Finnair UK261 and EU261 compensation: which regime applies?
Finnair journeys involving the United Kingdom can fall under UK261, EU261 or potentially both territorial frameworks, but the passenger cannot collect two fixed awards for the same inconvenience. A UK departure is protected by UK261; a Finnair-operated arrival from the UK into the EU can also enter EU261 because Finnair is an EU carrier. Operator, direction, final destination and prior payment determine the practical claim.

UK261 coverage basics
UK passenger-rights legislation covers flights departing from a UK airport. It also covers flights arriving in the UK when operated by a UK or EU carrier, subject to its detailed territorial and prior-benefit rules. Finnair is an EU carrier, so its own Helsinki-UK operation can fall within UK261.
A non-EU partner operating an AY codeshare into the UK may not receive the same inbound protection. Check "operated by" on the booking and replacement itinerary. Norra is an EU carrier, but remains a separate operator.
The UK CAA states that delayed passengers can receive care and may claim fixed compensation after arriving more than three hours late, while a delay over five hours gives a choice not to travel and obtain a refund.
EU261 on the same Finnair journey
An EU departure, such as Helsinki-London, is covered by EU261. A UK-Helsinki flight operated by Finnair can also satisfy EU261's inbound-EU-carrier rule. After Brexit, the two systems remain separate statutes with overlapping reach on some routes.
Overlap does not mean double recovery. Both systems contain mechanisms intended to avoid equivalent compensation being paid twice for the same event. A claimant can compare jurisdiction, amount and procedure, but should not submit contradictory facts or conceal payment.
On one connected booking, identify the final destination and all operators. A London-Helsinki-Tokyo journey can use Tokyo for a UK261 final-arrival analysis. The EU261 connected-flight position can require more detailed territorial assessment, especially where partner operators are involved.
Compensation amounts and long-haul reduction

For long-distance delay, both frameworks can reduce the full amount by 50% in the applicable three-to-four-hour arrival window. Under UK261 that generally means GBP 260 rather than GBP 520; under EU261 it means EUR 300 rather than EUR 600.
Currency conversion does not create a right to select whichever exchange rate produces more. The legally applicable framework, competent forum and previous benefits matter.
Cancellation and notice
Both systems retain the familiar 14-day cancellation structure. With notice between 7 and 14 days, a close alternative can remove fixed compensation where departure is no more than two hours early and arrival less than four hours late. With less than seven days, the limits are one hour early and less than two hours late.
Refund or rerouting remains due even when notice was early enough to remove the fixed payment. Extraordinary circumstances can excuse fixed compensation but not care and transport choices.
Preserve the first message that reached the passenger, not only the date Finnair says it notified a travel agent.
Causes under UK and EU law
Both regimes recognise extraordinary circumstances. Severe weather, air traffic management restrictions, security events and some external industrial action can qualify. Routine technical problems are generally not extraordinary under established case law.
UK courts have their own post-Brexit interpretative framework, while retained case law remains relevant subject to domestic rules. Avoid assuming every later Court of Justice judgment automatically binds a UK claim. The factual request to Finnair is still the same: identify the event, causation and reasonable measures.
Care should be provided regardless of fault on a protected disruption. Save receipts for proportionate meals, accommodation and transport if Finnair offers none.
Complaints and enforcement route
Submit the first claim to Finnair with route, operator, final arrival and requested statutory amount. Finnair's current form asks for EU261 claims within two months; for a UK261 matter, file promptly and check the applicable UK limitation separately.
The UK CAA directs unresolved complaints to an approved alternative dispute resolution provider if the airline participates, or to the CAA's Passenger Advice and Complaints Team where it does not. Check the current CAA airline list because participation can change.
Finnish bodies are not automatically correct for a disruption at a UK airport. Match the complaint body to the legal regime and event location.
One-ticket examples
London-Helsinki: a direct Finnair-operated flight arrives 3 hours 30 minutes late after an ordinary operational fault. UK261 clearly covers the departure; EU261 overlap may need to be managed, but only one fixed inconvenience award is recoverable.
Helsinki-Manchester: the EU departure is covered by EU261 and the Finnair-operated arrival can be within UK261. Use one claim basis and preserve the same arrival facts.
London-Helsinki-Seoul: one reservation reaches Seoul five hours late after a missed connection. UK261 can assess final arrival in Seoul. Separate tickets would normally split that protection.
Evidence checklist
Keep the e-ticket, operator disclosure, all boarding passes, cancellation notice, original and replacement schedules and door-opening record. State whether every sector was one booking and whether any compensation has already been received.
For expenses, list actual currency and retain card evidence. Do not convert all receipts into EUR or GBP without showing the original amount and conversion source.
