Delta delayed flight compensation: when EUR 600 or GBP 520 is due

A Delta delay can be worth up to EUR 600 after a departure from the EU, EEA or Switzerland, or up to GBP 520 after a UK departure, when the passenger reaches the ticketed final destination at least three hours late and Delta cannot prove an extraordinary cause. A completed Delta-operated flight from the United States into Europe normally has no equivalent EU261 or UK261 fixed-delay payment.

Which Delta delays enter EU261

A Delta-operated flight departing Paris, Amsterdam, Dublin or another covered European airport can fall under EU261. The airline's US nationality does not matter on an outbound journey. The same approach applies to relevant departures from Norway, Iceland and Switzerland.

An isolated Delta flight from New York to Paris normally does not qualify because Delta is not an EU airline. Purchasing the ticket in euros or beginning a holiday in Europe days earlier does not extend coverage to a separate inbound leg.

A continuous booking is more important. Suppose a passenger travels Amsterdam-Atlanta-New Orleans under one reservation and a problem on either Delta segment produces a five-hour final arrival delay. The journey began in the EU, so the final ticketed destination can control the assessment.

UK departures use a parallel test

Delta-operated services leaving Heathrow or another UK airport can be protected by UK261. Long-distance fixed compensation is currently GBP 520 per eligible passenger, subject to the cause and possible 50% reduction after sufficiently prompt rerouting.

The opposite Delta-operated direction from the United States to Britain is normally outside the fixed-payment rule. If Virgin Atlantic operated an inbound DL-coded flight, however, its UK carrier status changes the test.

Do not submit simultaneous euro and sterling demands for one delay. Select the system attached to the protected journey.

Measure arrival at the right place and time

The three-hour test concerns arrival at the final destination covered by the reservation. Touchdown is not the decisive event. Under European case law, arrival time is generally reached when at least one aircraft door opens and passengers are allowed to leave.

This distinction matters when an aircraft lands at 17:52 but waits for a stand until 18:18. Save the time shown in a reliable flight record, a timestamped message or a photograph, and note when the door actually opened.

For a through ticket, do not stop the clock at Atlanta or JFK if the booking continues to another city. Conversely, separately purchased tickets usually do not create statutory protection to the final self-transfer destination.

Most Delta-operated transatlantic departures sit in the highest distance band. If arrival on a long-distance journey is between three and four hours late, the carrier may be able to reduce the EUR 600 amount by half. At four hours or more, the full band normally becomes the starting point.

UK261 uses GBP 220, GBP 350 and GBP 520 bands. Compensation is calculated for each passenger, not each reservation. A group of three qualifying travellers can therefore have three long-haul claims.

Delay reason: what Delta must establish

Fixed compensation is not due when Delta proves both an extraordinary event and that the delay could not have been avoided even if all reasonable measures had been taken. The explanation must connect the event to this flight, not merely identify bad conditions somewhere in the network.

Potentially extraordinary causes include airport closure, severe weather affecting safe operation, binding air traffic restrictions and security events. Most routine technical defects are part of normal airline activity. A carrier's own staff strike also has a different legal treatment from an external air traffic-control strike.

Ask for the exact reason, affected rotation, restriction times and mitigation. A generic weather icon in the app is weaker evidence than an airport closure or a documented capacity decision.

Care is triggered before three-hour arrival compensation

On a protected EU or UK departure, the airline's care duty depends on expected waiting time and distance. Reasonable refreshments, communication, accommodation and hotel transport can become due even if the ultimate arrival delay is below three hours or the cause is extraordinary.

Ask Delta for assistance while waiting. If it provides nothing suitable, buy proportionate essentials and keep itemised receipts. Luxury accommodation, alcohol and avoidable upgrades are harder to recover.

Delta's US customer-service commitments use their own controllability and waiting-time language. Those policies should not be used to narrow mandatory EU or UK care on a covered departure.

Five-hour departure delay creates a choice

Once departure delay reaches at least five hours under EU261 or UK261, a passenger can decide not to travel and request reimbursement of the relevant ticket parts, plus a return to the first departure point when necessary. This is different from waiting to complete travel and later seeking fixed compensation based on arrival.

Evidence that makes a delay claim credible

Create a timeline with scheduled departure and arrival, actual door-opening time, each connection and the time Delta offered alternatives. Attach the ticket receipt, confirmation code, boarding passes, operated-by details and notices. Preserve proof that every passenger presented for travel.

If the claim concerns a missed connection, include the original complete itinerary and replacement. If Delta invokes extraordinary circumstances, request records identifying the restriction and reasonable measures. For care costs, submit receipts in a separate, clearly totalled section.

Delta's EU request page recognises delays over three hours. State the route direction at the top of the claim and avoid relying only on a screenshot of the delayed departure.

Delay examples

Paris-Seattle arrives 3 hours 25 minutes late after routine aircraft repair: EU261 covers the departure. The long-distance band may be reduced by 50% because arrival is under four hours, unless other timing facts alter the result.

London-Detroit arrives 5 hours late after a controllable crew issue: UK261 can produce GBP 520 per passenger, together with reasonable care costs not already supplied.

Detroit-Amsterdam arrives 7 hours late on Delta: no EU261 fixed payment normally arises from that direct US departure. Refund is usually unavailable once the delayed flight has been completed, though proven Montreal delay damage or contractual assistance may need review.

Amsterdam-Atlanta-Austin arrives 4 hours late after a protected misconnection: if both sectors were one reservation, measure the delay at Austin and identify which Delta operation caused it.

Is Delta compensation based on departure delay?

Fixed EU261 and UK261 delay compensation normally uses lateness at the final destination, while care and the five-hour refund choice use departure waiting time.

Does a three-hour Delta delay always pay EUR 600?
