Brussels Airlines delayed flight compensation: when does EU261 pay?
Short answer: if a Brussels Airlines-operated journey reaches its final destination at least three hours late, each qualifying passenger may be due EUR 250, EUR 400 or EUR 600. The claim fails only where coverage or another condition is missing, or Brussels Airlines proves extraordinary circumstances and reasonable measures. Meals, accommodation and rerouting can remain due even when the fixed sum is not.

What happened to your flight?

Choose the situation that applies to your flight:
A delay claim is not decided by how long passengers wait at Brussels Airport or when the aircraft touches down. The comparison is between scheduled arrival and the moment a door opens at the ticketed final destination. That distinction is decisive on connected journeys through BRU.
Four elements of a delay claim
| Element | What to establish |
|---|---|
| Coverage | EU261 or UK261 applies to the itinerary and operator |
| Qualifying delay | Final arrival is normally at least three hours late |
| Responsible airline | Brussels Airlines actually operated the disrupted sector |
| Cause | The carrier cannot prove an unavoidable extraordinary event |
Because Brussels Airlines is established in the EU, an SN-operated return from a third country to Brussels can be covered. A Nairobi–Brussels service actually operated by Brussels Airlines is not excluded merely because the departure airport is outside Europe. An SN-coded partner flight needs the operating-carrier test.
Measure arrival, not touchdown
The Court of Justice treats arrival as the time when at least one aircraft door opens and passengers are allowed to leave. Flight-tracking websites often show touchdown or gate time, so they are supporting evidence rather than the complete answer.
For a borderline case, preserve:
- a timestamped photograph or message after the door opens;
- the Brussels Airlines notification and revised itinerary;
- airport arrival information and independent flight data;
- a written note of touchdown, gate arrival and door opening;
- messages sent by other passengers at the time.
The separate three-hour guide explains how to handle a result close to 180 minutes.
Connections through Brussels Airport
On one reservation, the final ticketed destination usually controls the delay. Suppose a traveller books Manchester–Brussels–Kigali on one ticket. The first sector arrives 80 minutes late, the onward flight is missed, and the passenger reaches Kigali eleven hours late. The legal delay is assessed at Kigali, not at BRU, even though neither original sector was scheduled to be three hours long.
Separate tickets are different. If the first booking ends in Brussels and the traveller independently bought a later flight, the second journey is usually not protected as the final destination of the first contract. Travel insurance, package-travel duties or a flexible-fare remedy may still help, but EU261 does not automatically join the bookings.
Read the BRU missed-connection guide before claiming on a mixed-airline itinerary.
Distance and payment
| Journey category under EU261 | Standard amount |
|---|---|
| Up to 1,500 km | EUR 250 |
| Intra-EU over 1,500 km | EUR 400 |
| Other journey from 1,500 to 3,500 km | EUR 400 |
| Other journey over 3,500 km | EUR 600 |
For a long journey over 3,500 km to or from outside the EU, arrival between three and four hours late can reduce EUR 600 to EUR 300. At four hours or more, the full EUR 600 is the normal band if all conditions are satisfied. Families calculate the amount for each eligible traveller, including children travelling on a qualifying paid or publicly available award ticket.
Causes: ask for a chain, not a label
Brussels Airlines must prove more than “weather,” “air traffic control” or “operational reasons.” A defensible refusal should identify the event, show when and where it occurred, connect it to the flight, and explain why reasonable alternatives could not prevent the final delay.
Ordinary component failure, crew allocation and late aircraft rotation generally belong to airline operations. Severe weather at the relevant airport, a binding air-traffic restriction, a security closure or certain bird-strike consequences may be extraordinary. Even then, the airline should show reasonable measures such as sensible rerouting, use of available resources and avoidance of an excessive knock-on delay.
If the disruption began on an earlier rotation, request the flight sequence and timing. An extraordinary event affecting one aircraft does not give unlimited immunity for every later service. The carrier must establish a sufficiently direct causal link.
Care begins before three hours in many cases
The three-hour arrival threshold belongs to fixed compensation. Care uses departure-delay thresholds of two, three or four hours depending on distance. Brussels Airlines says a refreshment voucher is linked to the boarding-pass QR code after a qualifying delay; check the app and boarding pass, but do not wait indefinitely if reasonable food is needed.
When an overnight stay becomes necessary, the airline should arrange a hotel and transport. If it does not, choose a reasonable option and keep itemised receipts. Alcohol, luxury accommodation and unrelated shopping are difficult to recover. Care remains due when bad weather or ATC caused the wait.
After five hours at departure, Article 8 can permit reimbursement if the journey no longer serves its purpose, plus a return to the original departure point where relevant. Do not accept a refund casually if you still need transportation: refund normally ends the carrier's rerouting obligation.
Submit an evidence-led request
State the booking reference, flight date, route, actual operator and scheduled final arrival. Add actual door-opening time, total delay, amount and bank details. Attach the original itinerary, boarding passes, rebooking record and notices. Put care expenses on a separate schedule.
If several passengers are included, list each claimant and amount. Keep a copy of every attachment and the confirmation generated by the Brussels Airlines form. A short chronology is more useful than a long account of frustration.
Brussels Airlines' Conditions of Carriage currently specify a one-year period for actions based on EU261 under Belgian law. Do not wait for the airline's internal correspondence to consume that period. The deadline guide sets out mediation and enforcement options.
FAQ
Is three hours measured at departure or arrival?
Fixed delay compensation is normally measured at arrival at the final destination. Departure delay matters separately for care and the five-hour reimbursement option.
Can an 80-minute feeder delay produce EUR 600?
It can when flights are on one reservation, the delay causes a missed connection and the passenger reaches a long-haul final destination at least three hours late.
Is a Brussels Airlines flight from Africa back to Belgium covered?
Usually yes when Brussels Airlines operates it, because the carrier is established in the EU. A partner-operated sector must be assessed using the partner's identity.
What if Brussels Airlines says the previous rotation was affected by weather?
Ask for the event, affected rotation, timestamps, direct causal link and reasonable measures. Weather on an earlier service does not automatically excuse every later delay.
Can I claim meals as well as EUR 250-600?
Yes. Reasonable care costs and fixed compensation are different remedies. Keep receipts and present the expense claim separately.
