KM Malta Airlines claim deadline: when must you act?

Short answer: current EU261 does not set one Europe-wide court deadline for KM Malta Airlines compensation. The competent national law supplies the limitation period. Malta's published EU complaint form says to complain to the operating airline first and approach the relevant enforcement body if no reply arrives within six weeks or the answer is unsatisfactory, but that is a procedural instruction rather than a universal court limitation. Baggage notices use separate seven- and 21-day limits, and Montreal damages actions generally have a two-year period.

A PIR made at the airport does not replace the later written baggage claim. Equally, the Montreal two-year rule does not govern the standard EUR 250-600 payment under EU261.

Why EU261 has no single current number

In Cuadrench More v KLM, the Court of Justice confirmed that Regulation 261/2004 does not prescribe the period for bringing court actions under Articles 5 and 7. Each member state's procedural law supplies the limitation, subject to EU principles of equivalence and effectiveness.

The relevant country is not always simply the airline's home or the passenger's residence. Jurisdiction can be connected with departure, arrival, contract performance, consumer rules and the chosen defendant. A connected itinerary or OTA can add complexity.

Avoid statements such as "every KM claim lasts two years" or "Malta always controls". The KM compensation overview first determines the airline and regime; legal advice may be needed when a deadline is close.

MCCAA's six-week instruction

MCCAA is Malta's national enforcement body for EU261 incidents taking place in Malta. Its published EU complaint form instructs a passenger to complain to the operating airline first. If the airline fails to reply within six weeks, or the passenger is dissatisfied, the form may be sent to the proper national body.

That six-week period is not permission to wait indefinitely and is not a judgment deadline. Keep the original KM submission confirmation. If a meaningful refusal arrives earlier, the passenger can prepare the competent escalation without pretending that the six weeks create or remove substantive entitlement.

For an event at an airport in another member state, that state's enforcement body is usually the starting regulator. The body responsible for enforcement may not be the court with jurisdiction over private payment.

The future nine-month EU rule

EU lawmakers gave final clearance in July 2026 to revised passenger-rights legislation. The adopted framework provides that a passenger must submit a compensation request within nine months of the actual departure date shown on the ticket and that the carrier will have 30 days to pay or justify refusal.

Those provisions were not yet applicable on 13 August 2026. The Council stated that the updated rules would enter into force 12 months and 20 days after publication in the Official Journal. Entry into force and application must be verified from the final published act before using any calendar date.

Do not apply nine months retrospectively to close an older claim, and do not rely on it to delay a current submission. The safest course is to notify KM now and preserve whatever national court period already governs.

Baggage deadlines are shorter

KM's baggage guidance asks passengers to report a missing or damaged checked bag immediately at the airport and obtain a Property Irregularity Report. The written claim then follows.

  • damage: written complaint no later than seven days after receiving the baggage;
  • delay: written complaint no later than 21 days after the bag is placed at the passenger's disposal;
  • loss: KM describes baggage as lost after 21 days for its handling process;
  • court action for Montreal damages: generally within two years under Article 35.

The two-year period is calculated under the Convention by reference to arrival, the date the aircraft ought to have arrived or the date carriage stopped, with the forum's law governing calculation. Do not wait for tracing to end before preserving the written notice.

Use the delayed and lost baggage guide or damaged baggage guide for evidence.

Contract and fare periods are another category

KM's conditions generally provide one-year ticket validity from first travel or, if unused, issue date, subject to fare terms and stated exceptions. Voluntary refunds can be reduced by service or cancellation charges and may be unavailable for a non-refundable fare. This does not shorten an EU261 statutory fixed-compensation claim to one year.

KM Rewards has its own account rules. The programme permits retroactive credit claims only within defined periods and may expire inactive SkyBux after 24 months. Loyalty deadlines should not be substituted for statutory passenger-rights periods.

Build a deadline record

Record these dates in one file:

  1. scheduled and actual travel date;
  2. date and time of disruption notice;
  3. date baggage was delivered, if relevant;
  4. date KM received the claim;
  5. date and content of KM's answer;
  6. six-week MCCAA procedural point;
  7. earliest plausible court or Convention deadline;
  8. any fare, ticket, insurance or package deadline.

Preserve acknowledgements rather than relying on a sent-email folder. If KM's portal fails, take screenshots and use another official contact route promptly.

FAQ

Is the KM Malta Airlines EU261 deadline always two years?

No. The Montreal two-year rule does not set the period for standard EU261 compensation. National limitation law governs current Article 5 and 7 court actions.

Must I wait six weeks before contacting MCCAA?

MCCAA's form directs passengers to complain to the airline first and refers to no reply within six weeks or an unsatisfactory answer. Preserve urgent court deadlines regardless.

Is the new nine-month claim period already active?

No, it was not applicable on 13 August 2026. Verify the final act's publication and application before calculating it.

Does a PIR meet the baggage deadline?

It records the airport report but should not be treated as a substitute for the required written claim within seven or 21 days.

Can a ticket's one-year validity limit compensation?

Not by itself. Ticket validity and voluntary fare refunds are contractual issues distinct from the national limitation period for EU261 compensation.
