Flights between Europe and India: delays, connections and local rights
Published: Updated:
Rights on a journey between Europe and India depend on where the affected journey began, which airline actually operated it and whether the sectors formed one booking. EU261, UK261 and Indian passenger-rights rules are separate tests. The outbound and return can therefore produce different answers.

Check which rules cover your flight
Enter the complete route, date, operating airline and disruption. We will check whether EU261, UK261, Turkish SHY or another passenger-rights framework may be relevant.
What happened to your flight?
Choose the situation that applies. Eligibility and currency depend on the route, operating airline, disruption and applicable law.
Choose the situation that applies to your flight:
Start with the flight compensation calculator, then confirm the operator in the airline A-Z directory. The UK261 and EU261 comparison explains why a European destination alone is not always enough.
The route direction comes first
Apply the territorial rule to the disrupted journey, not to the passenger's passport, home address or booking currency.
| Journey | Main European test |
|---|---|
| EU, EEA or Swiss airport to India | EU261 can apply regardless of the operating airline's nationality. |
| United Kingdom to India | UK261 can apply regardless of the operating airline's nationality. |
| India to the EU on a qualifying EU or EEA operating carrier | EU261 may apply because of the carrier. |
| India to the United Kingdom on a qualifying UK or Community operating carrier | Test UK261 under the UK territorial matrix. |
| India to Europe on an Indian or other third-country operator | Arrival in Europe alone does not normally create EU261 or UK261 coverage. |
For example, a Delhi-bound flight departing Paris can be within EU261 even if Air India or another non-EU airline operates it. The return operated by the same airline does not inherit EU261 merely because it lands in Paris. Likewise, a London departure can be within UK261, while an India-origin return requires the carrier limb of the UK test to be satisfied.
A return ticket is not one permanent legal category. Record the origin, destination and operator for each direction. If an airline changes after booking because of a wet lease or operational substitution, preserve the notice showing who actually performed the flight.
One booking and self-transfer are different journeys
Europe-India itineraries regularly connect at Delhi, Mumbai, Bengaluru, Dubai, Doha, Abu Dhabi, Istanbul or another hub. A single reservation may protect carriage to the final ticketed destination even when the disruption occurs on a later sector. Keep the complete itinerary, ticket numbers, connection coupons and any reissued documents.
When the flights are on separate tickets, the legal position can change sharply. A traveller who buys London-Dubai and Dubai-Kochi independently may have two contracts and bear the missed-connection risk between them. A booking website's self-transfer guarantee is a contractual promise; it does not automatically join the flights for EU261, UK261 or Indian aviation rules.
Do not decide the issue from the fact that both flights appear in one confirmation email. Check whether there is one ticket or several, whether baggage was checked through, whether check-in was required again and whether the first carrier undertook to deliver the passenger to the final destination. The long-haul connections guide sets out the practical evidence for that analysis.
Indian DGCA passenger-rights rules
India's Directorate General of Civil Aviation publishes a Civil Aviation Requirement addressing denied boarding, cancellation and flight delay. Its scope includes relevant scheduled and non-scheduled operators and foreign carriers operating to or from India. This is a distinct local framework, not an Indian copy of EU261.
The available remedy depends on the event, notice, waiting time, cause, passenger choices and other conditions in the current rule. Assistance, an alternative flight, a refund and compensation are not interchangeable. A passenger who still needs to travel should understand the effect of accepting a refund before ending the carriage contract.
Do not convert a European award into rupees or state that every three-hour delay produces a fixed payment. Use the version of the DGCA requirement in force on the flight date and match its provisions to the actual event. The operating airline should receive the complaint first. The official AirSewa and DGCA routes may assist with escalation, but they do not turn a claim outside EU261 or UK261 into a European case.
Delay, cancellation and denied boarding require separate tests
For a qualifying EU261 or UK261 journey, calculate arrival at the protected final destination and examine the airline's explanation. Long distance does not by itself guarantee a maximum award. Extraordinary-circumstances analysis, reasonable measures and any applicable reduction remain relevant.
Cancellation creates several possible rights: reimbursement, rerouting, care and, where the conditions are met, fixed compensation. They should be recorded separately. A refund of the unused ticket is not the same as compensation for disruption, and reimbursement of meals is not the same as either of them.
