British Airways delayed flight compensation: arrival time, cause and amount

BA's app may display an estimated delay, but estimates change. Preserve screenshots at meaningful stages and obtain an independent flight record after arrival. A claim close to three hours deserves especially careful proof.
Measure delay at arrival
European case law treats actual arrival as the moment at which at least one aircraft door opens and passengers are allowed to disembark. Touchdown, reaching the stand and the door event are different. If a flight lands two hours and 55 minutes late but remains closed for another ten minutes, the later event may cross the compensation line.
Write down the time immediately and ask another passenger to confirm it. Flight-tracking services often record landing or gate time rather than the precise door event, so combine data sources. BA operational records can settle a close dispute and should be requested if the rejection relies on an arrival figure you contest.
The threshold is "three hours or more" in the case law, although BA's consumer wording sometimes says "more than three hours". One booking and the final destination
For directly connecting flights sold as one transport operation, assess delay at the destination on the ticket. Suppose BA carries a passenger from Edinburgh to Heathrow, then onward to Toronto on the same booking. A late first sector causes the Toronto service to be missed, and rerouting arrives seven hours late. The final delay, not merely the Edinburgh-Heathrow delay, is central.
The Folkerts judgment confirms that compensation does not depend on the first flight itself reaching a departure-delay threshold. It is enough that a protected through journey reaches its final destination at least three hours late, subject to the remaining conditions. The straight-line distance from first departure to final destination normally sets the amount.
Separate tickets change the picture. If the passenger independently bought Manchester-Heathrow and Heathrow-New York reservations, the second flight is not automatically part of the first carrier's final destination. Contractual assistance, travel insurance or a card benefit may help, but the two bookings should not be presented as one EC261 or UK261 itinerary.
Choose UK261 or EC261 before calculating
UK departures are ordinarily protected by UK261. BA-operated arrivals into the United Kingdom also usually fall within the UK system because BA is a UK carrier. Flights departing an EU airport use EC261 even though BA is no longer an EU airline.
Inbound EU coverage is narrower. A BA flight leaving a third country for an EU destination does not generally qualify under EC261 because BA is a UK, not Community, carrier. A previous EU sector on a different ticket does not cure that. Through journeys and overlap questions require the itinerary as a whole, so use the UK261 versus EC261 analysis before demanding the wrong currency.
For long routes exceeding 3,500 km, a delay between three and four hours can produce a reduced amount. Current UK CAA guidance gives GBP 260 in that interval and GBP 520 after four hours. Do not quote GBP 520 solely because the destination is far away.
The reason for delay must be proved
Compensation follows unless the operating carrier demonstrates an extraordinary event and all reasonable measures. The cause should be tied to the specific aircraft, crew or restriction. "Operational reasons" provides too little information to test the defence.
Ordinary wear, a routine component failure, a foreseeable knock-on from BA's rotation and normal staff absence usually belong to airline operations. The Supreme Court's Lipton decision rejected BA CityFlyer's attempt to treat a pilot's unexpected illness as extraordinary. A hidden manufacturing defect disclosed by the manufacturer, sabotage or an external airspace closure can lead elsewhere.
Weather must be incompatible with safe operation for the relevant flight, not merely present somewhere in the network. An air-traffic slot should be supported by the restriction and timings. Even after an external event, BA must show how it allocated aircraft or crews, considered rerouting and limited the resulting delay.
If extraordinary and ordinary causes both contribute, isolate their periods. The airline should not subtract the whole delay merely because one external event occurred during the day.
Care starts before compensation is known
The right to food, drink, communication, accommodation and hotel transport is linked to waiting thresholds and circumstances, not the final decision on fixed compensation. A passenger should not have to sleep at Heathrow while BA investigates the cause.
Ask for vouchers and accommodation first. If none is provided within a reasonable time, choose proportionate options and keep itemised receipts. Luxury purchases, alcohol and remote premium hotels are vulnerable to challenge when sensible alternatives existed. Consequential losses such as a missed concert or non-refundable hotel at the destination are not ordinary care expenses.
At a five-hour departure delay, a passenger who no longer wants to travel can have a separate refund choice. A strong delay claim file
Create a chronology with scheduled departure and arrival, actual door-opening time, missed connections, replacement flights and final arrival. Include booking confirmation, e-ticket, boarding passes, BA messages and the operating-airline line. Save photographs of information screens and written explanations from staff.
State the distance band and requested amount per passenger. A family claim should list each traveller separately because the fixed award belongs to each eligible passenger. Explain the cause evidence you have and ask BA to disclose the basis for any extraordinary-circumstances defence.
