Kenya Airways rejected your compensation claim: how to answer

Do not repeat the same Kenya Airways claim after a rejection. Identify whether the dispute concerns route coverage, operator, final timing, notice, cause, amount or missing evidence, then answer that specific point. Some refusals are correct, especially for a standalone Kenya Airways flight from Nairobi to Europe. Others overlook a protected EU or UK departure or use a vague extraordinary-circumstances label without proof.

Copy the airline's wording into a response table and attach one piece of evidence to each contested point. Do not dispute facts that are correct.

Correct and incorrect direction refusals

Protected European departure

If the reservation began in Paris or Amsterdam and Kenya Airways operated the outbound flight, EU261 can apply regardless of KQ's Kenyan status. Respond with Article 3, the initial departure and complete ticket.

If a Heathrow or Gatwick journey was rejected because Kenya Airways is foreign, point to UK departure coverage. UK261 protects departures regardless of the carrier's nationality.

Nairobi-origin return

A refusal of EU261 for Kenya Airways-operated Nairobi-Paris is normally correct. The same is true of UK261 for KQ's Nairobi-London operation. Change the demand to applicable KQ contract, Kenyan consumer, Montreal or destination-country rights instead of arguing that the European arrival alone is sufficient.

Partner-operated arrival

Nairobi-Amsterdam operated by KLM may fall within EU261 because KLM is an EU carrier. A KQ code does not remove KL's operator status. Send the claim to the partner if KQ was only the marketer or ticket issuer.

Final destination errors

A common connected-ticket problem is measuring only arrival at Nairobi. If Amsterdam-Nairobi-Entebbe was issued as one reservation and the protected outbound disruption produced a six-hour final delay, provide the full e-ticket and actual arrival at Entebbe.

If the onward sector was independently purchased, do not claim it formed the final destination of the first contract. Explain any proven consequential loss under the appropriate basis instead.

For a three-hour boundary, request the door-opening time. Flight-tracking services may show touchdown or gate arrival rather than the legal arrival moment. Convert both scheduled and actual time into one zone.

Answering an extraordinary-circumstances defence

The airline should establish more than a category. Ask:

  1. What event occurred?
  2. Where and when did it occur?
  3. Which aircraft or rotation did it affect?
  4. How did it cause the claimed delay or cancellation?
  5. What reasonable operational and rerouting measures were attempted?

Severe unsafe weather, air traffic restrictions, airport closure and security events may qualify. Ordinary technical defects or airline staffing generally require a stronger explanation. A knock-on effect from an earlier flight needs evidence linking the external event to the later disruption.

Even a valid defence does not remove refund, rerouting and care on a protected itinerary. State those remedies separately rather than treating the refusal of fixed compensation as a decision on every cost.

Cancellation notice disputes

Kenya Airways should prove when the passenger was informed. An internal schedule update is not necessarily notice. Preserve email headers, SMS timestamps, application history and agent correspondence.

For notice seven to 14 days before departure, compare whether rerouting left no more than two hours early and arrived less than four hours late. For less than seven days, the narrow exception uses one hour early and less than two hours late. If KQ cites only the date of notice, request its replacement-timing calculation.

Refund is not the same payment

A ticket refund returns unused travel value. EU261 or UK261 fixed compensation addresses the qualifying disruption. Meals, hotel, transfers, replacement travel, baggage and Montreal damages are further categories.

If the rejection says “compensation already paid”, request the transaction description and legal basis. A travel voucher accepted for the fare does not automatically settle a cash fixed-payment claim. EU261 fixed compensation can be paid as a voucher only with signed passenger agreement.

Build a focused reconsideration

Use this structure:

  • case reference and passenger names;
  • one sentence identifying the exact refusal point;
  • the corrected fact or legal rule;
  • a short calculation;
  • numbered evidence;
  • requested revised decision and payment;
  • deadline for a final written response.

Kenya Airways' Conditions currently state a substantive complaint response within 21-30 working days. Preserve the original claim, acknowledgement, refusal and reconsideration as separate files.

Escalate to the forum matching the route

For EU-origin cases, use the national enforcement body connected to the event and assess court forum under national law. For UK departures, check current CAA guidance on complaint and dispute routes. For Kenya-origin consumer matters, the KCAA, Competition Authority or aviation Tribunal may have a role depending on the decision and remedy. US-route refunds and oversales can be complained about to DOT.

Attach the airline's final response. A regulator cannot easily review a refusal it has not seen. Observe the relevant limitation or appeal period; the future EU nine-month notification provision is not yet active on 15 August 2026.

FAQ

Should I challenge a rejection for Nairobi to Paris EU261?

Usually not if Kenya Airways operated the standalone Nairobi departure. Consider a different legal basis instead.

What if KQ measured delay only at Nairobi?

Provide the single reservation and final arrival when a protected booking continued beyond Nairobi.

Is “technical reasons” a complete defence?

No. Ask for the defect, causal link and measures; routine technical problems are not automatically extraordinary.

Does a ticket refund settle compensation?

Not necessarily. The fare and fixed statutory payment are distinct remedies with different purposes.

When should I escalate?

After obtaining or reasonably requesting a final written decision, use the authority and deadline applicable to the route and issue.
