British Airways UK flight compensation under UK261

Reviewed on 10 August 2026. UK261 protects British Airways flights departing from the United Kingdom and also reaches many BA-operated arrivals because BA is a UK carrier. A qualifying delay, short-notice cancellation or involuntary denied boarding can produce GBP 220, GBP 350 or GBP 520 per passenger, while refund, rerouting and care remain separate rights.

The route and actual operator matter more than the BA code. A partner-operated codeshare arriving at Heathrow may have different territorial coverage from a service flown by British Airways Plc, BA CityFlyer or BA Euroflyer.

The UK CAA describes protection as covering flights leaving the UK on any airline, arrivals in the UK on a UK or EU carrier, and arrivals in the EU on a UK carrier. Always confirm the current operating-airline notice before relying on the last two categories.

For long delay above 3,500 km, current CAA guidance gives GBP 260 when final arrival is between three and four hours late, and GBP 520 when it exceeds four hours. Cancellation and denied-boarding rerouting can also trigger a half reduction where the substitute reaches the destination within the specified two-, three- or four-hour window.

The amount does not depend on cabin or fare. A discounted economy passenger and a Club World passenger on the same disrupted service use the same fixed band. Cabin downgrade, however, has a different percentage reimbursement based on the affected flight price.

Long delay under the UK rules

Measure lateness at the final destination on a directly connecting booking. The usual arrival marker is the first aircraft door opening with permission to leave, not wheels touching the runway. A domestic feeder delay that causes a missed BA long-haul connection can make the final result compensable.

Suppose a passenger holds Aberdeen-Heathrow-Miami in one reservation. The first service is 65 minutes late, the connection is missed, and BA reroutes the passenger to arrive ten hours behind schedule. UK261 applies from the UK departure and the final arrival controls the delay analysis. Great-circle distance normally runs from Aberdeen to Miami.

Separate tickets do not automatically combine. If the passenger independently purchased Aberdeen-London and London-Miami, each contract requires its own destination and cause assessment.

Cancellation and the passenger's choice

Cancellation activates a choice between reimbursement, rerouting at the earliest opportunity and later travel at the passenger's convenience subject to availability. BA's current disruption page permits rebooking and recognises comparable alternative transport when it cannot provide a suitable option. CAA guidance expects the airline to consider another carrier where that materially improves earliest rerouting.

Fixed compensation usually depends on receiving notice less than 14 days before departure. In the seven-to-13-day and under-seven-day windows, a sufficiently close replacement schedule can remove the fixed award. The refund or rerouting choice exists regardless of whether BA proves extraordinary circumstances.

Do not select refund if transport is still wanted. Repayment generally closes the carriage choice and ends continuing care. Keep a screenshot of the options before confirming.

Care while stranded in the UK

For a qualifying wait, BA should provide reasonable food and drink, communication, accommodation if an overnight stay is necessary, and transport between airport and hotel. The duty is not a reward for airline fault. Fog or an external ATC restriction can remove compensation while leaving care intact.

Ask BA to arrange assistance. If it fails, choose proportionate services and retain itemised receipts. A premium airport hotel may be reasonable when it is the only safe late-night option, but document availability and BA's failure to respond. Alcohol and destination losses are not ordinary care items.

At five hours of departure delay, the passenger can abandon the journey and seek the relevant ticket refund. If a through trip has already begun and no longer serves its purpose, return transport to the original departure point can also be relevant. The BA five-hour delay page explains that election.

Operating airlines within the BA brand

British Airways' conditions define "we" to include British Airways Plc, BA CityFlyer and BA Euroflyer. They remain separate operating entities. BA CityFlyer commonly performs services associated with London City, while BA Euroflyer operates BA-branded services from Gatwick.

The legal claim should name the company shown as operator. A wet-leased aircraft does not necessarily transfer operating-carrier status to the aircraft owner; look at who had operational responsibility and how passengers were informed. For a oneworld codeshare, the partner may be responsible even though the booking was made at ba.com.

UK261 and EC261 can overlap without double compensation

A BA-operated Madrid-Heathrow flight departs the EU and arrives in the UK on a UK carrier. Both territorial descriptions may be relevant. This does not entitle the passenger to two fixed awards for the same disruption.

Choose a coherent legal basis and disclose any payment already received. The two regimes retain similar core amounts but use different currencies and can diverge as law develops. The UK261 versus EC261 guide addresses overlap, inbound routes and enforcement.

The EU reform adopted in July 2026 does not automatically amend UK261. Its future nine-month claim procedure and response timing belong to the EU framework once applicable. British claims continue under current UK law unless Parliament changes it.

Claim evidence

Save the original ticket, boarding pass, operating-carrier notice, cancellation message and replacement itinerary. Record final door-opening time and the cause BA gave. Keep care receipts in a separate schedule.

In the submission, state UK departure or qualifying arrival, distance band, passenger count and amount. Ask for event-specific proof if BA relies on extraordinary circumstances. Use BA's compensation route for the fixed sum and its expense form for costs.

If BA refuses, its complaint page directs dissatisfied passengers to CEDR. CAA guidance says ADR can generally be approached after a final response or eight weeks without resolution, subject to the provider's scheme rules.

FAQ

Does UK261 protect every British Airways flight worldwide?

No. BA's UK-carrier status creates broad inbound coverage, but the territorial rules still require a qualifying UK or EU departure or arrival category.

Can a US passenger use UK261 from Heathrow?

Yes. Nationality and residence do not decide the right. A covered UK departure receives the same statutory framework for eligible passengers.

Is GBP 520 payable after exactly three hours on long haul?

Not normally in full. CAA guidance gives GBP 260 for a route above 3,500 km when arrival is between three and four hours late.

Does UK261 cover BA CityFlyer and BA Euroflyer?

Their UK operations can be covered, but name the particular operating company shown on the travel documents rather than using the group brand alone.

Will the new EU nine-month procedure change UK claims?

No automatic change follows. UK261 is domestic law after Brexit, so later EU amendments do not amend it by themselves.
