 denied boarding protection assumes you presented yourself as required.

Gate evidence is powerful

Overbooking disputes are often decided by simple facts: boarding pass, gate time, staff explanation, replacement flight and whether you volunteered or were refused involuntarily.

Voluntary vs involuntary denied boarding

When a flight is overbooked, LOT can ask for volunteers to give up seats in exchange for benefits. That can be a reasonable deal if you are flexible, but it is not the same as being involuntarily denied boarding. A volunteer agreement can define what you receive, so read it before accepting vouchers, miles or a later flight.

Involuntary denied boarding is stronger. That means you did not agree to give up your seat, you met the boarding requirements, and LOT still refused to carry you. In that situation, fixed compensation is usually due unless the refusal was justified by reasons such as health, safety, security or inadequate travel documents.

If staff say "the flight is full" or "we need volunteers", take screenshots, keep the boarding pass and ask whether you are being denied boarding voluntarily or involuntarily. The wording matters.

How much is LOT denied boarding compensation?

The compensation amount depends mainly on distance. It does not depend on the ticket price or whether you were travelling economy, premium economy or business class. Each passenger who was involuntarily denied boarding can have a separate claim.

Flight distanceEU 261 amountTypical LOT examples
Up to 1,500 kmEUR 250Warsaw - Berlin, Warsaw - Vienna, Krakow - Frankfurt
1,500-3,500 kmEUR 400Warsaw - Madrid, Warsaw - Athens, Warsaw - Lisbon
Over 3,500 kmEUR 600Warsaw - Chicago, Warsaw - New York, Warsaw - Toronto, Warsaw - Seoul
Fast rerouting with limited arrival delayPossible reductionIn some rerouting outcomes, compensation can be reduced by 50%.

Long-haul LOT overbooking cases can be especially valuable. Routes such as Warsaw to Chicago, New York, Newark, Toronto, Delhi or Seoul normally sit above 3,500 km, so eligible denied boarding claims can reach EUR 600 per passenger.

Refund, rerouting and care after LOT refuses boarding

Fixed compensation is not the only right. If LOT refuses boarding involuntarily, you should also receive the choice between reimbursement, rerouting at the earliest opportunity, or rerouting at a later date under comparable conditions. While you wait, care rights can include meals, refreshments, communication, hotel and transport where needed.

RightWhat it coversLOT overbooking note
Fixed compensationEUR 250, EUR 400 or EUR 600 when involuntary denied boarding qualifiesShould be paid in money unless you sign agreement to another form.
Refund or reroutingChoice between ticket reimbursement, earliest rerouting or later reroutingThis is separate from the fixed compensation amount.
Airport careMeals, refreshments, communication, hotel and transport where neededCare rights can apply while you wait for the replacement flight.
Volunteer benefitsNegotiated vouchers, cash, upgrades or other benefits for passengers who give up seats voluntarilyRead the terms before accepting; voluntary agreements change the legal position.

Do not let the airport rush make the choice for you. If the next LOT option arrives too late for the purpose of the trip, ask about refund and return options. If you accept rerouting, keep the replacement arrival time because the airline may later argue for a reduction.

LOT routes where overbooking claims can be high value

Overbooking can happen on short European flights, holiday peaks, business-heavy routes and long-haul services through Warsaw. The same legal structure applies, but the amount changes with distance.

  • Warsaw - London or London - Warsaw: usually short-haul band, with EU 261 or UK 261 depending on direction.
  • Warsaw - Madrid, Lisbon or Athens: often the EUR 400 distance band.
  • Warsaw - Chicago, New York, Toronto, Delhi or Seoul: often the EUR 600 distance band.
  • Connections through Warsaw on one ticket: check the segment where boarding was refused and the final rerouting offered.

When LOT can refuse denied boarding compensation

Not every refusal at the gate is overbooking. EU 261 does not usually protect a passenger who arrives too late, lacks required documents, fails security requirements or cannot be carried for a valid safety reason. The dispute is often about what really happened at the gate.

