British Airways Holidays disruption: separate package and airline claims

Reviewed on 10 August 2026. A British Airways Holidays package can create rights against the package organiser alongside UK261 or EC261 rights against the airline operating the flight. Check the package confirmation and ATOL certificate, preserve every component, and claim flight compensation, package price reduction and out-of-pocket costs under the correct headings without recovering the same loss twice.

BA Holidays says UK-booked flight-inclusive packages are ATOL protected under number 5985. ATOL concerns insolvency protection; it is not the source of ordinary delay compensation.

Branding is not enough. The ATOL certificate names the protected organiser and services. BA's package terms also distinguish packages bought while located in the UK from some non-UK purchases.

Flight rights remain individual

A package passenger does not lose UK261 or EC261. If the operating flight reaches the final destination at least three hours late, is cancelled with insufficient notice or denies boarding, each eligible passenger can have fixed compensation.

The claim goes to the operating airline. British Airways Plc, BA CityFlyer, BA Euroflyer or a partner may perform the flight. Fixed amounts are not reduced because the package displayed one combined price.

Care during the airport wait also remains an airline duty. Ask for meals, hotel and transport. If British Airways Holidays separately arranges accommodation, do not send the same hotel invoice to both entities.

Package remedies address the holiday as a whole

Package travel law makes the organiser responsible for performance of included services. A two-day flight delay can remove hotel nights, transfers and a material share of a short trip even after the airline reroutes passengers.

Notify BA Holidays promptly using the support details in the booking. Explain which package elements are unavailable and ask for an integrated solution. A new flight alone may not repair a three-night holiday reduced to one night.

Where services are not provided as contracted, suitable alternatives, price reduction or damages can be relevant. Give the organiser an opportunity to fix the problem unless immediate action is necessary.

Before departure

British Airways' current disruption page says a customer whose package flight is cancelled may rebook on an alternative BA flight, move travel dates where itinerary and duration remain the same, or cancel the entire holiday package for a full refund to the original payment method.

Read the current offer rather than assuming every schedule change cancels the package. Ask whether hotel, car, transfer and experiences move with the flight. Save the complete revised package price and dates.

If the organiser makes a significant change to an essential term, package rules can give a choice among accepting it, taking a substitute package or terminating. Response deadlines in the notice should be observed.

After travel has started

Use the BA Holidays 24-hour contact provided for the trip. Record unavailable hotel nights, transfer failures and substitute services. Photographs, messages and supplier statements help prove non-conformity.

If the organiser cannot supply a significant portion, ask for suitable alternatives at no extra cost. Where an alternative is lower quality, a price reduction may be due. Reasonable self-help can be recoverable when the organiser fails to remedy a problem that requires immediate action.

Keep flight and package expenses in separate schedules. The airport hotel during rerouting is normally airline care; the lost destination hotel night is a package-performance issue.

ATOL protection and its limits

ATOL protects covered travellers against organiser insolvency and can arrange refunds or repatriation when the ATOL holder fails. It does not pay ordinary GBP 220-520 flight compensation or decide whether the package was poorly performed while the organiser trades.

BA's terms identify ATOL 5985 for qualifying UK-located purchasers and state that the scheme does not reimburse Avios used as payment, although stranded-passenger protection can still operate. Inspect the actual certificate because not every BA-branded combination has identical protection.

Package Travel Regulations give contractual protections beyond ATOL. Do not describe insolvency cover as the whole package remedy.

Avoid duplicate recovery

Fixed flight compensation addresses regulated inconvenience. Airline care repays reasonable waiting needs. Package price reduction addresses missing or lower-value holiday services. Insurance can cover specified additional loss.

All may coexist, but one dinner or hotel night should be paid once. Maintain a payment ledger naming respondent, legal basis, item and amount. Disclose relevant settlements where another claim concerns the same loss.

Example: a family loses two of seven resort nights after BA's ordinary cancellation. It can pursue fixed flight compensation per passenger, care at Heathrow and a package price reduction for unused hotel and transfer services. It should not claim the same Heathrow room from both BA and the organiser.

Evidence and complaint structure

Keep the package confirmation, ATOL certificate, flight e-ticket, operating carrier, cancellation messages and revised itinerary. Add supplier contacts, unavailable services, photographs, expense receipts and organiser responses.

Send the flight claim through BA Customer Relations. Send package performance to British Airways Holidays under its terms. Cross-reference them only where facts overlap and state the remedy requested from each.

If the package dispute remains unresolved, inspect the current ADR or travel-association route in the terms. CEDR handles eligible airline complaints but should not automatically be assumed to decide every land-service issue.

Is every flight-and-hotel booking a BA Holidays package?

No. Look for a package confirmation and ATOL certificate. Separately purchased services can remain separate contracts.

Who pays flight compensation on a BA holiday?

The operating airline handles UK261 or EC261 fixed compensation. The package organiser deals with performance of the combined holiday.

Does ATOL compensate an ordinary flight delay?

No. ATOL primarily protects against organiser insolvency. Flight regulation and package law provide the ordinary disruption remedies.

Can I claim both package price reduction and GBP 520?

Potentially, because they address different interests. Do not recover the same expense or service loss twice.

Are Avios protected by ATOL?

BA's current package terms say ATOL does not reimburse Avios used as payment, although other package and flight rights can remain.
