Finnair denied boarding and overbooking compensation

A passenger involuntarily denied boarding by Finnair despite a confirmed reservation, timely presentation and valid travel documents can normally claim EUR 250-600 immediately, plus choose refund or rerouting and receive care. Do not volunteer until Finnair has written the offered benefit and confirmed replacement travel. Voluntary surrender generally replaces the mandatory denied-boarding payment.

Ask Finnair to state the refusal reason in writing before leaving the gate. "Operational" is too broad to show whether EU261 denied boarding applies.

Voluntary versus involuntary boarding refusal

When Finnair reasonably expects to deny boarding, it should first seek volunteers willing to surrender reservations for agreed benefits. The negotiation can include money or credit, meals, hotel, confirmed transport and other terms.

A volunteer should insist on a written amount, payment form, expiry, replacement flight status, cabin, baggage arrangements and what happens if the replacement is disrupted. An invitation to discuss volunteers is not itself a refusal.

If insufficient volunteers come forward and Finnair selects the passenger against their will, the mandatory EU261 package applies. Do not sign language saying the surrender was voluntary merely to obtain a boarding pass unless that accurately reflects the choice.

Denied boarding is not limited to oversales

In C-22/11, which involved Finnair, the Court of Justice interpreted denied boarding beyond overbooking. Finnair rearranged passengers after a strike-related cancellation and refused boarding to a passenger on a later flight so that other passengers could travel. The Court held that operational reasons can fall within denied boarding.

The extraordinary-circumstances exemption for cancellation does not allow an airline to avoid Article 4 compensation for a later boarding refusal by reorganising flights. This protects the passenger chosen to bear the operational consequence.

Reasonable grounds still exist. Health, safety, security or inadequate travel documents can justify refusal. The airline should identify the actual ground and apply it proportionately.

The fixed amount is per eligible passenger and should be paid immediately under Article 4's denied-boarding structure. If rerouting reaches the final destination within two, three or four hours respectively for the distance categories, Finnair can reduce the fixed sum by 50%.

The reduction uses actual final arrival, not the promised schedule. Keep the replacement boarding pass and door-opening evidence. A family selected together can have one fixed claim for each eligible traveller.

Refund or rerouting remains the passenger's choice

Finnair must offer the Article 8 options. The passenger can obtain reimbursement of unused ticket parts, choose rerouting at the earliest opportunity under comparable conditions, or travel later at their convenience subject to seat availability.

If part of the journey has already been made and the trip no longer serves its purpose, return to the first departure point can also be relevant. State the chosen remedy at the gate and in writing.

Accepting ticket reimbursement should not be automatic when the passenger still needs to reach the destination. Conversely, accepting rerouting does not waive the mandatory denied-boarding amount.

Care after the refusal

Meals and refreshments should be proportionate to the waiting time. An overnight reroute requires hotel accommodation and airport-hotel transport. Two communications are also included in the care framework.

These duties do not depend on why Finnair overbooked or reorganised the flight. If the airline provides no practical assistance, spend reasonably and keep itemised receipts.

Shared hotel or taxi costs are claimed once. Fixed compensation is multiplied by eligible passenger count; actual expenses are not.

Common non-qualifying refusals

Finnair can reasonably refuse boarding where the passenger arrives after check-in or gate deadlines, lacks required documents, creates a safety or security risk, or cannot meet health-related conditions lawfully imposed for travel. A downgrade with carriage still provided is not denied boarding; it has a separate percentage-refund rule.

A disputed document decision requires immediate evidence. Ask Finnair which document or destination rule was missing, photograph the documents and obtain official entry guidance. A later visa refusal can be difficult to reverse without proof from the gate.

Standby travel and free tickets unavailable to the public may fall outside EU261. A publicly available award booking with confirmed space can be protected.

Codeshare and connecting travel

Address the claim to the operating carrier that refused boarding. An AY code operated by a partner does not automatically assign liability to Finnair. If Norra operated the regional flight, retain that disclosure.

On a one-ticket itinerary, rerouting should reach the final destination, not merely Helsinki. Compensation distance also follows the protected journey. If boarding refusal on Helsinki-Tokyo sends the passenger to Tokyo nine hours late, use the full one-ticket endpoints.

Gate evidence and claim wording

Keep the booking, check-in confirmation, gate arrival proof, valid documents, original boarding pass if issued, written refusal and volunteer announcement. Record names or roles of staff, the number of volunteers sought and what alternative was provided. Do not photograph other passengers' personal documents.

A useful request says:

I was involuntarily denied boarding on [flight/date] despite a confirmed reservation, timely presentation and valid documents. Finnair stated [reason]. I did not volunteer. I request Article 7 compensation of [amount], Article 8 [rerouting/refund] and reimbursement of the attached Article 9 care costs.

FAQ

Is overbooking required for EU261 denied boarding?

No. C-22/11 confirms that qualifying operational refusals can also fall within the rule.

Should I accept a volunteer voucher at the gate?

Only after comparing its written value, conditions and confirmed rerouting with mandatory rights if selection becomes involuntary.

Can Finnair reduce the fixed amount after quick rerouting?

Yes. A 50% reduction can apply when final arrival falls within the two-, three- or four-hour distance window.

Does a missing visa qualify for compensation?

Usually not where Finnair reasonably refuses boarding because required documents are inadequate.

Can I receive both rerouting and compensation?

Yes. Transport choice, care and the fixed denied-boarding amount are distinct rights.
