Delta right to care: meals, hotel and transport during disruption
Delta must provide reasonable meals, communication, accommodation and hotel transport when a covered EU261 or UK261 passenger faces a qualifying wait, even if severe weather or air traffic control means no fixed compensation is payable. A Delta-operated departure from Europe or the United Kingdom can qualify. A direct Delta flight beginning in the United States follows Delta's commitments and US rules instead, which do not create the same universal care duty.

For EU261, the expected departure delay threshold depends on distance:

UK261 uses corresponding thresholds. Once the relevant wait is expected, assistance should be proportionate to the delay. Cancellation and involuntary denied boarding also carry care while the passenger waits for rerouting.

What Delta should provide
Care under EU261 and UK261 includes meals and refreshments reasonably related to waiting time, plus two communications where needed. If a stay becomes necessary, it includes hotel accommodation and transport between the airport and the hotel.
The standard is practical, not luxurious. A meal voucher should be usable while airport outlets are open and sufficient for a reasonable meal. A hotel should be safe and suitable for the passenger's circumstances. Accessible passengers, children and people with medical needs should explain those needs immediately.
Delta may provide vouchers, make a booking or direct passengers to a contracted property. Keep the voucher and any balance information. If the voucher is unusable, photograph the closure or rejection and notify Delta before paying independently where possible.
Extraordinary circumstances do not remove care
Weather, air traffic control restrictions, airport closure and external security events can defeat fixed compensation when Delta proves the legal defence. They do not remove the protected passenger's right to reasonable care.
This distinction matters during long storms or airspace disruption. Delta may correctly refuse EUR 600 because the event was beyond its control yet still owe meals, an overnight room and hotel transfer. Submit the fixed-compensation issue and receipts as separate parts of the request.

Which Delta journeys are protected
EU261 covers a Delta-operated departure from an EU/EEA airport or Switzerland. UK261 covers a Delta-operated departure from a UK airport. Delta does not need to be European for these outbound journeys.
A direct Delta-operated New York-Paris, Atlanta-Amsterdam or Boston-London flight begins in the United States. The ordinary journey is outside EU261 and UK261 because Delta is not an EU or UK carrier. Delta's customer commitments may provide meals, hotel and transport for a controllable disruption, but weather and ATC are excluded from its ordinary US reimbursement policy.
The result can differ where Air France, KLM or Virgin Atlantic operates an inbound flight. Read the “operated by” line. The ticket seller and DL marketing number do not identify the statutory debtor by themselves.
Care while waiting for rerouting
When a protected flight is cancelled or boarding is denied, the passenger can choose reimbursement or rerouting. Care supports the passenger while waiting for rerouting at the earliest opportunity. Choosing cash refund and ending the journey can also end an open-ended accommodation obligation once further air transport is no longer awaited.
Tell Delta clearly if travel is still required. Ask it to confirm the replacement flight, cabin and final destination. If Delta offers a departure several days later, ask whether an earlier reasonable partner option exists.
Do not book an expensive replacement solely because the care queue is long. Replacement transport and waiting expenses have different tests. Preserve Delta's failure to reroute before making a significant purchase.
How long must hotel care continue?
Current EU261 does not contain a general three-night cap. Necessary accommodation can continue while the protected passenger reasonably awaits rerouting at the earliest opportunity. The carrier can still contest unnecessary, excessive or self-extended stays.
Accepting a much later flight for personal convenience rather than the earliest practical route may affect how long care remains reasonable. Ask Delta to record why the offered date was the earliest available and preserve any earlier alternatives shown.
If the passenger is at their home airport, hotel accommodation may not be necessary. Reasonable transport home and back can sometimes be the practical alternative, but agree this with Delta where possible and retain evidence.
Delta's current US commitments
For controllable cancellations, significant delays or missed connections, Delta states that it may provide meal vouchers after a wait of at least three hours, contracted hotel accommodation for an overnight disruption away from home or destination, and transport between the airport and hotel. The DOT customer-service dashboard records corresponding Delta commitments.
Current Delta guidance limits its ordinary reimbursement route to disruptions caused by Delta. It excludes weather and ATC, prepaid destination losses, lost wages and independently purchased transport to the final destination. US and Canadian residents use Delta's reimbursement form; other residents use its Comment and Complaint form.
This policy does not reduce stronger EU261 or UK261 care rights on a covered departure. State the protected origin when a European weather claim is incorrectly assessed under Delta's narrower US expense policy.
Reasonable spending when Delta provides nothing
First ask at the airport, in the app, by chat or by phone. Record the time and response. Then choose costs proportionate to the location, waiting period and passenger needs.
Usually defensible items include:
- ordinary meals and non-alcoholic drinks;
- a reasonably priced room near a practical transport route;
- taxi, train, shuttle or public transport to and from that hotel;
- essential communication costs;
- necessary accessibility arrangements not supplied by Delta.
Avoid luxury rooms, minibar charges, alcohol, entertainment, shopping and meals for people who were not affected passengers. If only an unusually expensive room is available, capture screenshots showing cheaper options were sold out.
Families and passengers requiring assistance
List every passenger on the booking and explain shared costs. One parent may pay for the room and meals, but the submission should identify all travellers and attach their tickets.
Tell Delta immediately about mobility equipment, medication refrigeration, an assistance animal, an unaccompanied minor or a child seat requirement. A technically available replacement is not suitable if essential assistance is missing. Keep any special service request code and airport report.
Do not assume family members must split into different flights. Ask for a workable joint reroute, but record if accepting a split is the only reasonable way to reduce delay.
Presenting the expense claim
Create a short chronology: scheduled flight, disruption, assistance request, Delta's answer, replacement and actual final arrival. Number each receipt and convert foreign currency using a documented rate if needed.
For every item, state date, purpose, amount, payer and passengers covered. Attach proof of payment, not only a card terminal slip with no description. Keep fixed compensation on a separate calculation.

Worked examples
Paris-New York cancelled by snow: Delta operates from the EU and reroutes next morning. Weather may defeat EUR 600, but reasonable dinner, hotel and transfer remain care items.
London-Atlanta delayed overnight by ATC: UK261 applies by departure. Preserve the assistance request and claim proportionate costs if Delta supplies no vouchers.
Atlanta-Amsterdam controllable cancellation: European care law ordinarily does not apply to this Delta-operated direction. Use Delta's current US commitments and reimbursement channel.
Amsterdam-New York delayed five hours: the protected long-haul threshold for care is four hours. Meals are due even if final arrival later remains under three hours and no fixed compensation arises.
