EL AL compensation: Europe-to-Israel and return flights compared

EL AL is an Israeli airline, not an EU or UK carrier. An EL AL-operated flight departing the EU or EEA can fall under EU261 and may qualify for EUR 250, EUR 400 or EUR 600. A separate EL AL flight from Israel to the EU is normally outside EU261 because the non-EU carrier departs a third country. Israeli Aviation Services Law may provide different rights on flights to or from Israel. UK departures are protected under UK261; a UK arrival requires its own territorial check.

Why the direction changes the claim

EU261 protects departures from EU and EEA airports regardless of carrier nationality. An EL AL flight leaving Paris, Amsterdam or another covered airport can therefore qualify. Its Israeli establishment does not defeat departure coverage.

The return is different. EL AL is not an EU carrier, so a standalone Tel Aviv-to-EU flight does not receive EU261 protection solely because it lands in Europe. Quoting the outbound rule for both sectors produces an avoidable rejection.

Israel's Aviation Services Law covers defined flights to and from Israel and provides its own assistance, replacement-ticket, refund and compensation structure. Amounts, delay definitions and exceptions should be assessed under the version in force for the event rather than converted into EU261 language.

EU261 amounts on a covered departure

The European bands are EUR 250 for journeys up to 1,500 kilometres, EUR 400 for other journeys between 1,500 and 3,500 kilometres and longer intra-EU routes, and EUR 600 for other journeys over 3,500 kilometres. Many Europe-Israel routes require actual distance calculation rather than a guess based on map appearance.

Delay compensation generally requires at least three hours at the final destination. Measure when a door opens. A diversion and ground transfer may push the final arrival beyond the threshold even if touchdown occurred earlier.

Ticket price and cabin do not set the fixed sum. Each eligible passenger has an individual claim. Refund of a paid seat or baggage fee is a separate service issue.

Cancellation during security disruption

After an EU-covered cancellation, the passenger chooses reimbursement or rerouting. That choice survives even when a security event removes fixed compensation. Care while waiting can also remain due.

The practical rerouting question can be difficult during a broad airspace or security closure. The standard is not an impossible flight; it is reasonable performance under the conditions. Preserve what routes were operating, what EL AL offered and why any self-booked alternative was necessary.

For fixed compensation, EL AL must identify the event and causal connection. A formal airspace closure or concrete security instruction can be extraordinary. A generic reference to the “security situation” should still be tested against the flight date, airport and actual operation.

Delay, denied boarding and check-in

EL AL security procedures make timely arrival and cooperation with screening particularly important. EU261 does not compensate a passenger who missed check-in or was refused for valid documentation or safety reasons. Keep proof of arrival at the airport and cooperation if boarding was denied despite valid documents.

Involuntary denied boarding caused by capacity or operational reasons on a covered departure can create immediate compensation, rerouting or refund and care. Do not sign a volunteer agreement unless the offered benefits and new itinerary are acceptable; volunteering changes the statutory position.

When the reason given is security screening, request written confirmation without demanding sensitive security details. Establish whether the refusal came from the airline, airport or state authority.

Care, hotel and out-of-pocket costs

On an EU261-covered departure, meals, communications, necessary accommodation and airport-hotel transport follow the waiting thresholds. They are not conditional on airline fault. Keep itemised receipts if EL AL does not provide support directly.

On an Israel departure, examine the assistance available under Israeli law and EL AL's policy. Do not label those expenses Article 9 EU261 costs if the regulation does not territorially apply.

Consequential losses, including a missed event or separate hotel at the destination, are not automatically care. Insurance, package law or further damages rules may need to be assessed.

Claims under the correct law

Lead with route and direction. For an EU departure, state the airport, LY flight, operating carrier, final arrival and EU261 remedy. Attach the booking, ticket, boarding pass, notice, rerouting and receipts.

For an Israel departure, identify the Aviation Services Law claim separately. If the journey touches the United Kingdom, assess UK261 without assuming it matches EU territorial rules.

EL AL publishes EU notices for flights departing EU airports and an English version of the Israeli law. Use the contact or refund channel corresponding to the remedy and save the submission proof.

If the rejection relies on extraordinary security circumstances, ask for the date, official restriction and effect on the flight. Enforcement follows the regime and departure; an EU national body does not become competent for every EL AL return merely because the passenger lives in Europe.

FAQ: Frequently asked questions

Is EL AL an EU airline?

No. EL AL is Israeli. Its departures from EU and EEA airports can still fall within EU261, but its separate Israel-to-EU flights usually do not.

Does EU261 cover an EL AL return to Europe?

Not automatically. Because EL AL is non-EU, an independently assessed departure from Israel is normally outside EU261. Israeli law may provide another claim.

Does a security cancellation remove every right?

No. A proven extraordinary security event may exclude fixed compensation, while refund, rerouting and care can remain under the applicable system.

Can denied boarding after security screening be compensated?

It depends on the reason and the passenger's cooperation, documents and timing. Capacity-based involuntary refusal differs from a justified safety or documentation refusal.

Should I quote EU261 and Israeli law in one demand?

Only where each genuinely applies. Set out the route and identify remedies under the correct framework rather than treating the laws as interchangeable.

What evidence matters most for an EL AL claim?

Keep the full itinerary, operating-carrier line, check-in and boarding proof, disruption notice, final arrival, replacement travel and itemised receipts.