If LOT later says the refusal was caused by documents, compare that with what staff said at the airport. If your documents were accepted during check-in and the real reason was lack of seats, preserve every piece of evidence. The wording in a boarding denial notice can make or break the case.

Ask for written confirmation

Before leaving the gate, ask for a written denied boarding notice showing the flight number, date, passenger name and reason. If staff refuse, write down their names, time, gate number and exact explanation.

Evidence to keep after LOT overbooking

Denied boarding claims are evidence-sensitive because the passenger and airline may later describe the same gate event differently. Save proof before the boarding screen changes and before app notifications disappear.

EvidenceWhy it helps
Boarding pass or mobile boarding passShows you had checked in and were ready to travel.
Booking confirmation and e-ticketProves route, PNR, passenger name and original itinerary.
Written denied boarding noticeAsk LOT staff for written confirmation that boarding was refused and why.
Gate photos, screenshots and time notesUseful when staff refuse to write the reason.
Replacement flight detailsShows how late you arrived and whether a reduction may be argued.
Receipts for meals, hotel and transportCare expenses can be recovered separately from fixed compensation.
  1. Keep the boarding pass. It proves you checked in and had a seat process underway.
  2. Ask why you were refused. The answer should distinguish overbooking from documents or late arrival.
  3. Save the replacement itinerary. It shows rerouting and care needs.
  4. Take screenshots. Gate screens, app messages and seat notifications may vanish quickly.
  5. Keep receipts. Food, hotel and transport can be separate from fixed compensation.

How to claim LOT overbooking compensation

A good denied boarding claim should be short and factual. State that you had a confirmed booking, complied with check-in and boarding deadlines, were involuntarily refused boarding, and request compensation under EU 261 Article 4 and Article 7.

  1. Confirm the operating carrier. On codeshares, the claim normally goes to the airline that operated the flight.
  2. Explain the gate event. Include gate number, time, staff explanation and whether volunteers were requested.
  3. State the amount. Use EUR 250, EUR 400 or EUR 600 based on distance.
  4. Claim separate care expenses. Attach receipts for meals, hotel, transport and communication.
  5. Challenge document-based refusals if inaccurate. Ask LOT to show why boarding was refused if you believe the real cause was overbooking.

FAQ: LOT overbooking compensation

1. Can I claim compensation if LOT overbooked my flight?

Yes, if you had a valid booking, presented yourself for check-in and boarding as required, and LOT involuntarily refused boarding because there was no seat or another airline-controlled reason. The fixed EU 261 amount is usually EUR 250, EUR 400 or EUR 600.

2. Is denied boarding the same as a flight delay?

No. Denied boarding has its own EU 261 rule. You do not need to prove a 3-hour delay first, although the timing of the replacement flight can affect possible reductions and practical losses.

3. What if LOT asks for volunteers?

LOT can ask passengers to give up seats voluntarily in exchange for benefits. If you volunteer, read the agreement carefully because the negotiated benefit is treated differently from involuntary denied boarding compensation.

4. How much is LOT overbooking compensation?

The fixed EU 261 bands are EUR 250 for short routes, EUR 400 for medium routes and EUR 600 for long-haul routes over 3,500 km. Many intercontinental LOT routes to or from Warsaw sit in the EUR 600 band.

5. Can LOT refuse compensation because I had document problems?

Yes, if the refusal was genuinely caused by missing passport, visa or entry documents, it is usually not an overbooking claim. Keep proof if the real reason was seat shortage rather than documents.

6. Do I get refund or rerouting as well as compensation?

In involuntary denied boarding cases, refund or rerouting rights are separate from fixed compensation. You may also have care rights while waiting for the replacement flight.

7. Who pays on a LOT codeshare overbooking?

EU 261 claims usually go against the operating carrier, not automatically the airline whose code appears on the ticket. Check who physically operated the flight where boarding was refused.
