Kenya Airways UK departures: when UK261 compensation applies

A Kenya Airways-operated flight leaving Heathrow or Gatwick can fall under UK261 and may produce GBP 220, GBP 350 or GBP 520 after a qualifying delay, cancellation or involuntary denied boarding. The reverse Kenya Airways journey from Nairobi to London is normally outside UK261 because KQ is not a UK or EU carrier. Direction and actual operator must be checked before any amount is promised.

The airport is not interchangeable. Preserve whether the original booking used LHR or LGW, particularly if rerouting moved the passenger across London and created transfer expense.

Delay amounts on long-distance travel

UK261 normally requires arrival at the final destination at least three hours late for a delay payment. For an over-3,500-km journey:

  • arrival between three and four hours late generally pays GBP 260;
  • arrival more than four hours late generally pays GBP 520;
  • arrival under three hours normally pays no fixed delay amount.

Door opening, not touchdown, is the usual arrival moment. If the booking continues to Entebbe, Kigali, Mombasa or another destination, measure there when the sectors form one reservation.

The airline can avoid fixed compensation by proving extraordinary circumstances and reasonable measures. It cannot remove care merely by establishing an external cause.

Cancellation rights

A protected passenger chooses between reimbursement and alternative transport. Kenya Airways should discuss the earliest suitable route, including another airline where it would arrive materially sooner, or later-date travel at the passenger's convenience subject to availability.

Fixed compensation usually disappears when notice was given at least 14 days in advance. With shorter notice, compare replacement departure and arrival. A long-distance cancellation amount can be GBP 520 or GBP 260 depending on the rerouting window.

Keep the first notification. Kenya Airways or an agent should be able to prove when information reached the passenger, not merely when an internal reservation note was created.

Heathrow and Gatwick disruption evidence

Kenya Airways currently lists both airports for London service. For a route-specific case, retain:

  • the airport code on the original and replacement ticket;
  • terminal and gate information;
  • time the cancellation or delay was announced;
  • every KQ, BA or other rerouting option proposed;
  • rail, coach or taxi receipts if an airport move was required;
  • final arrival evidence at Nairobi or the onward destination;
  • proof of operator, especially on a codeshare.

An alternative departing from the other London airport is not automatically comparable. Ask who will pay reasonable surface transport and whether the transfer time is realistic for luggage, mobility and travel documents.

Care and abandonment after five hours

For long-distance UK departures, care normally begins after four hours of departure delay. It includes reasonable refreshments and communication, then hotel accommodation and transport when an overnight stay is necessary.

After at least five hours, a passenger can decide not to travel and request reimbursement. Where travel has begun but no longer serves the original purpose, a return to the first departure may also be relevant. Record the decision with Kenya Airways before leaving the airport so it is not processed as an unexplained no-show.

If KQ does not provide care, buy modest necessities and keep itemised receipts. A bank statement alone may not show what was purchased.

Why Nairobi to London usually fails the UK test

UK passenger protection covers departures from UK airports regardless of airline. For arrivals from abroad, the operating carrier generally needs to be a UK or EU airline. Kenya Airways does not meet that status.

A British resident, GBP ticket, London destination or KQ codeshare with British Airways does not change the operator rule. If BA actually operates the Nairobi-London flight, coverage may change. Look at the original “operated by” line rather than assuming from the flight number.

An ineligible KQ arrival can still carry contractual rerouting or refund rights, Montreal Convention damages for proven delay loss and baggage remedies. Saying UK261 does not apply is not the same as saying the passenger has no rights.

Claiming and escalating

Kenya Airways' dedicated disruption claim portal expressly includes UK261. State the UK airport of initial departure, the complete final destination, actual operator, event timing and requested GBP amount. Separate hotel or replacement-transport receipts from the fixed claim.

If Kenya Airways rejects the case, require a final written response identifying the cause and coverage reasoning. The UK CAA provides current guidance on complaints and possible escalation routes. Whether an approved alternative dispute resolution body or the CAA's Passenger Advice and Complaints Team can handle the case depends on the airline and current arrangements, so check the live CAA route rather than naming a forum from memory.

The Kenya Airways Conditions of Carriage currently state a substantive complaint response within 21-30 working days. Preserve the case reference and the exact date of response.

Is Heathrow to Nairobi covered by UK261?

Yes, a qualifying flight departing Heathrow is within UK261 even when Kenya Airways operates it.

Is Nairobi to Gatwick covered by UK261?

Normally not when Kenya Airways is the operator, because it is neither a UK nor an EU airline.

How much is a three-and-a-half-hour long-haul delay?

For an eligible UK261 journey over 3,500 km, the usual reduced amount is GBP 260 per passenger.

Must Kenya Airways provide a hotel after bad weather?

On a protected journey, care can remain due even when extraordinary weather removes fixed compensation.
