Finnair USA flight compensation: EU261 and US refund rights

A Finnair-operated flight between the United States and Europe can qualify for EU261 in both directions, while US Department of Transportation rules separately protect refunds for cancelled or significantly changed travel to or from the United States when the passenger does not accept the alternative. US law does not generally pay a fixed sum for ordinary delay or cancellation comparable to EUR 600.

Why US-to-Europe can fall under EU261

Finnair is an EU airline. Regulation 261/2004 can cover its own flight arriving in the EU from a third country, subject to the rule concerning benefits already obtained under departure-country law. A Finnair-operated US-Helsinki sector therefore has a different EU analysis from an inbound service operated by a US airline.

The operated-by line is decisive. If a US partner operates an AY codeshare, Finnair's marketing code does not make that partner an EU carrier. Preserve the original booking and any operator change.

Travel beginning in the EU is covered regardless of airline nationality. A Helsinki-US departure operated by Finnair clearly enters the EU261 territorial gate.

EUR 600 for US journeys

Europe-US distances normally exceed 3,500 km. On a qualifying delay, final arrival four hours or more after schedule usually supports EUR 600 per passenger. Arrival from three to under four hours can permit a reduction to EUR 300.

One-ticket connections use the last destination. If Berlin-Helsinki-US city is sold together and the traveller arrives at that US city six hours late, calculate final arrival there. If the US flight lands in time but a separately purchased domestic connection is missed, EU261 does not automatically extend to the separate ticket.

For cancellation, notice and replacement-flight windows determine the fixed sum. Refund or rerouting remains a separate choice.

DOT refund rights

US DOT rules cover flights to, from or within the United States. When the airline cancels a flight or makes a qualifying significant change and the passenger does not accept rebooking or another alternative, a prompt refund to the original form of payment is generally due.

The refund is not conditioned on airline fault. It returns unused ticket value and qualifying unused ancillary fees. If the passenger affirmatively accepts a replacement and travels, the automatic-refund premise can disappear.

DOT announced enforcement discretion in July 2026 for a narrow situation involving flight-number changes where passengers are successfully rebooked and the flight operates without a significant change or delay. Do not treat every renumbered service as an automatic cash event without checking the current notice.

Finnair's ticket issuer or agent may process the money, especially for agency sales. Keep the cancellation notice, offered alternative, rejection of that alternative and card statement.

US denied-boarding rules

DOT oversales protections apply to involuntary bumping from an oversold flight departing the United States, subject to eligibility exceptions and arrival delay. Payment is based on the one-way fare and delay, with periodically adjusted caps. The airline must seek volunteers before involuntarily denying boarding.

Do not volunteer until the offered compensation, confirmed replacement, hotel, meals and consequences are written. A voluntary agreement usually replaces mandatory denied-boarding compensation.

EU261 can also be relevant on a Finnair-operated US-EU flight because Finnair is an EU carrier. The passenger cannot collect overlapping denied-boarding awards twice for the same refusal; compare which framework applies and how duplication is handled.

Care in the United States

EU261 right to care can apply to a covered Finnair-operated inbound service. It includes reasonable meals, communication and hotel with airport transport where an overnight wait becomes necessary. Extraordinary weather may remove fixed EUR compensation but not those duties.

US law does not create the same broad statutory meal-and-hotel rule for ordinary controllable delay. DOT's Airline Customer Service Dashboard and carrier commitments can be useful, but the Finnair passenger should state the EU261 basis where it applies.

If practical assistance is unavailable, spend modestly and save itemised receipts. Separate those costs from destination losses such as a missed cruise or hotel night, which require Montreal, insurance or contract analysis.

Cancellation versus significant change

EU261 treats a flight brought forward by more than one hour as a cancellation under Court of Justice case law. Finnair also advertises disruption refund options for certain schedule changes. DOT defines significant changes for refund purposes, including substantial time shifts and changes to origin or destination, subject to current rules and enforcement notices.

Tell both systems the same facts: original schedule, new schedule, whether the passenger accepted it and whether travel occurred. Do not describe a voluntary fare change as an airline cancellation.

Montreal Convention for proven losses

Article 19 can allow recovery of provable damage caused by international delay unless the carrier proves all reasonable measures or impossibility. A replacement hotel, transport or other direct loss may qualify; speculative profits, distress and unsupported estimates are much harder.

Mitigate loss and retain invoices. The court-action period is two years. Montreal is not a substitute fixed payment when EU261 does not apply.

Claim allocation

Use Finnair's feedback and compensation route for EU261 fixed amounts and care costs. Use Manage Booking or the refund form for ticket money. A DOT complaint can address US consumer-rule noncompliance after the airline has had the facts. Baggage follows its own written deadlines.