For denied boarding, keep proof of a confirmed reservation, timely check-in, presence at the gate and valid documents. Ask whether volunteers were sought and save the written reason. Visa or document refusal, operational offloading and commercial overbooking are not automatically the same event.
Indian local rights should be assessed alongside, not merged into, any applicable European regime. Avoid duplicate recovery for the same expense while preserving legally distinct heads of claim.
A connection through Turkey does not automatically apply SHY
Istanbul is a common connection point, but airport transit alone does not make every Europe-India itinerary a Turkish passenger-rights case. SHY-YOLCU has its own territorial, carrier and event rules. Identify the sector, departure point and operating carrier before relying on it.
An itinerary can require more than one analysis: EU261 or UK261 for the protected European journey, SHY for a qualifying Turkey-related operation, and Indian rules for a flight within their scope. Do not combine the most favourable parts into a single invented global scheme. Use the current Turkish text and official complaint route for any SHY issue.
Codeshares, wet leases and domestic Indian feeders
The airline whose code appears on the ticket may not be the airline that operated the aircraft. Identify the operator from the boarding pass, airport information, disruption notice and any wording such as “operated by”. This is especially important on codeshares and wet-leased services.
A domestic feeder from Jaipur, Goa or another Indian city may be part of one through journey or a separate local booking. If it is on the same ticket as a protected international journey, retain the whole booking and measure what happened at the ticketed final destination. If it is a self-transfer, do not assume that a previous European flight extends EU261 to the domestic ticket.
Package holidays add another contract but do not replace the operating-airline test. The organiser may owe separate package remedies, while the carrier remains relevant for air-passenger rights. Direct the correct request to the correct party.
Montreal Convention claims are based on proven damage
The Montreal Convention may apply to international carriage and can govern damage caused by passenger delay or baggage events. It is not a worldwide fixed-compensation table.
The current 6,303 SDR limit for passenger delay is a liability ceiling, not an automatic award. A traveller must show recoverable loss, causation and reasonable mitigation, subject to the Convention's conditions and defences. The baggage liability limit is separately 1,519 SDR. Do not present either figure as a guaranteed payment or convert it to a permanent pound, euro or rupee value.
Keep invoices for replacement transport, accommodation, meals and other claimed loss. Record refunds, insurance payments and vouchers so the same loss is not recovered twice. Convention time limits and jurisdiction questions also require their own assessment; they should not be used to shorten a separate EU261 or UK261 claim without legal analysis.
Evidence and complaint sequence
Save the original itinerary, e-ticket receipt, every boarding pass, baggage tags, the airline's operating-carrier wording and all schedule-change messages. Record scheduled and actual times with local dates and time zones. Ask the airline to confirm the disruption reason in writing.
Create separate entries for fixed compensation, unused fare, rerouting, care expenses, baggage and other proven loss. State the legal basis and respondent for each entry. Contact the operating airline first for air-passenger rights, while sending package or agent issues to the seller responsible for that contract.
For a European case, use the competent enforcement or dispute route for the relevant country and airline. For an Indian-only issue, follow the current official DGCA and AirSewa process. ClaimWinger can assess whether a European or qualifying Turkey-related route falls within its service; local remedies outside that service should be pursued through the official channel.
Check the whole itinerary before claiming
Check your journey with the origin, final destination, every operating carrier and whether all sectors share one ticket. The result should identify a legal route, not promise that every Europe-India disruption receives the same payment.
FAQ: Europe and India flight rights
Does EU261 cover an Air India flight from Paris to Delhi?
It can. A journey departing an EU airport is within the departure limb of EU261 regardless of the operating carrier's nationality, subject to the remaining conditions.
Does EU261 cover the Air India return from Delhi to Paris?
Not merely because it lands in Paris. For an India-origin flight, EU261 normally requires a qualifying EU or EEA operating carrier. Check who actually operated the flight.
Can UK261 apply to a London-Delhi flight operated by an Indian airline?
Yes, the UK departure can bring the journey within UK261. The India-origin return requires a separate carrier and territorial test.
Is a missed domestic Indian connection covered by European rules?
It may matter when it is part of one protected through booking. A separately bought domestic flight does not become covered simply because an earlier journey began in Europe.
Does India pay EU-style compensation after every three-hour delay?
No. The DGCA framework has its own event categories, conditions and remedies. Apply the current official requirement rather than importing the European timing and amount rules.
