Kenya Airways strike compensation
A Kenya Airways crew or airline-staff strike does not automatically remove EU261 or UK261 compensation. On a KQ-operated flight departing the EU or the United Kingdom, an internal labour dispute can still lead to EUR 250-600 or GBP 220-520 if the delay or cancellation rules are met. A strike by independent air traffic controllers, airport security or another outside body is more likely to be extraordinary, but care and rerouting can remain due.

Do not rely on the booking brand alone. A KL-coded service operated by KQ is normally assessed against KQ's event. A KQ-coded feeder operated by Air France may create a claim against Air France for that operated flight.
Internal strike does not mean automatic payment
European case law treats many strikes by an airline's own employees as inherent in normal carrier activity and within its control for extraordinary-circumstances analysis. That defeats a blanket "strike" defence, but the passenger must still satisfy route scope, arrival delay or cancellation notice, and the other eligibility conditions.
For a cancellation, ask when Kenya Airways notified the passenger and what replacement was offered. Notice at least 14 days before departure generally removes fixed cancellation compensation. Shorter notice can also avoid payment when a qualifying reroute stays within the regulation's timing windows.
For a delay, record door-opening time at the final destination. A labour dispute that causes two hours at departure but only two hours 45 minutes at final arrival does not reach the ordinary three-hour threshold.
External industrial action
An air traffic control strike, border-control stoppage, airport-wide security action or closure imposed by public authorities may be outside Kenya Airways' control. KQ should still identify the event, affected period and causal link. A national strike announced for one day does not explain a cancellation several days later without further evidence.
Reasonable measures remain important. Kenya Airways should consider rerouting, schedule recovery, available partner services and care. It is not required to make an unlimited sacrifice, but it cannot rely on the word "strike" without explaining what could and could not be done.
If an external action affected an inbound aircraft, request the complete rotation. Crew displacement or an aircraft being out of position can be a real consequence, yet KQ must connect it to the claimed flight and show how it tried to recover.
Route direction changes the remedy
Paris-Nairobi and Amsterdam-Nairobi operated by Kenya Airways leave the EU and can qualify under EU261. Heathrow-Nairobi and Gatwick-Nairobi can qualify under UK261. These are long-distance routes, so an eligible cancellation or final delay usually points to the highest band, subject to rerouting reductions.
Nairobi-Paris, Nairobi-Amsterdam and Nairobi-London operated by KQ normally sit outside those fixed regimes. A strike does not reverse territorial scope. Passengers can still invoke Kenya Airways' Conditions of Carriage for rerouting or involuntary refund and may claim provable delay damage under the Montreal Convention where its requirements are met.

Care, rerouting and refunds
On a protected EU or UK journey, reasonable meals, communication and overnight accommodation do not depend on whether the strike is internal or extraordinary. Keep receipts when KQ does not arrange assistance.
After a cancellation, the passenger generally chooses reimbursement or rerouting under the applicable regime. Ask for the earliest reasonable connection, not merely the next KQ-operated seat. A suitable partner option can matter when the airline proposes an avoidable multi-day wait.
Kenya Airways' own Conditions provide remedies when it cancels, materially fails to operate according to schedule or causes a protected missed connection. For qualifying online direct bookings, KQ also publishes a separate refund process when a passenger abandons travel after a delay exceeding eight hours. That company process is distinct from the EU or UK five-hour delay right and from fixed compensation.
Evidence to collect during a strike
Save the complete ticket, operating-carrier line, boarding pass, cancellation message, final arrival and every rerouting offer. Screenshot KQ's notice and any airport or authority statement naming the striking body. Record the date on which the industrial action and the individual cancellation were announced.
Ask Kenya Airways to state:
- who employed the striking workers;
- which operational function was unavailable;
- when the action began and ended;
- how it affected the aircraft and crew assigned to the service;
- what replacement routes were considered;
- why the final delay could not be reduced.
Avoid asserting that every airline strike is compensable. The employment relationship, event, route, notice and actual timings all need evidence.
How to present the claim
Open with the flight date, route, operator and final arrival. State whether EU261 or UK261 applies and the amount claimed. Then explain why the action appears internal or why KQ's external-strike explanation is incomplete.

Keep the submission confirmation. KQ's current Conditions describe a substantive complaint response within 21-30 working days. That company timescale does not replace the applicable legal limitation period.
Worked strike scenarios
Kenya Airways cabin crew take industrial action and KQ cancels Amsterdam-Nairobi the day before departure. The airline offers a flight two days later. If no qualifying extraordinary defence or cancellation-timing exception applies, each eligible passenger can pursue EUR 600, while reasonable hotel and meal expenses are separate.
In a second case, UK air traffic controllers impose a binding capacity restriction and the Heathrow departure reaches Nairobi six hours late. KQ demonstrates the slot, causal timing and lack of an earlier viable reroute. GBP 520 fixed compensation may be excluded, but care duties during the wait remain.
A Nairobi-Paris cancellation caused by KQ staff action does not normally produce EUR 600 when KQ operates the flight. The passenger should seek rerouting or refund and document actual financial loss under the relevant contractual and international rules.
