Delta overbooking and denied boarding compensation

A passenger involuntarily denied boarding on an overbooked Delta flight may receive EUR 250–600 or GBP 220–520 when the departure is covered by EU261 or UK261. A passenger departing a US airport can instead qualify for DOT denied boarding compensation based on the one-way fare and replacement arrival time. These systems are different, and a volunteer who freely accepts Delta's offer normally relies on the terms of that agreement.

For European routes, confirm direction with the Delta EU departures guide. Delta being a US carrier does not remove EU261 from a flight leaving a covered European airport.

Voluntary and involuntary boarding denial

When a flight has more confirmed passengers than seats, Delta should first seek volunteers. A volunteer exchanges the seat for benefits negotiated with the airline. The offer can include cash, a gift card or travel credit, hotel, meals and a confirmed replacement.

Ask before agreeing:

  • Is the new seat confirmed or standby?
  • What is the final arrival time and cabin?
  • Does Delta provide a hotel, meals and ground transport?
  • When does any credit expire, and is it transferable?
  • Are remaining and return flights protected?
  • What happens if the replacement is also disrupted?

Do not say “yes” merely to hear the amount if gate staff may record that as acceptance. A passenger denied boarding against their will should ask for a written notice showing overbooking, the offered reroute and statutory payment.

EU261 compensation for Delta overbooking

EU261 applies to a Delta-operated departure from the EU/EEA or Switzerland. If the passenger had a confirmed reservation, presented on time and was ready to travel with valid documents, involuntary denied boarding generally creates compensation without requiring proof of a three-hour delay or airline fault.

The standard cash bands are:

Delta can reduce the amount by 50% when rerouting reaches the final destination within the regulation's distance-based two-, three- or four-hour limits. Long transatlantic EU departures commonly enter the EUR 600 band before any permitted reduction.

Compensation should be paid immediately in cash, bank transfer, cheque or another permitted monetary form. A travel voucher requires the passenger's signed agreement. Do not let a higher-looking credit conceal restrictions or waive a cash option without an informed choice.

UK261 compensation for a UK departure

A Delta-operated flight leaving the United Kingdom can be covered by UK261. The distance bands currently correspond to GBP 220, GBP 350 and GBP 520, with a possible 50% reduction after sufficiently prompt rerouting.

The same core distinction applies: Delta should seek volunteers first, while a passenger denied boarding involuntarily has statutory rights. Refund or rerouting and care are separate from the fixed payment.

A direct Delta-operated US-to-UK service is different because Delta is not a UK carrier. UK261 does not ordinarily cover that inbound direction. DOT rules may apply if boarding denial occurred at the US departure airport.

DOT payment for a US departure

US rules cover qualifying involuntary bumping from an oversold flight departing a US airport. The passenger generally needs a confirmed reservation, timely check-in, timely gate arrival and acceptable travel documents. Delta must be unable to transport the passenger to the destination within one hour of the original planned arrival.

DOT currently calculates required payment from the one-way fare:

The current published caps are USD 1,075 for the 200% tier and USD 2,150 for the 400% tier. DOT adjusts limits periodically, so check the official table on the incident date. No required payment applies when the planned replacement arrival is within one hour.

Delta should offer eligible payment at the airport on the same day. If substitute transport departs before payment can be made, DOT states that payment should follow within 24 hours.

When denied boarding compensation may not apply

Not every refusal at the gate is overbooking. Compensation can fail where the passenger arrived late, lacked required documents, posed a safety or security issue, did not comply with reasonable conditions of carriage, or accepted a voluntary deal.

US bumping rules also contain exceptions for certain aircraft substitutions, weight and balance restrictions on smaller aircraft and downgrading where the fare difference is refunded. European law separately allows denial for reasonable health, safety, security or documentation grounds.

Ask for the exact reason. “Operational” is too vague to distinguish oversales from an aircraft change, document issue or safety decision. Preserve the boarding pass and a screenshot showing successful check-in and gate presence.

Refund, rerouting and care

Under EU261 or UK261, an involuntarily denied passenger chooses reimbursement or rerouting. If the trip remains useful, ask for travel at the earliest opportunity under comparable conditions. If it no longer serves its purpose, request refund of the unused ticket and, where relevant, a return to the first departure point.

Delta also owes reasonable care while a protected passenger waits: meals, communication, hotel accommodation when necessary and hotel-airport transport. These are not deducted from fixed compensation.

For a US departure, Delta's customer commitments and the replacement arrangement govern care in addition to DOT's bumping payment. Confirm every promised hotel or meal benefit in writing.

Operating carrier and partner flights

A ticket displaying a DL flight number can be operated by Air France, KLM, Virgin Atlantic or another partner. The carrier that actually planned and performed the flight handles the statutory denied boarding claim.

For example, Air France operating Paris-New York under a DL code is responsible under EU261. Delta operating the same route under an AF code is responsible. The Delta codeshare guide helps identify the correct recipient.

If Delta reroutes the passenger on a partner, the replacement carrier does not become responsible for the original overbooking merely by transporting them. Keep both sets of boarding records.

Evidence to collect at the gate

Obtain or preserve:

  • booking confirmation, ticket number and PNR;
  • boarding pass and proof of timely check-in;
  • a timestamped record of gate presence;
  • Delta's written denied boarding reason;
  • the volunteer offer and whether it was rejected;
  • the statutory rights notice;
  • payment or voucher terms;
  • original and replacement arrival times;
  • hotel, meal and transport receipts;
  • names and ticket numbers for every affected passenger.

If staff refuse a written confirmation, send Delta a message from the airport recording the time, gate and wording used. Contemporaneous evidence is much stronger than a reconstruction weeks later.

Worked examples

Amsterdam-New York overbooked: Delta involuntarily removes a timely passenger and reroutes them to arrive six hours late. EU261 applies by departure; the long-distance band is EUR 600 before assessing any lawful reduction.

London-Atlanta volunteer: Delta offers GBP 900 credit, hotel and a confirmed morning flight. The passenger accepts in writing. The agreement ordinarily replaces involuntary denied boarding compensation, so its exact terms matter.

Atlanta-Paris involuntary bump: boarding denial occurs at a US airport. Apply DOT's international timing and fare formula, not EU261, even though the destination is France.

Paris-New York with DL code operated by Air France: the statutory claim goes to Air France as operator. Delta's role as marketer does not transfer liability.
