British Airways changed the flight time: refund and compensation tests
Reviewed on 10 August 2026. A British Airways schedule change can amount to a legal cancellation when the original service is abandoned or moved substantially, especially when departure is brought forward by more than one hour. Refund and rerouting rights can then arise, while fixed compensation depends on notice, replacement timings, coverage and cause.

Classify the change
| BA action | Starting point |
|---|---|
| Departure moved a few minutes | Usually a timetable adjustment |
| Departure brought forward by more than one hour | Can be treated as cancellation under CJEU case law |
| Original flight removed and passenger moved to another service | Strong cancellation indicator |
| Arrival changed after a new connection is inserted | Assess replacement and final arrival |
| Airport changed within a city region | Check transfer duty and practical arrival |
| Passenger asks to travel on another date | Voluntary fare rules may apply |
The label in the email is not decisive. Compare flight number, operating carrier, airports, departure, arrival and connection structure.
Why an earlier departure can be a cancellation
In the joined 2021 judgments on brought-forward flights, the Court of Justice held that moving departure forward by more than one hour can be treated as cancellation. The change creates serious inconvenience because passengers must reorganise travel and be available earlier.
Suppose BA moves a 10:30 Heathrow departure to 08:45 ten days before travel. Calling it a "schedule adjustment" does not prevent the cancellation analysis. The passenger should test the seven-to-13-day replacement window: a flight leaving more than two hours early falls outside the exception that can remove fixed compensation.
When notice arrives less than seven days before departure, the protected replacement may leave no more than one hour early and arrive less than two hours late. Exact notice and new timings therefore matter.
Refund and rerouting options
If the change is legally a cancellation, BA should offer reimbursement, earliest rerouting or later travel at the passenger's convenience subject to availability. The passenger should not be forced to accept a materially earlier service that defeats the purpose of travel.
Ask for alternatives near the original time, including reasonable partner services. If BA cannot offer a suitable route, document the search and response before self-booking. A cash refund is appropriate when travel no longer has value, but choosing it ordinarily ends the transport obligation.
For a minor non-cancellation schedule adjustment, rights can still arise under ticket terms or consumer law. BA may permit rebooking commercially. Do not describe a voluntary waiver as statutory compensation.
Notice evidence
Save the first email, text, app notification and agent message. Record when it was received, not merely the date shown in the revised itinerary. BA can rely on sufficiently early notification, so transmission evidence can decide the claim.
When an OTA booked the ticket, ask when BA informed the intermediary and when the intermediary informed the passenger. The legal effect can depend on agency and booking facts. Keep contact details that were stored in the reservation.
A website displaying a changed time is not necessarily proof that BA communicated it on that date. Request the notification log if the airline rejects compensation as more than 14 days' notice.
Connections and final destination
A timetable change may turn a valid Heathrow connection into an impossible one or add an overnight transfer. On one ticket, BA should reroute the passenger to the final destination rather than refunding only the altered feeder without agreement.
Compare both departure and final arrival. An earlier first flight followed by an eight-hour wait can still create substantial inconvenience even if final arrival remains unchanged. The fixed cancellation rules focus on specified replacement windows, while package or contractual remedies can address other consequences.
If separate tickets cease to connect, UK261 and EC261 do not automatically merge them. Check insurance and whether BA offered the original transfer as part of one booking.
Amount and cause
Once cancellation treatment and short notice are established, distance selects GBP 220/350/520 under UK261 or EUR 250/400/600 under EC261. A qualifying replacement arriving within two, three or four hours can reduce the amount by half.
BA can avoid fixed compensation by proving extraordinary circumstances and reasonable measures. A strategic timetable consolidation or ordinary aircraft planning is not automatically extraordinary. An airport closure requiring all airlines to retime services can be different.
Refund and rerouting do not depend on the defence. Care can also be due where the passenger waits away from the original schedule.
Airport and cabin changes
Moving between Heathrow, Gatwick or London City can create surface transport issues. Where rerouting uses another airport serving the same city or region, the airline can owe transfer to the booked airport or another nearby destination agreed with the passenger. Save rail, coach or taxi receipts and ask BA to arrange transport first.
A schedule change that also places the passenger in a lower cabin creates a separate Article 10 question. Fixed compensation does not replace 30%, 50% or 75% reimbursement for downgrade. Preserve booking class, original cabin and flown cabin.
Likewise, changing an aircraft and seat while retaining the same cabin is not a statutory downgrade. Claim any paid seat service under its own terms.
Claim structure
Attach the original and revised e-tickets, communication timestamp, alternatives offered and operating carrier. State why the change is cancellation in substance and apply the correct notice window. Give the new departure and final arrival relative to the original schedule.
If BA refuses, ask whether it disputes cancellation classification, notice, timings, cause or amount. Each issue needs different evidence. The BA cancelled-flight guide provides the full option table, while the claim-rejection guide covers CEDR.
The EU reform adopted in July 2026 is not yet applicable. Use current law for a change notified on this review date and recheck the rules for future travel after the reform begins to apply.
FAQ
Is every British Airways schedule change a cancellation?
No. Minor adjustments are not automatically cancellations. Examine how far departure moved, whether the original service remained and what replacement was imposed.
What if BA moves my flight two hours earlier?
A brought-forward departure exceeding one hour can be treated as cancellation. Notice and replacement timing then determine possible fixed compensation.
Can I insist on a flight near my original time?
After a legal cancellation, ask for reasonable rerouting at the earliest opportunity. BA should consider suitable alternatives, not only the imposed retiming.
Does changing Heathrow to Gatwick create transport rights?
It can. Where another airport serves the same region, BA may owe transfer to the booked airport or an agreed nearby point.
Is a changed seat a cabin downgrade?
Not if the passenger remains in the booked cabin. A paid seat fee may be refundable, but Article 10 concerns a lower class of service.
