JetBlue passenger rights: EU261, UK261 and US DOT compared
JetBlue passengers must select the framework created by the route and event rather than mixing the most attractive parts of EU261, UK261 and US law. EU departures can pay fixed euro amounts, UK departures can pay fixed pound amounts, and US rules focus mainly on refunds, oversales, tarmac delay and disclosure. No passenger chooses a system by residence, passport or payment currency. A US citizen can claim EU261 from Paris; an EU citizen on JetBlue from New York cannot create EU261 through nationality.
EU261: strongest on departures from the EU
JetBlue is covered on flights leaving airports such as Paris, Amsterdam and Dublin because Article 3 applies to departures regardless of airline nationality. A journey on one ticket can extend to a final destination beyond the first US airport.
Delay compensation uses final arrival of at least three hours. Cancellation compensation examines 14-day notice, replacement timing and cause. Denied boarding and downgrade have separate tests. The fixed bands depend on distance, with many JetBlue transatlantic departures in the EUR 600 category.
The carrier can rely on extraordinary circumstances only with proof of causation and reasonable measures. Care generally remains due even when that defence succeeds.
UK261: a parallel but separate regime
JetBlue's UK departures receive comparable protection with GBP 220, GBP 350 and GBP 520 bands. London-US routes are normally long distance. A qualifying replacement arriving within the reduction window can halve GBP 520.
Do not cite EU institutions as the direct complaint forum for a London departure. UK enforcement, dispute routes and courts are separate. The underlying factual file remains similar: complete booking, operator, timing, notice, cause and receipts.
A US-to-London JetBlue flight normally falls outside UK261 because JetBlue is not a UK carrier. The US-to-Europe guide identifies what remains available.
US DOT: refund and oversales protections
The United States does not provide a general EU-style fixed cash payment after every long delay or cancellation. Its most valuable federal protections include:
- automatic refund after cancellation or significant change when alternatives are declined;
- denied-boarding compensation after involuntary bumping from an oversold flight;
- tarmac-delay safeguards;
- baggage liability and fee refunds in qualifying cases;
- disclosure and complaint-response obligations.
For international schedule changes, a movement of six hours is one refund trigger; domestic itineraries use three hours. A cancellation itself does not need that timing threshold. Card refunds are due within seven business days and other methods within twenty calendar days.
US involuntary denied-boarding payments use 200% or 400% of the one-way fare subject to current USD 1,075 and USD 2,150 caps. Voluntary offers are negotiated and can differ.
JetBlue's contractual layer
JetBlue publishes controllable-delay, cancellation and ground-delay benefits. Current departure-delay bands begin at three hours. Beginning in early 2026, JetBlue says qualifying Customer Bill of Rights awards are issued as TrueBlue points and require an attached account before departure.
This plan is neither EU261 nor a DOT cash-compensation statute. Weather or air traffic restrictions may be outside controllability. JetBlue also records meal, hotel and ground-transport commitments for qualifying controllable disruptions.
Passengers beginning in the EU or UK should review JetBlue's statement that applicable statutory claims can be made in lieu of its plan. An offer's settlement wording decides whether accepting it affects another demand.
Montreal Convention is another category
International delay and baggage claims can invoke the Montreal Convention for proven damages. The passenger must show actual loss, causation and reasonable mitigation. The Convention's Special Drawing Rights limits are ceilings, not automatic awards.
That means a missed prepaid event or necessary accommodation may be assessed differently from inconvenience compensation. A passenger can potentially have an EU261 fixed sum and a distinct Montreal loss, but double recovery for the same damage is not permitted.
One event, different outcomes
Paris-New York delayed four hours: EU261 may pay EUR 600 per eligible passenger, plus reasonable care expenses. JetBlue policy may be presented as an alternative under its terms.
London-Boston cancelled the night before: UK261 refund or rerouting and care apply; GBP 520 depends on notice, replacement and cause.
New York-Paris cancelled: DOT refund if alternatives are declined; no automatic EUR 600. JetBlue's controllable-cancellation terms may add a benefit.
New York-Los Angeles oversold: DOT denied-boarding formula applies if involuntary. EU and UK distance tables do not.
Dublin-New York-Las Vegas missed connection: one-booking EU departure can use final Las Vegas arrival under C-561/20.
Prevent double counting
Prepare a ledger with separate rows for unused fare, statutory fixed compensation, contractual benefit, care expenses, replacement transport, baggage and proven Montreal loss. Mark any amount already paid and any release accepted.
Send the request to the party responsible for each item. The operating carrier usually handles EU261 and UK261 fixed compensation; the ticket seller may process refund; the carrier that accepted baggage handles the baggage file. Codeshare and agency labels should not obscure those roles.
