LATAM Pass award tickets and flight compensation
A publicly available LATAM Pass award ticket can retain EU261 or UK261 protection. The fact that the fare was paid with miles does not reduce a qualifying EUR 250-600 or GBP 220-520 fixed amount. After disruption, separate statutory compensation from redeposit of unused miles, refund of taxes and fees, restoration of an upgrade, and reimbursement of paid seats or baggage. Each line has a different legal or programme basis.

The starting point is still route and operator. A LATAM Pass redemption from Madrid on a LATAM-operated flight can be covered by EU261. The LATAM-operated return beginning in Sao Paulo normally is not, even though the same miles paid for both directions.

Do not allow one credit entry to settle every category without explanation. LATAM Wallet, a LATAM Pass mileage credit and a bank refund are different records.
Award tickets are not automatically excluded
EU261 and UK261 exclude passengers travelling free or at a reduced fare not available directly or indirectly to the public. A standard loyalty-program redemption offered to members is generally treated differently from confidential staff or industry travel. Public availability, rather than use of cash, is the practical distinction.
Preserve the redemption receipt showing:
- passenger and ticket number;
- miles debited;
- taxes and charges paid in money;
- booking class and cabin;
- original sectors and operators;
- programme account statement;
- upgrade or ancillary transactions.
If LATAM rejects compensation only because “the ticket was purchased with miles,” ask it to identify the exclusion relied upon and explain why the award was not publicly available.
Coverage remains direction-specific
LATAM Pass does not turn LATAM into a European carrier. Apply the same territorial screen as a cash ticket:
- Madrid-Lima operated by LATAM: EU261 can apply;
- Heathrow-Sao Paulo operated by LATAM: UK261 can apply;
- Lima-Madrid operated by LATAM: normally outside EU261;
- Sao Paulo-Heathrow operated by LATAM: normally outside UK261;
- Lima-Madrid operated by Iberia: EU261 can apply through Iberia's status.

Fixed compensation on a miles ticket
Once coverage and event conditions pass, the statutory amount is based on distance and timing, not how many miles were redeemed. A long-haul EU-origin delay can produce EUR 600 per eligible passenger. A UK-origin long haul can produce GBP 520, with the same possible reduction windows as cash tickets.
Example: two passengers redeem LATAM Pass miles for Madrid-GRU-Santiago on one public award. An ordinary operational disruption causes arrival in Santiago 6 hours late. Subject to the evidence, each can seek EUR 600, total EUR 1,200. The mileage debit does not become the compensation formula.
A child on a qualifying award has an individual ticket and can have an individual entitlement. A lap infant travelling entirely free needs review of ticket and public-fare status.

Mileage redeposit after cancellation
LATAM's current Help Center says award tickets can be changed or refunded subject to redemption conditions and directs members to the Contact Center or case creation. It distinguishes unused, valid tickets and the status of redeemed miles.
An airline-caused cancellation should be described separately from a voluntary member cancellation. Preserve the cancellation notice before requesting redeposit. Ask for:
- all unused miles restored;
- original expiry treatment explained;
- unused taxes and charges returned to the correct payment method;
- any award issuance or change fee reviewed under the disruption rule;
- written confirmation that the ticket is closed or reissued.
Do not accept an unexplained partial mileage credit. Compare the account balance before and after, including each passenger's redemption.
Voluntary changes follow programme conditions
If the passenger simply changes plans, LATAM Pass redemption conditions can impose fees, validity limits and fare availability. Those commercial rules are not the same as airline cancellation rights. A refundable award does not promise a seat on every future date; a non-refundable condition does not automatically remove statutory options when LATAM cancels a covered flight.
Label the event accurately in the Help Center. Submitting an airline-caused cancellation as a voluntary refund can trigger the wrong conditions and obscure compensation.
LATAM Wallet and miles are different ledgers
LATAM describes LATAM Wallet as a place where some refunds and commercial compensation can be credited. A wallet balance is monetary travel value under its own terms. LATAM Pass is the loyalty-mile account.
Ask three questions when value appears:
- Was this entry a cash refund, wallet credit or mileage redeposit?
- Which ticket, passenger and service does it correspond to?
- Did the passenger consent to non-cash settlement of any statutory compensation?
A wallet refund may solve unused fare while EUR 600 remains under review. A mileage redeposit can restore the award without paying hotel receipts. Keep screenshots and transaction IDs.
Upgrade paid with miles or another instrument
An upgrade can be obtained through miles, a bid, a voucher, cash or an elite benefit. If LATAM reroutes the passenger in a lower cabin, identify what was promised and delivered on each segment.
Possible claims differ:
- restore miles or instrument for an upgrade not provided;
- refund cash paid for the failed upgrade;
- apply statutory downgrade reimbursement where the passenger was placed in a lower class on a covered flight;
- reimburse ancillary services not transferred;
- claim fixed delay or cancellation compensation if its separate requirements pass.
Do not assume one universal formula for a mixed miles-and-cash upgrade. Preserve the upgrade confirmation, cabin, booking class and segment price. Statutory downgrade percentages apply to the affected flight's price basis, not automatically the full round trip.
Paid seats and baggage after rerouting
LATAM's current seat-and-baggage refund guidance recognises refunds in specified situations when operational changes prevent equivalent service. After rerouting, compare seat type, baggage allowance and purchased extras.
If the replacement flight provides the same service, no duplicate refund is due. If an extra-legroom seat becomes an ordinary seat or prepaid baggage is not honoured, request that ancillary's price separately. Attach the receipt and new boarding pass.
Ancillary refund does not replace compensation for a qualifying long delay. Conversely, receiving EUR 600 does not automatically return every service fee.
Operating airline on partner awards
LATAM Pass can book partner-operated flights. The programme that issued the award is not automatically the operating carrier for EU261 or UK261.
Example: LATAM Pass issues Lima-Madrid operated by Iberia. Iberia is the operational respondent for a qualifying disruption and its EU status may cover the inbound flight. LATAM Pass handles mileage servicing. Send each request to the party responsible for that value line.
If the award combines LATAM and partner sectors, build a table of marketing code, operator, ticket coupon and disruption. The operating-carrier guide prevents the loyalty programme from being mistaken for the airline that flew.
Evidence and claim wording
Save the award receipt, programme statement, e-ticket, boarding passes, upgrade record, paid-ancillary receipts, cancellation or delay message and replacement itinerary. Take account screenshots before and after any automatic redeposit.
A clear request can say:
“LATAM cancelled the covered Madrid-Sao Paulo award flight seven days before departure. Passenger A travelled on a publicly available LATAM Pass redemption. We request assessment of EUR 600 under EU261 separately from restoration of 62,000 unused miles, refund of EUR 91.40 in taxes and return of the 18,000-mile upgrade.”
Adjust amounts to the actual account. Do not estimate mileage balances.
Escalation
External EU261 or UK261 escalation concerns statutory rights and the operating carrier. A loyalty-account dispute may follow LATAM Pass programme channels and applicable consumer law. Keep the two files linked but distinct.

Can a LATAM Pass award receive EUR 600?
Yes when it was publicly available and the EU261 coverage, event, delay and causation tests pass. Miles used do not set the amount.
Are miles automatically restored after LATAM cancels?
Check the account and request written confirmation. Preserve the airline cancellation notice so the case is not processed as a voluntary member change.
Is LATAM Wallet the same as LATAM Pass?
